Holzmeister, District Clerk SPECIAL MEETING February 25, 1991 The special meeting of the Board of Directors of the Truckee Donner Public Utility District was called to order at 4 : 00 PM in the TDPUD Board room by President Aguera. ROLL CALL: Directors John Corbett, Richard Curran, James Maass and Joe Aguera were present; Director Sutton was on vacation and unable to attend. EMPLOYEES PRESENT: Andy Hyde, Peter Holzmeister and Susan Craig. CONSULTANTS PRESENT: Counsel John Phelps. There were no others present in the audience. POSSIBLE ACTION REGARDING WATER SYSTEM IMPROVEMENTS CONSIDERATION AND ACCEPTANCE OF REVISED ENGINEERING REPORT FROM SAUERS ENGINEERING Counsel Phelps reported that, by including some of the information orally provided by Mr. Sauers at the February 19 Board meeting, to the written engineering report prepared by Sauers Engineering it better conforms to the requirements of the law. Keith Sauers, Mr. Hyde noted, reviewed Mr. Phelps' suggestions and agrees that the report be amended. Director Maass moved, and Director Curran seconded, that the amended engineering report be approved. All Directors, aye, by voice vote. So MOVED. RESOLUTION TO INITIATE PROCEEDINGS TO FIX WATER STANDBY CHARGES Director Maass moved that the Board adopt Resolution No. 9107 rescinding Resolution No. 9105 and initiating proceedings to fix water standby charges. (Such resolution contains the same provisions as 9105, but changes the public hearing date from March 11 to March 18 in order to allow notification to be published twice) . The motion was seconded by Director Corbett. ROLL CALL: Sutton, absent; all other Directors, aye. SO MOVED. CALL FOR HEARING ON ORDINANCE APPROVING FINANCING DOCUMENTS Director Maass moved that a public hearing on an ordinance approving financing documents for the water system improvements be scheduled for March 18, 1991. The motion was seconded by Director Corbett. All Directors, aye, by voice vote. So MOVED. AUTHORIZATION FOR DISTRICT COUNSEL TO ATTEND SPECIAL DISTRICT BOARD MANAGEMENT INSTITUTE IN SAN DIEGO Counsel Phelps indicated a desire to attend the Special District Board Management Institute in San Diego on March 1, 2 and 3 . 2/25/91 1 Manager Holzmeister noted that he spoke with Director Sutton by telephone and she asked that he convey to the Board the fact that she is in favor of Counsel attending the seminar. Director Corbett moved, and Director Maass seconded, that Counsel Phelps be authorized to attend the Special District Board Management Institute with the District to pay the related expenses. All Directors, aye, by voice vote. SO MOVED. ADJOURNMENT There being no further business before the Board, Director Maass moved that the meeting be adjourned b t voice vote seconded SO MOVED. C aig, Deputy District Cler smc 2/25/91 2 RESOLUTION NO. 9107 Of THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT INITIATION OF PROCEEDINGS TO FIX WATER STANDBY CHARGES WHEREAS, the Board of Directors of the Truckee Donner Public Utility District desires to initiate the proceedings required to fix standby charges under the Uniform Standby Charge Procedures Act (Sections 54984 et seq. of the California Government Code, the "Standby Charge Act") ; and WHEREAS, the report of Sauers Engineering, Inc. , a qualified engineer is on file with the Truckee Donner Public Utility District' s Engineering Department and contains all of the following in accordance with Section 54984 .2 of the Standby Charge Act: (1) a description of the standby charges and the method by which they will be imposed; (2) a compilation of the amount of the standby charges proposed for each parcel subject to the charges; (3) a statement of the methodology and rationale followed in determining the degree of benefit conferred by the service for which the standby charges are made; and (4) certain other factors listed in Section 54984 . 2 of the Standby Charge Act; WHEREAS, a description of the lands upon which the standby charges are to be imposed is on file with the District' s Engineering Department; NOW, THEREFORE, the Board of Directors of the Truckee Donner Public Utility District hereby resolves as follows: 1. That Resolution No. 9105 of the District is hereby repealed and rescinded and this resolution shall replace Resolution No. 9105 in its entirety. 2 . That the Board shall conduct a hearing at 7 : 45 PM on March 18, 1991 to hear and consider all objections or protests, if any, to the passage of a resolution imposing standby charges at an annual rate of $80 per parcel , regardless of parcel size, applied to each parcel in the District for which water service is available but not used, as described in the engineering report and in the description of the lands upon which the standby charges are to be imposed. 3 . That the General Manager of the District shall cause to be published a notice of the time and place of such hearing on the proposed standby charges, pursuant to Section 6066 of the California Government Code, prior to the date set for the hearing, in the Sierra Sun, a newspaper of general circulation printed and published within the jurisdiction of the District. 4 . That the General Manager of the District shall cause to be mailed a notice in writing, at least 14 days prior to the hearing on standby charges, to each owner of land to be affected by the standby charges as described in the engineering report and in the description of the lands upon which the standby charges are to be imposed, and that such notice shall be mailed to the address shown on the last equalized assessment roll, or known to the Clerk of the District. Passed and adopted by the Board of Directors of the Truckee Donner Public Utility District at a meeting duly called and held within the District on the 25th day of February, 1991, by the following roll call vote: AYES: Corbett, Curran, Maass and Aguera.
