It was so carried. Manager presented Financial Statement to the Board and went over each item. Discussion ensued regarding the Consumers Deposits and Director McIver suggested this be brought up at the next regular meeting of the Board. Rate projections were presented to the Board for study. In regards to the extension of water main to Olympic Heights it was moved by Director McIver and second by Director Spillner that manager be given authorization to start $1, 000.00 preliminary work on Olympic Heights . ' Manager read letter from Edwin N. Ness regarding Agreement for Prosser Lake Heights, Manager advised the County holds a bond for $60, 741.00. l_ "- Resolution 6309 was read to Board. It was moved by Directorlr �. and second by Director Spillner Resolution of Acceptance 6309 ON-11 Minutes July 23, 1963 Continued between Truckee Public Utility District District and the County of Nevada beadopted. Roll call~ vote: Ayes: Aweeka. McIver, Spillner Noes: None Absent: Greenhouse, Kaspian r Resolution 6310 related to Sanders easement read and adopted by roll call vote. Ayes: Aweeka, i McIver, Spillner Noes: None Absent: Greenhouse, Kaspian Manager reported before the well at Donner Monument can be used it has to be tested. A firm at Rancho Cordova will test well for the first eight hours for $550.00s the remaining hours $15.00 per hour. Director McIver advised thirty-six hours testing was required. The testing will not start until around the first of September* Manager advised Board he would discuss with Harold Berliner the possibility of using the $1, 000.00 that Lewis put .-up as warranty now being held by the District to pay for the testing of the well. Manager read conditions of the Sale of Timber. The Board was -in agreement with the conditions . Correspondence: Manager read letter from Harold Berliner to Richard Tuttle dated 7-17-63 in regards to wheeling power to Norden for delivery to Truckee Public Utility District* Mager advised $ 5 , 000.00 would be due Geo. Miller on Freeway water crossing. in September* Director Spillner stated in vieu of all of the expense involved in the proposed project the water department would run out of money* Manager replied the only source of money that could be- come available for these projects would be a 4/ loan from the Bank of California using Mr. 1 Beavers note as a dollateral or collection item with the bank, The note is for $ 35 , ow . uu and it is assumed the bank would loan up to this amount. Plan and specifications for said system of domestic water supply have been prepared by Whitlow, Reffumn and Albritton Civil ngineers # engineer for the developers of Presser Lake Heights 3 Assessment District and Packard. Muir Train appointed Magl.neers of Work for County in said preceedings . Said plans have been submitted { to and approved by the District ,engineer,, It is agreed that all of said worm shall be installed in accordance with the plans and specifications approved by the District Engineer as hereinbefore referr-4 ed to, and that said plans and spec i f is at .ens are hereby approved by District* No changes in said plans and specifications maybe made without the prig written consent of Districts it is agreed that the acquisition and construction of works and improvements herein provided shall be acconplished through an assessment district and that County shall pay to District 4-1a" frcm funds raised in the assessment district all fees and charges to be paid pursuant to this Agreement. The estittiated acquisition and ct.,,�nstruction cost of said syste-va of domQstic water supply, including charges for the acquisition of capacity and a right of service is GOp 741.00 of which the amount;: payablQ directly to District 4 -r---r the acquisition of rights and facilities is $ none and the cz,-:4timated- amount. of the fees and charges payable directly to the I District is $ 700.00 * 4, District may at all times maintain an inspector over the work of installation of the system of domestic water supply to see that plarsand specifications have been complied with, and the County and Jts Engineers shall cooperate with the District's inspector, or inspectors, in the duties incident to design or construction. After completion and acceptance of the work, County will cooperate with District in the enforeement of any guarantee made by the contractor in contracturr's agreement to perform the work, or by tiie owner and shall cause said contractor or owner to provide the District with an acceptable surety be guaranteeing against defective materials and/or workmanship for a period of one year from and after completion and acceptance of the work, Such bond shall be in a sum to be fixed by DistrictO 5. Whenever facilities and appurtenances to be conveyed hereunder are not installed in dedicated streets or highways, County shall provide or cause to be provided the necessary rights -of -ways and other property necesssary to accomodate said work and improvements, and where said easements or'property C-Aa:=e required exclusively for water supply facilities, or,, where requli:ed by District,, County shall require the execution and delivery to District of appropriate instruments of txajrisfe.r and such other documents as District may require to convey to District said rights -of -way and otiiex property. 6. Following t1le confirmation of the assessment aad priox: to zkcceptance of piny of t4i-� wortc. cox J-Mprovements to be installed or acquijced4, aunty shall pay District all fees and ail expenses of District -2- incidental to the installation of a system of domestic water supply together with all other charges of the District as set forth herein. 7. County shall require that the contractor or owner performing the work of construction of water supply facilities provide District with labor and material and faithful performance bonds, in the name of the District,, in the sum of the estimated cost for such work and shall r(--!qu1re_ said contractor or owner to provide the District with certificates of insurance protecting the District, its officers, agents and employees against any claims of any nature, After the work has been completed and the facilities have been accepted by the District, all facilities and appurtenances so installed shall be the property of District and part of its system and thereafter District may make extensions therefrom and install connect ions thereto at any point or points thereon. They shall be operated, maintained and managed by District as part of such system under the rules and regulations and subject to the rates and charges of District from time to time established. 9. District shall not be obligated to extend, without charge, its mains and facilities within the boundaries of Prosser Lake Heights Assessment District, and any future extension of mains, facilities and appurtenances beyond those specifically set forth in the plans and specifications shall be under the rules and regulations and subject to the rates and charges from time to time established by District. 10. It is agreed that the signature of all parties to this Agreement is based upon and predicated upon consummation of special assessment district proceedings providing for a sufficient assessment to pay the money herein agreed to be paid Distxict and also to pay all costs W-1Q, expenses of said proceedings and rights -of -way or other property referred to in Paragraph 5 of this Agreement. It is agreed that. the County of Nevada 16 signing this Ikgreement solely as agent and trustee for the propeity owner-s within the area described in ti'le Agreement, that it is assuming no direct liability for payment of -3- said money or the expenses of the acquisition and construction of said system and that, its only liability and responsibility is that of coanducting the special assessment proceedings referred to in the form provided by law. It is also understood by all parties that the County Nevada cannot pledge itself in advance that said spt:ci.al assessment P A- Coceedings will give the (%'.'ounty jurisdiction to confirm the assessment zi"t-'d that all terms and provisions of this Agreement are subject to said spucial assessment proceedings being consummated. County is to pay sums to be paid pursuant to this Agreement only out of moneys in said special assessment district proceedings and out of no other funds.
