40 April 169 1968 Truckee, California The members of the Board of Directors of the Truckee Public Utility District met in a regular meeting at the office of the District on Main Street, Truckee, California at 7:30 P.M. Upon roll call the following Directors were noted presents Doyle , Firpo, Roses Waters, Moore* District Employees present: Longo, Paulus, Cattan, Silva Haltom, Vieu, Grow. Guests : Frank Anderson, Brien Walters, Henry Redford Minutes of the meeting April 2nd, 1968 approved as written subject to the following corrections: Page 33: Paragraph threes Brien Walters - Walters Engineering. corrected to Brien Walters - Walters, Hibdon and Ball. Page 33, 4th paragraph; He stated that 50% of the municipal water systems do have refund water rates. Corrected to read: In almost all cases for private utilities in the case of connection fees there is a refund arrangement* Page 349 paragraph 11 Brien stated that 385.00 would be an approximate connection charge for the developer per customer. Correction retract statement from minutes* Page 34, stated that if. Prosser Heights was tied in with the town system there would be enough water during the summer months. Corrected to. read enough water during the summer months of 1968. Page a 34, 8th paragraph, Manager stated that when Stampede Dam is pcom leted California will have 300 acre feet released from Donner Lake*' Corrected to read: California will have 39000 acre feet released from Donner Lake* - There being no further corrections, minutes stand approved as corrected. He stated the $185.00 amount is broken down to a $90.00 tap fee and a $95.00 facility charge* He stated this means that you pay for your service and part of the backbone plan, but there would be no refund plan. He stated the only glace where there would be money transferred from the District to the developer would be in the case of someone like Ed Aweeka where the District asked- for a large facility than Mr. Aweeka needed, Brien Walters asked the Board to look over the article he came across dealing with such a situatinn as extensions, --- etc. , and discuss it at the next meeting. Brien Walters -submitted to the Board some -estimate s `on ~ tying Prosser Well in and tying the system to Gateway. He stated the "distance needed to tie in Ed Aweeka is 3000 feet. There Would be a lot of rock excavation in that area. He stated he would like to put up a couple of stand pipes so a pumper engine could be moved into that area to serve water in case of an emergency. He stated the reason he does not want to put in a permanent booster station is that on the overall plan the permanent pumping station would be' in the location of the cemetery.' Cost Estimate: Brien Walters stated that for 3,300 feet t would cost approximately 30,000.0O for 10 inch line. He stated for 8 inch line it would be roughly around $20,000.00. He stated this would be contingent upon Mr. Aweeka completeua his job on time. He stated that on the time estimate it would be at least the last week in July bef or the job is completed. Manger stated that it is prohibited by the State Law for a Utility to do a ob when it exceed 3,000.00 unless its broken up as doing a 13,000.00 project and then go to another project. Manager stated that in the event the bids do not come up to specifications and the Board does not accept them the District can use their own forces in the ..� way he Just presented* Manager stated he thinks it would be desirable for the District to do their own tie-ins as 4 the District is better qualified. Brien Walters stet ed that there is a time factor involved and he does not think the project should be delayed as water problems will arise if it isn"t completed as soon as possible. He stated he will have .a 35 day time limit in the contract submitted for bids. Chairman stated that perhaps it would be best if Brien firgures the cost estimate as to the cost of District accomp- lishing the job and the cost of contracting the job. Brien Walters stated he could do this. Manager stated under the agreement with Brien Walters he does not think the Board has autorized Brien Walters to go ahead and set up this project for bid. Brien Walters stated he will have a more thorough cost estimate for the Board to discuss at the next meeting. Manager asked Brien Walters for a rough estimate on the surveying. Brien Walters stated the survey will cost about 3 man days at S25.00 per hour which will total approximately 4200.00 per day. He stated the engineering and drafting would be billed on an hourly basis also which would cost approximately 4750.009 To make the inspections the District has a qullfied person# Manager stated, Brien Walters stated the engineering cost would be approximately 39000.00 for engineering without inspections. Brien Walters et ted it would be approximately $55,000.00 for entire cost of completing project. Director Rose asked the Manager how soon the District can be sure on right-of-ways in the project. Manager stated there is no problem in the Gateway area however there is a problem Aweeka line Forth as it owned by the Forest Service and a right of way will have to obtained from them. Manager stated the Dis tai ct should be able to obtain emergency right- of-ways