Meeting was held at the office of the District on Main Street, April 230 1964 at 7:35 P.M. Upon roll call the following directors were noted present Aweeka, McIver, Firpo Absent: Spillner, Kaspian Also -present: bongo, Midyett, Cattan Guest: Attorney Martin McDonough Attorney McDonough presented the following Memordum to the Board. - MEMORANDUM April 238 1964 Too- The Board of Directors of Truckee Public Utility District From: Martin McDonough, Attorney This will summarize the District's position with respect to its_ wholesale power rate, from a legal viewpoint* In spite of considerable study, the District has been un- able to find means of obtaining a lower wholesale power rate than it now pays Sierra Pacific Power Company, without formal proceedings. The formal proceedings open to the District are two kinds. 1) An application to the Federal Power Commission or to the California Public Utilities Commission for a reduction in the rate which Sierra Pacific now charges the District; (2) An application to the California Public Utilities Commission to require wheeling by Pacific Gas and Electric Company of Central Valley Project power to the District, or, in -the alternative, sale of P .G . & E . power. Savings which would be achieved by the success of the second alternative procedure greatly exceed those which would probably be achieved bythe first alternative, since it is believed that both the Bureau of Reclamation and Pacific Gas and Electric Company can produce and transmit power at a substantially lower cost than can Sierra Pacific. Following the second alternative will cost an estimated $10, 000 for legal and engineering fees, as outlined to you in a .•-• previous memorandum. It would involve controverted proceedings and there is no way at this time of assuring a favorable result. ul 04 r(j Ea I 169 Minutes April 230 1964 Continued The Board again asked McDonough' s opinion on PUC hearing and he stated the application to PUC is.likely,to be successful and now is the time to proceed. Rates were discussed and Director McIver asked if the District would get the same rate as Sierra Pacific is getting now,- McDonough advis- ed wheeled power should be less. .M-" Director ,McIver stated he did not want to act on anything tonight as there was nota full board present. The board thanked Attorney McDonough for attending the meeting and requested he submit a bill for his services for the last few months. Mr. McDonough stated he would and left the meeting at 8:45 P.M. Further disucssion ensued on borrowing money to build line to Summit. Mr. Cattan stated he would build the line himself and would guarantee the _ f 4.nanc.ing . Director 1� 1.rpo brought up the poor I mangement of the District and the improvements which should be made in the water system. Director Firpo made a motion that Mr. Barrett editor of the Sierra Sun should be given nQ further lafermation after each Board meeting, Director Firpo stated lixe meetings were open to the public and Mr. Barrett could attend the . meetings to r obtain information for h imse 1 f . Director Firpo asked if the $10, 000.00 would cover the whole suit, He was advised it would cost $10,000.00 to present the matter to PUC and ,McDonough's estimate did not include possibility of refusal from _PUC_ end hearing to Supreme . Court . Manager understood the $10, 000.00 would include both the legal and engineering fee necessary to take the matter to the PUC . Chairman 4weeka announced that he would not be at the next regular meeting of the board set for April 28 , 1964 . Director �'irpo stated at this time that he felt all business should be taken care of even though a full board was not present, There being no further business to be brought before the board the meeting was adjourned , at 9 ; 20P.M. _ i Edward N . Midyett, RRecor ing Secretary "'SOLUTION No, 6407 WHEREAS: This District is engaged in a program of expansion of its electrical facilities portions of said program being fiananced by REA borrowing,, and,, WHEREAS, a site for a substation is required and can be purchased for an agreed sum of $3,000.00, with costs of escrow, title insurance and survey to be borne by this district, said site comprising .6 acre presently owned by Orlan H..and Alice Sanders,,and WHEREAS., Orlan H. and Alice Sanders provide without additional charge., easements and rights of way for all roadway purposes permitting ingress and egress to said substation site over and across their land contiguous to said site, NOW THEREFORE BE IT RESOLVED: By the Board of Directors of the Truckee Public Utility District that purchase of said land for sub- station site be hereby authorized and that the President of the Board of Directors and the Secretary are hereby authorized to do all things necessary to expedite acquisition of said land. Passed and adopted by the Board of Directors at a regular meeting, this 14th day of April, 1964 by the following roll call vote.
