Motion carried. LAW SUIT AGAINST DISTRICT FILED BY DR, ROBERT AFFELDT, D . D . S . - Manager advised. the Directors that .Dr. -Affeldt is suing for damages to an ,..� X-ray machine in 1963 which - he believed to be caused by power irregu- larities. Damage was reported to us in 1964, and insurance investigator, checked out claim, and then refused it because of lack of evidence of any power ,caused damage. Dr. Affeldt then allowed his Attorney to sue us last month for Breach of Contract. Case was turned over to Attorney Chamberlain, who advised the claimants by letter that the legal time limit for filing had expired, He also had the District file a refusal of suit with the claimants . Case now at a stand -still awaiting further action by Affeldt and his attorney. RECREATION DISTRICT LEASE - Mr. Randy Bobby, Recreation Director, appeared before the Board to advise that survey of the Brockway Short- cut land was completed. Preliminary report shows that the Recreation - Department will control between 50.2 and 50.8 acres of land, if the Utility District land can be leased as previously requested. He brought with him sketches and plans of the area, and pointed out the exact acreage needed by the Recreation Department for completion of their plans, and qualification for Federal aid. Nevada County Counsel, will work up the lease without charge for them if we will decide length of time we wish to cover in leave, price per year, and any restrictions or inclusions we wish covered. Directors authorized Manager Longo to meet with the Nevada County Counsel and the Recreation Department to work out details, including price of $1.00 per year, length of time to accord with leases on ad- joining properties, and clauses of reversion if property bought by State for freeway purposes, or if Recreation District becomes inactive for any reason. Lease to be approved by Attorney Chamberlain before signing, and cost of attorney to be borne by Recreation District. Following discussion, it was also agreed to include for recreational development and use approximately 2h acres of District land set aside for that purpose at a previous date; such property to be included in the lease. Property in question previously known as the "Old Gravel Pit" at the foot of -the Donner Trail Subdivision* TRUCKEE PUBLIC UTILITY DISTRICT RESOLUTION NO, 6517 NOW, THEREFORE, BE IT RESOLVED that - the TRUCKEE PUBLIC UTILITY DISTRICT of Truckee, California, accepts any'-iAGREEMENT with the County of Nevada,, a political subdivision,, and Truckee Tahoe Lake Estates, Inc., a California corporation, providing for the installation of a water supply and distribution system, to serve water within the PROSSER LAKEVIEW ESTATES SUED IVISION, UNIT NO% 1. AND, the President and the Clerk of the Board are hereby authorized to execute said AGREEMENT in behalf of this District, PASSED AND ADOPTED by the following roll call vote at the regular meeting of the Board of Directors on the 7th * day of September 1965: AYES: Firpo, Fink, Doyle NOES: None ABSENT: Aweeka ABSTAINING: Rose a A- EDWARD Nw AWEEK-Al -Prtslwa' �dk t Board ATTEST: r4f th FRANC IS LONGO, Clerk. e Board 67 Minutes September 7, 1965 Continued PROSSER LAKE VIEW ESTATES AGREEMENT - Three way agreement between County of Nevada, Truckee Tahoe Lake Estates, Inc., and Truckee Public Utility District, drawn up under Bond Act of 1911, to cover the development and acceptance of the water system in the Prosser Lake View Estates Subdivision north of Truckee on SSR 89. Agreement has been checked over by Attorney Chamberlain and approved. Read aloud by Manager - system will cost in the amount of approximately o..r $95 , 975.00 to subdividers, and will include well, pressure system, and two storage tanks, Additional spring on property in advent of failure of well. Director Doyle moved and Director Firpo seconded a motion that RESOLUTION #6517., authorizing acceptance of the agreement and signatures of the Chairman and Clerk of the Board on behalf of the Directors, be adopted. Passed and adopted by the following roll call vote: AYES: Firpo, Fink, Doyle NOES: None ABSENT: Aweeka ABSTAINING: Rose (because of personal interests) SIGN LEASES ON SUBSTATION PROPERTY ' - Because of the absence of Mr. Harold Ellis of the , Donrey Outdoor Advertising Company - no action was taken on sign board lease requests on the Substation property. GEORGE CATTAN, Enqineer, requested that the Executive Session decision to renew his engineering contract from November 15th, 1965 to November 16th, 1966 at $750,00 per month be made a matter of record in the minutes. Director Firpo advised that he thought the matter of the increase in salary from $700.00 per month to the requested $750,00 per month should be held -over until the full Board was present , and then -voted upon. It was so decided. UNDERGROUND ELECTRIC SERVICE LINE AT TRUCKEE AIRPORT,_ Andy Creglow, Manager of the Airport District, was not present as -planned., Manager explained that Airport District wished to put in approximately 1000 ft.0 of underground line to a storage hanger. They wished the Utility District to pay the costs. Mr. Longo informed them that our District would put in electric service on a contract basis of $35.00 per month minimum for sixty consecutive months, and would bear the percentage of the cost that an overhead line would -cost installed. All additional expenses must be borne by the Airport District, and all estimates to date are very high. Directors agreed with Manager's decision on costs, ALLEY PAVING SOB - Mr. Loehr, Nevada County Supervisor, has advised the Manager that the back alley must be repaved where it was dug up last year to install new water mains. Sanitary District is presently com- pleting the installation of new sewer 1 ines in the alley, but when they are through, about September 20th, Nevada County will pave the whole street if District will pay 3� the cost, approximately $1250,00, Board approved, and authorized Manager to go ahead with arrangements with Mr. Loehr, and also to request them to repave the damaged area on Spring Street at the same time and bill us. Have been informed that it should be erected first, then sand blasted and painted immediately to prevent rust. 7. Soma Sierra signs discussed - left on our property at the pleasure of the Board. Developers still owe District on a note which is past due. Board feels that if no action can be obtained on payment on this note, Attorney Chamberlain should be asked to force collection.
