HomeMy WebLinkAbout1954-09-28 Min - BoardNo further business appearing, Board adjourned. _Uffici.o Secretary s Presid t Truckee, California September 28, 1954 The members of the Board of Directors of the Truckee Public Utility District met in regular meeting at the office of the District on Main St., at 2:30 p m., Z L Loynd, president, presiding. Upon roll call the following directors were noted present: C R Heller H T Lang ille L L Loynd Also present was Mr. Polk of the Highway Right of Way Department, who brought up the question of the District agreeing to quiet title to those sections redently condemned by the Highway Department for sand and gravel use. 11r. Polk mentioned that certain restrictions in the Districts deed to a E Lewis covering rights of way for pole and pipe line, together with a reservation for a pump site, together with a reservation requiring exclusive use of the Districts services were the items that his Department would like to have removed. He stated that he had contacted Mr. Chamberlain and had expected him to take the matter up with the District before this meeting. After some discussion relative to the reservations the Board advised Mr. Polk that they would take the matter up with attorney Chamberlain and leave it to him to draw up the necessary papers in accordance with the wishes of the District. Mr. Polk left after thanking the Directors for their consider- ation. The minutes of the previous meeting -uf September 1 th were read and approved. W. Barrett of the Sierra Sun entered the meeting at this point. Communications were read under date of Sept. 16 from Paul H. Chamberlain to Messrs. Clewe & Blade of Oroville with reference to a bill of Mr. I.0 Gifford, owing to Mr. Kydd of the Texaco Coil Co., also a copy of a letter from Clewe & Blade to 14r. Chamberlain under date of Sept 15 relative to the A. same. Also a letter dated wept 16 from Paul H. Chamberlain to the District on sane subject. And a letter dated Sept 15 from Paul H. Chamberlain to the District in reference to Section 16472 of the District Act, regarding the imposition of service charges as a part of the annual assessment and a ruling by the State Controller regarding the same. And a letter dated Sept 17 from the District to Mr. Chamberlain advising him that the account of I 0 Gifford would have to be collected by an attachment. A letter was read under date of wept 16 from Paul H. Chamberlain to the District in reference to the Donner Lake Utility Co. The manager advised that he had received from the Inter -County Title Co. a subordination of restrictions covering the lot sold by the District to Russell & Hedlund. This document was for the purpose of clearing up certain restrictions so that Mr. Russell could negotiate a loan on the property. He stated that he had referred the matter to fir. Paul H. Chamberlain and read a letter under date of Sept 15 from Paul H. Chamberlain to the District relative to the same,in which he had forwarded for the Districts consideration a new document of subordination of restrictions, which eliminated certain items of the previous document, and protected the District in certain of its rights, inasmuch as Mr. Russell was anxious to have his loan corAumated as soon as possible, the Manager reported that he had submitted this revised document to Chairman Loynd and both the Chairman and the Acting -Secretary had signed the same and returned it to the Inter -County Title Co. It was Moved and carried that the action of Chairman Loynd: and Acting, -Secretary Edmunds in signing this do cu i. ent be approved by the Board. The iVlanager reported that no further word had been received from Attorney Berliner. -in reference to the charges of Mr. Van Sickle regarding certain water .rights on the Hilltop . office The Manager brought up the natter of a new, building for the District and stated that he had contacted fir. A. Ghirardi in reference to his property at the corner of F, Main and Spring St. and had received an offer of sale to the District for 7500.00.- He asked the Districts permission to investigate the feasibility of the District obtaining this property and erecting a 2 story office building and to further investigate the probable financing of such a building by renting office space to certain other political subdivisions and governmental agencies and also to endeavor to interest the County in joining in so that County offices -- may be established in such a building. It was moved and carried that the Manager be authorized to gather such information as is possible for submission to the Board at a later date, Chairman Loynd brought up the matter of the District establishing a pension system and asked the Manager to write to Attorney Chamberlain and get his advice and suggestions. The monthly report of Auditor lftdte for the month of August was submit#ed to the Board me_�ibers and after perusal of the same,were ordered filed. Manager L hunds reported that he had given Kr. John J. Lodato an option to .purchase the Districts lot on Highway 40 for the sum. of $5000,00, said option to extend to September 30.