to go ahead and start the project. He stated he did talk to a Forest Service representative about the right of way and he stated that a right of way could be given if the District puts in standpipes every 100 feet for fire pro- tection. Manager stated whenever necessary to put in a water 43 line there has never been a refusal as it gives fire protection. Chairman asked where the $50,000.00 or 460,000000 is going to come from to complete the project. Manager stated that there is about 470,000,00.An reserve at this time that can be used for water extensions. It was moved by Director Rose .... seconded by Director Firpo to authorize Walters, Ball & Hibdon to prepare specifications and- plans to provide information to bidders. So Ordered,. Board agreed on a special meeting to be held on the 26th of April at 7:30 P.M. regarding the water prJect, I.B.E,W LOCAL 12 Manager reported hat some of the Directors met with Mr. Anderson, Union Representative and Bruce Crow and Manager and discussed breifly the conditions set by the Union rela- tive to the coming year, l. The provision related to the existing gre iviance pro- cedure stated that the employee and Dis kiet must agree on a 3rd party as a joint gre iviance committee an impartial party, to be chosen by the employees, Chairman stated it is his feeling that the way the proposal made to the Board was worded was the intent of the Board. Board is agreeable to the provision, and will consider, 2. Provisions related to standby pay, Mr. Anderson pro- posed that standby pay be changed to conform for the follow- ing: A mans standby pay provide for 8 hours regular pay for 60 hours standy performed. In addition a second paragraph was added to provide for four hours standby pay when standby is required during recognized holidays. Manager stated at the pre sent time there is no provision for standby pay during the holidays. Manager stated the additional cost would be approximately #1,000.00 annually for re gualar standby time, He stated the additional cost would be approximately 4680.00 for holiday standby, for eleettic crew. He stated the cost would be approximately 3,400*00 total for electric and water standby The provision will result in approximately an additional 2,600*00 annually over what is now being paid. Board agreed that the Holiday standby pay would cause a hardship on the District, Mr. Anderson stated that if the Holiday provision proposes some problems financially the employees are prepared to withdraw that provision. Chairman stated that the provision on holidays is deleted from the proposed provisions and consideration will be iven the regular standby pay for 8 hours regular a for 90 hours standby time* So ordered, pay o o y 3, Manager stated it is also proposed to add a section similar to the language set forth in the Sierra Pacific agreement providing for District paid telephone expense for those required to maintain a phone during standby, Mr. Anderson stated that Sierra Pacific Power Company agreed to pay one-half of the telphone rate for those rem gruire d to have a telephone during standby, He stated that this would be at a basic telephone rate for one black telephones Manager stated the Distct does not require an employee to be on standby as it is by mutual agreement they do so* 44 Chairman stated that prior to this date it has been dis- cussed and has been the consensus of the Board not to furnish a telephone for standby time. Board agreed that telephone service not be paid. 4.Man.ager stated at the suggestion of Mr. .Anderson the Directors consider payroll deduction of union dues. Director Waters stated that he stands on his bp�n.ion when this was discussed before as apposing the provision. Board agreed* Chairman stated it is the feeling of the Board that the { District does not want to become involved in payroll } deduction plan of union dues. - 5. Job Description: In the event that during the course of a year the District and Employees may agree to additional terms and classifications of wages during the term of this resolution and provide for revisions of existing classificattn for wages pending negotiations Stith respect -to such classi- fications and wage rates the District may establish temporary classifications and wage rates. The District will promptly notify the employee of any such temporary classification and wage rates which are established* When the District and employee reach an agreement on the classification and wage+-rates they shall be retroac�tiva to the date when the new wage rate and or classification was first temporarily established. Mr. Anderson stated that this is to provide for an employee who does work other than his given job requiring additional stills, etc. Manager stated there has been no wage agreement submitted by the employees pending such time as Sierra Pafi ci c and their employees make agreement. Mr. Anderson stated this would be sometime during the middle of May. Board agreed to table the matter until such time the District employees submit a wage provision for wage rates. b. Manager stated presently the water department responsi- bilities are not defined. Mr. Anderson suggested that an insertion be made to that effect, and a job description for the water department be Inserted* Mana er stgt ed that the employee is presently receiveing 88 per hour and theproposed rate is 4. 