May 8, 1989
The special joint meeting of the Truckee Donner Public Utility
District and the Truckee Donner Recreation and Park District was
called to order by TDPUD President Maass at 7: 35 P.M. in the TDPUD
Board Room.
ROLL CALL: Directors Aguera, Corbett, Sutton, White and Maass were
present from the PUD; Directors Fish, Krieger and Flanagan and
Manager Steve Randall of the TDR&PD were present.
EMPLOYEES PRESENT: Peter L. Holzmeister.
CONSULTANTS PRESENT: Counsel John Phelps.
OTHERS PRESENT: Charlie White, Jack McCormick, Rick Ingebritson
and Jim Westphal were among those present.
JOINT MEETING WITH BOARD OF DIRECTORS OF THE TRUCKEE DONNER
RECREATION AND PARK DISTRICT TO CONSIDER PROVIDING FINANCIAL
ASSISTANCE IN ACQUIRING DONNER LAKE PROPERTY
The Chairman noted that, at its last meeting, the TDPUD Board made
the decision to assist the Park District with financing the
purchase of property adjacent to the West End Beach. The land is
currently in escrow, and it was the intent of the Park District
to initiate a condemnation action, he said. The buyer is planning
to divide the property into four residential parcels.
Counsel Phelps advised that he is representing the Truckee Donner
Recreation and Park District in this matter, and the PUD is
consulting with Dennis DeCuir of the McDonough firm.
The Chairman of the Recreation and Park District Board advised that
the Board of Supervisors denied their request to file condemnation
proceedings and they are now requesting that the PUD consider
initiating the filing.
Manager Holzmeister has asked Counsel DeCuir for an opinion as to
whether it is possible for the PUD to condemn land for recreational
purposes and make it available to the Park District and, given the
Park District' s commercial interest rate limitations, if they would
be able to pay a higher rate to the PUD. Mr. DeCuir is researching
the matter and will provide a written response to the District.
Jack McCormick of McCormick Realty, the realtor who represents the
buyer of the property in question and is also a Donner Lake
resident, noted that the property has been available for five
years. He said the Park District already owns two miles of beach-
front property; this parcel is only 200 feet. He mentioned the
limited parking at the West End Beach and expressed concern about
creating more hazardous, congested conditions. It was his opinion

• that it would be more advantageous for the Park District to develop
some of their other properties.
Charlie White, Donner Lake homeowner and real estate salesman,
agreed with Mr. McCormick and stated he thinks the Park District
could spend their money more wisely. He said making more land
available to the public at this location would increase the traffic
on South Shore Drive.
Jim Westphal, a realtor associated with McCormick Realty and a past
president of the Donner Lake Property Owners Association, said Mr.
McCormick's comments reflect the concerns of the Donner Lake
property owners.
Director Maass advised that he would place the matter on the May
15 meeting agenda for informational purposes. The Park District
will be discussing the item further at their May 17 meeting.
The joint meeting with the Recreation and Park District was
adjourned at 8 : 44 P.M. and the TDPUD Board continued with the other
special meeting agenda item.
CLOSED SESSION - HIRSCHDALE WATER SYSTEM IMPROVEMENTS -
CONSIDERATION OF SETTLING DISPUTE WITH JOE SUTER CONSTRUCTION
COMPANY
The Board adjourned to closed session at 8: 45 P.M. to discuss the
Hirschdale arbitration and threatened litigation pursuant to
Government Code Sections 54956.9 (a) and 54956.9 (b) (1) .
RETURN TO PUBLIC SESSION
The meeting was returned to public session at 9 : 42 P.M.
Relating to the Hirschdale water system improvements, Director
Corbett moved that the Board authorize legal counsel to deliver to
Joe Suter a check in the amount of $67, 974 . 29 and a check in the
amount of $6, 000 to the trust account of Brad Elley (Mr. Suter° s
attorney) . He noted that the $6, 000 may not be released to Joe
Suter until the District is satisfied that the pump and the paving
has been repaired; Mr. Elley is to sign a letter agreeing to that
condition. Director White seconded the motion. All Directors,
aye, by voice vote. SO MOVED.
The Chairman noted that personnel matters were also discussed
during closed session.
ADJOURNMENT
There being no further business before the Board, Director White
moved that the meeting be adjourned at 9: 44 P.M. ; seconded by
