The Members of the Board of Directors of the Truckee Public Utility- District met
in regular meeting at the office of the District on Main St., at 2:30 p m., C R
Heller, president, presiding .

A communication was read under date of February 9th from Paul H. Chamberlain
relative to the water ordinance and rules and regulations. Ordinance #56-01
attached hereto and made a, part of these minutes was introduced and read and
after some discussion a motion was made and unanimously carried that the
ordinance be adoptedand the same be published in the Sierra Sun as required
by law.
Revised rules and regulations were submitted by the manager and copies of the
same were given each -director, These were laid over for further study and action
at the next regular ,tee et ing .
A eoizunication was read under date of February 18th from Paul H" Chamberlain ,
together with a letter under date of Feb 16 from Richard Graves, "president of
the don. munity Facilities Corporation, relative to lease -purchase agreement
in connection with the Districtts proposed new office building. The communications
were filed awaiting further information,

BE IT ENACTED BY THE BOARD OF DIRECTORS OF TRUChEE PUBLIC
UTILITY .DISTRICT as follows:
SECTION 1. DEFIIVITIOI�10: For the purposes of this Ordinance
the terms and words below are herewith defined as follows:

1.1 DISTRICT: Truckee Public Utility District, and prop-
erty within the exterior boundaries thereof,
1.2 UTILITY: water service, system, facilities and
appurtenances of Truckee Public Utility District,
1.3 CUSTO�W: Any individual or agency of record receiving

or making use , of water service from said District.
1.4 PREMISES: An lot piece y or parcel of land, improved
or unimproved, to. whi ch wn-iler service is being or is to be
provided.

1.5 TARIFF SC', -MULES: The entire body of effective rates,

rentals, charges, penalties and regulations set forth or provided"
for herein,
1.6 PaLIC USE* Provision of water service to a munici-

SECTION 2. TYPES AND CLASSES 01' SERVICE: For the purpose
of this Ordinance there is hereby established the following
types
and classes of service:
A. 'TYPES OF SERVICE:

A-1 FLAT RATE SERVICE: Provision of water service in unew

measured quantities charged for on a fixed periodic charge,`
A-2 METERED SERVICE: Provision of water service in 3

1 measured quantities charged for on metered rates.
2 A-3 TEMPORARY SERVICE: Service for construction work and
3 similar uses, which, because of the nature thereof., will not be
4 used steadily or permanently.
5 A-1�� SEASONAL SERVICE: Provision of water for a limited
6 but specified period of time.
7 B. CLASSES OF SERVICE:
8 B-1 DOMESTIC SERVICE: Provision of water for household
9 and residential purposes, including water for spHnkl ing -.lawns,
to gardens and shrubbery, watering livestock, washing vehicles, and
11 other similar and customary purposes.
12 B-2 COMMERCIAL SERVICE: Provision of water to premises
13 where the customer is engaged in a profession, trade or business,
14 or is engaged in the buying, selling or providing of goods or
15 services.
16 B--3 INDUSTRIAL SERVICE: Provision of water to a customer
17 for use in manufacturing or processing; activities. �
18 B-4 FIRE PROTECTION SERVICE: Provision of water to
19 premises for automatic fire protection.
20 B-5 T\ICLASS IT" IED: Any water service provided to customers
21 or premises, having unusual characteristics or requirements and
22 not within the classifications set forth above.
23 SECTION 3. WATER SERVICE AREAS: The areas in which water
24 service is or may be furnished by Truckee Public Utility District
25 are described as follows:
26 3.1 SERVICE AREA NO, 1: Comprising the South 1/2 of
27 Sections lO and 11, the North 1/2 of Section 14, all of Section

3.4 SERVICE AREA No. 4: Comprising all other parts,
parcels, portions or sections lying within the exterior
boundaries of Truckee Public Utility District.
3.5 SERVICE AREA NO. 5: All land outside the exterior
boundaries of Truckee Public ITtili ty District,
The Truckee Public Utility District specifically reserves
the right., in the discretion of its Board of Directors, to apply
special or restricted service, rates, charges or regulations
within any of the service areas described which may differ from
the service, rates, charges, or regulations applicable do an-
other service area.
SECTION 4. WATER RATES AND CHARGES: In order to provide
revenues for the purposes of undertaking, conducting, and
carrying on any of the business and affairs of said District as
allowed by law, there is hereby established, levied, and there
shall be collected according to the following rates and classi-
fications, the following amounts:

18 4.2 APPLICABILITY; Applies to all flat rate service,

regardless of how classified, fire protection service, un-
classified or seasonal service.