6 per hour �3. p as per Sierra Pacific existing wage. He stated in effect it will give Dave vieu a classification of his own. Manager stated other than a j o b description for D ve lieu he sees no reason for acquiring a new job description for a helper as a great deal of the summer help would be classi- fied as helper or temporary helper as now exists in present agreement. It wasagreed by the Board to consider the language in the job description for the one employee now employed and to table the matter of the wage rate until such time as wage rate is agreed upon for electric dept. Chairman stated in answer to Mr. Andersons question the employees cannot vote on the adoption of resolutions. Mr. .Anderson stated that this is given for the Boards consideration r to give the employees the chan. e for expressing themselves. Chairman stated that the employees have the right to express 2 themselves before the Board at any time* Manager stated the employees have that right but what they want is -4o be notified prior to the action taken by the Board t Chairman stated this will be done but under no circumstances can they vote. INCLEMENT WEATHER Employees who shall report for work on regular work days and who are unable to perform such work because of in- clement weather or similar causes, shall be paid for a minim of four hours. However, they may be held pend- ing emergency calls, or for instructions or miscellaneous work in the warehouse or other sheltered locations . LEAVE OF ABSENCE (a) Leave of absence shall be granted to regular employees for urgent substantial personal reasons, provided that adequate arrangements can be made to take care of the employee's duties without undue interference with the normal routine of work. VACATION (a) An employee who has worked as a regular employee for the District for a period of twelve consecutive months shall be entitled to ten work days with full pay. SAFETY (a) Safety belts for the electric department shall be furnished at the expense of the District . Every effort should be made by the employee to maintain them in good condition because his safety may de- pend on his equipment (b) Safety meeting shall be allowed during the course of regular working hours, to he scheduled at a time agreeable to the Superintendent: and Manager, approx i mate ly four hours each month. (c) The District shall make reasonable prov i:;i.ons for the safety employees of em to gees in the performance of their work. Employees shall jointly cooperate in promoting the responsibility fo the individual emplovee witch regards to the prevention of accidents. (d) The Foreman shall establish ci safety inspection committee to function in the prevention of accidents by ascertaining unsafe working conditions and at least every six months recomend any measures to be taken for correction thereof, in writing to the Manager. _ 4 SAFE 1 Y (Continued) (e) The District reserves the right to draft reasonable safety rules for employees and to insist on the observance of such rules. UNION ACTIVITY The District will not discriminate against an employee because of his membership in a Union, and employees are expected not to discriminate against any employee because of -his non-affiliation with a union. f SICK LEAVE (A) Employees who have completed six months of con- tinuous service with the District shall commence accruing sick leave at the rate of one day per month to a maximum of 30 days. (B) The District shall require medical certification for verification of prolonged illness. (C) Nothing in the foregoing articles shall be interpreted to entitle the employee to sick leave while on vacation, temporarily laid off by the District, upon serverance of employment, or while receiving industrial Compensation. As the initial step in the adjustment of a reievame the employee and/or shop steward or other representative shall discuss the same with the manager*. MANAGERS REPORT CLEAN UP DAY: Manager stated that two years ago the District paid one man for 8 hours and one man 4 hours to work on clean up day. Manager asked the Board if it is agreeable to ask the men to take the day off on Friday and work on Saturday clean up day. The Board agreed the men shoud donate their time on a voluntary basis as the District is donated the equipment. If the men do not volunteer the District cannot participate. A.LEX STEWART: Manager reported Alex Stewart approached him and stated he is being overcharged for his service at the Golf Course* Manager stated that he checked with a District servicing South Shore Golf Course and they use 40,000 to 50,000 kilowat=,hours against Alex Stewarts 80,000 Kwhrs. Manager stated Alex Stewart pays approximately 3,000.00 p&r:i*year. Manager stated the meter on the pump shows that he is using more power than other golf courses. PROPOSED NAME CHANGE: Manager asked for the Boards confi- de rats on on changing the name of the Truckee Putli c Utility District to Truckee-Donner Lake Utility District. Director waters stated the Truckee Public Utility built up the, system and in his opinion it should remain. Truckee Public Utility District.