21 TERRITORY: Applies within Service Areas Nos. 1 to
22 4, inclusive, and to any water service provided customers in
Service Area No. 5 as hereinabove described
23
RATES AND CHARGES for the foregoing shall be
24
25 established in each case by the Board of Directors, depending on
26 the quantity of water to be used, type of service desired,
classification of service to be provided, special connections
27
necessary, if any, and such other conditions or circumstances
28
29 as may be applicable, all to the end that such rates and charges
30 shall be in conformity with the revenue producing requirements
of Section 16467 of the Public Utilities Act of the State of
31
California.

1 SECTION 5 a BILLING FOR AN'D PAYMENT OF WATER RATES AND
2 CHARGES .
3 5.1 METERED SERVICE: Meters will be read at regular inter-
4 vals and as near to a calendar month basis as reasonably
practicable for the purpose of preparing regular bills, opening
6 bills', closing billq, or special bills. Should a monthly billing
7 period contain less than 27 or more than 33 days, a pro rata
8 correction may be made on the monthly minimum charge.
9 5.2 FLAT RATE SERVICE: Bills for flat rate are payable
to in advance. Opening bills for flat rate service shall not be
11 less than the estimated monthly charge for the service. Any
12 amount paid in excess of the pro -rated period rate will be
13 credited against the charge f o-r the succeeding month.
14 5.3 PAYMENT; Bills for water service are due and payable
15 upon presentation and payment may be made at the office of the
16 District, Truckee, California, or to an authorized collector.
17 Bills become delinquent 15 days from date of presentation.
is 1 5,4 RESPONSIBILITY FOR PATY'I T: All bills for water
19 service and other charges shall be billed to theperson requesting
20 and making application for service; provided, however, that in the

21 event of delinquency such rates or charges shall be billed to
22. the owner of the premises afforded such service, whether or not
23 such owner requested or made application for service,
24 5.5 DISHTED BILLS: In the event of a dispute between a
25 customer and the District as to the correct amount of a bill

26 rendered by the District for service furnished a customer, the
27 customer shall deposit the amount billed with the Clerk of the
28 District, and shall then proceed in accordance with Section
29 of this Ordinance. Failure to deposit said amount within 20
30 days from the date of said bill shall warrant the District regard-
31 ing it as a delinquent account.
32 SECTION 6: ENFORCEMT OF COLLECTIONS, RILES AND RECTULATIONS;

The General Manager of said District is hereby charged with
-he enforcement of the provisions of this Ordinance and all
Rules and Regulations -made pursuant hereto. The Board of
Directors shall make and provide for the enforcement of such
Rules and Regulations for the safe, economic, and efficient
operation, management and protection of the District water system,
service and facilities, and such Rules and Regulations as may be
necessary for the regulation of water services, the application
for service, the establishment and collection of connection
charges for various types of service, including special contracts
where necessary, the collecting, rebating or refunding of
charges , .establishment of c_redi t and reconnection charges.
(a) In the event of a violation of any laws of the State
of California, the ordinance of the District, or the rules and
iegidations established pursuant thereto, the General Manager
shall notify the person or persons causing, allowing or commit-
ting such violation, in writing, specifying the violation, and
18 upon the failure of such, person to cease or prevent further
19 1 violation -within JJ' days after thedate of such notice, the
20 General Manager may exercise his authority to disconnect said
21 premises from water service; provided, however, that in the
22 event such violation results in a public hazard or menace, then
23 the General Manager may enter upon the premises and do such
24 things and expend such sums as may be necessary to abate such
25 hazard or menace, and the reasonable value of the things done and
26 expense incurred or amount so expended thereon shall be a
27 charge upon the person and premises so in violation.
28 If a custemer receives water service at more than one loca-
ls t ion and the bill or charges for service ;at any one location is
3o not paid prior to delinquency, water service at all locations
31 may be disconnected..
32 (b) Upon the failure of any person or the owner of the

1 premises, to pay any water service bill or charges applicable
2 thereto, in addition to the foregoing, any one or more of the
3 following actions may be taken:
4 (1) Each water service bill and/or charges levied by
5 or pursuant to this ordinance and the Rules and Regulations
s thereunder, on any premises within the District, is hereby
7 made a lien upon such premise, and any measures authorized by
8 law may be taken by the District to enforce payment of such lien.

2whenever a premise has been disconnected from the
10 water system for non-payment of water bills or charges, such
11 premise shall not be reconnected to said water system until
12 all delinquent charges and penalties, if any, have been paid,
13 together with such additional charges or deposits for disconnec-
14 tion, reconnection or establishment of credit as may be ordered
15 from time to time by the Board of Directors by rules and regula-
le tions or other act.

17 SECTION 7. APPLICATION FOR SERVICE - PERMIT To CO10ECT:
18 No personk shall connect, or cause to be connected any premise
19 with the District water system without having first made applica-
20 tion therefor to the District, and having obtained permission of
21 the District so to do in accordance with Rules and Regulations.
22 SECTION 8. APPEALS: Any person who shall be dissatisfied
23 with any germination hereafter made under or pursuant to this
24 ordinance, or any amendment thereof, or Rules and Regulations
25 made pursuant thereto, may at any time within 30 days after
26 such determination (disputed bills provision excepted) appeal
27 to the Board of Directors of said District by giving written
28 notice to the General Manager and to the Clerk of the Board of
29 Directors, setting forth the determination with which such person
30 is dissatisfied. The General Manager shall then investigate and
31 transmit to the Board of Directors within ,w days from
32 date of said written notice a report upon the matter so appealed.

1. The Board of Directors after receipt of said report, of the
2 General Manager shall not less than 30 days thereafter have a
3 hearing in reference to said protest or matter appealed., and
4 notice of the date, place and time of said hearing shall be given
5 to all persons affected thereby not later than ten days prior
ro to said hearing. The Board of Directors may at any time, upon
7 its own motion, reverse any determination made by the General
8 Manager.
9 Pending decisions upon any appeal relative to the amount of
10 charges made hereunder, the person making such appeal; shall pay
11 such charge under protest as more particularly provided in the
12 Rules and- Regulations of the District. After appeal and hearing
13 thereon is had, the determination of the Board of Directors, as
14 a result thereof., shall be final and conclusive, and in the
15 event that a determination be made, that any charge or amount
16 previously paid under protest be refunded, such refund shall be
17 made forthwith.
18 SECTION 9: If any of the provisions of this Ordinance,

19 or the application thereof to any person or circumstance, is
20 held invalid, such decision shall not thereby affect the other
21 provisions of this Ordinance
22. Nothing herein shall be construed to limit the authority of
23 the Board of Directors to amend, supplement or change this
24 Ordinance, or any supplements or amendments thereof, or to change,

25 modify or alter any rules, regulations or other deteniinat ions

made pursuant thereto.
27 SECTION 10: EFFECTIVE DATE OF ORDD�ANCE: This Ordinance
26 shall become effective 30 days after the date of passage thereof,
29 and shall be published twice within 15 days after the date of
30 passage in the Sierra Sun, a newspaper of general circulation
31 printed and published within the County wherein said District
32 is located; provided, however, that the water rates and charges

1 now in effect shall remain in effect until April 1, 1956, on
2 which date the water rates and charges hereinabove set forth
3 ; and referred to shall become effective.
