Manager's Report I AUGUST 18, 1970 The members of the Board of Directors of the Truckee Donner Pub 1 i c Utility District met in a regular session in the conference room of the District at 7:30 P.M. Upon roll call the following directors were present: Rose, Loehr, Stone, p ; Moore. Director Doyle notified the office he would be late. Employees present: Cattan, Paulus, Archer, Bliss. Guests present: Mr. and Mrs. Gordon Reddal l, Jack Marquette, Ray Smith, j Pat Shane and Nick Camola. The meeting was called to order by Acting President Rose. The minutes of the regular meeting of August 4 and of the special meeting j of August 11 were submitted and approved as written. BILLS PAID AND BILLS FOR BOARD'S APPROVAL It was explained that the bills for the title search were for Mantis Valley Dam and the bill for inspection fees for the County of Nevada was { necessary when an encroachment permit is applied for. No further discus- s i on, a motion was made by Mr. Stone and seconded by Mr. Moore that the bills paid and bills for Board's approval be paid as listed. ROLL CALL: Loehr, aye; Stone, aye; Moore, aye; Rose, aye. Motion carried. So ordered. Bills attached hereto being a part of these minutes. BID: 811 WATER MAIN, SPRING STREET TO KEISER ,.�.. This bid comprises 620' of 8" steel pipe, crossing one main sewer with 6 sewer services. Nine bids were mailed and two bids were submitted as i follows: ROBERT C. GEBHART CO. $5,012.5 0 ALPINE-SMITH CONSTRUCTION COMPANY $4,127.00 The difference between the two bidders was in the excavation and installa- tion costs.. Bid cost is approximately $6.50/foot. A motion was made by Mr. Stone and seconded by Mr. Moore that the District accept the low bid of $4,127.00 from Alpine-Smith Construction Company. ROLL CALL: Loehr, aye; Stone, aye; Moore, aye; Rose, aye. Motion carried. So ordered. SITE FOR DONNER LAKE SUBSTATION Mr. Cattan explained the proposed sites are located either on McGlashen property or on Shorty Harris' property. Both locations are below the elevation of the road, and we have access to the substation. We are requesting a 50' X 90' site at the rear of the McGlashen lots. Mr. McGlashen's price may be in the region of $3,000. Since this District feels this price is unreasonable, we may have to go to condemnation. The county land site is not being considered because it is too costly since is would have to be built, etc. Mr. Cattan will try to get retaining walls a settlement tomorrow or the next day with Mr. McGlashen. The District will have to pay Sierra Pacific Power Company for the high tension line, which will be billed to us at their cost. It was noted that Mr. McGlashen can benefit from taps off our line and that the Division of Highways may want power nearby for lighting an intersection. As mentioned in the p • however, the Dis- trict meeting, the material takes nine months delivery, wants the foundations built before this winter. Page 136 August 18, 1970 (August 18, 19 70 - Continued) MART I S VALLEY DAM i Paul Chamberlain suggested we talk to Mrs. Joerger Wolverton's attorney again and mention that the District was ordered by the Army Corps of Engineers to obtain this easement either by condemnation or otherwise and ask for right of entry. Mr. Cattan talked to Mr. Brucher, her attorney, and suggested the best way to obtain the easement was not by condemnation and that he reconsider the matter. Mr. Brucher then advised Mrs. Joerger Wolverton to give us right of entry, which she did verbally earlier today. Compensation will be discussed ', later. The purchase order has been received from Perini, and it was noted that the provision for refunds to Perini if the line was tapped has been deleted from the purchase order. Mr. Cattan contacted Southern Pacific today regarding the crossing of the railroad tracks, and we hope to obtain their approval in a i day or two. Poles have been ordered after obtaining two b ids, one bid being $9/pole less than the other. SIERRA MEADOWS TANK The copy of the letter to Duane Anderson from Dan Cook regarding the status of the booster pump on Lot 21, Ponderosa Palisades, was read. The cost of the booster station is estimated at $42,000. Mr. Cattan spoke with Duane Anderson l who said he felt Mr. Beavers should share in the cost of this project. The District will give General American one more week to perform, at which time they will have to design and build the booster station and the District will seek legal action against General American. f GORDON REDDALL Mr. and Mrs. Reddall were present tonight and have purchased Lot 122 in Ponderosa Palisades. Mr. Reddall stated he paid $2,100 in assessments which were supposed to have paid for a water system. He was assured that the District would supply water in adequate volume and pressure for domestic use and fire flow. He has retained an architect, constructed a driveway, and subsequently discovered -won% there is no water. After consulting George Pifer, District Attorney, regarding his position, Mr. Pifer's opinion was that the District should provide water acccording to the 1962 contract between the District and the developer. Mr. Reddall asked the Board if he should proceed with his $30,000 house and not be able to live in it for lack of water? Mr. Rose explained the District is working on the problem and realizes the requirements are not being met at this time. Reference was made by Don Archer, Water Foreman, to a mechanical failure in the booster pump which caused the residents to be without water for an hour. Mr. Reddall reiterated he needed some sort of assurance from the District before he proceeded with additional construction. Mr. Cattan explained there was a letter from Dan Cook to Raymond Vail & Associates, Engineering Consultants for Ponderosa Palisades, stating booster pumps are required on Lots 42, 43, 44 and 45. Mr. Reddall stated his lot is at the 6200' elevation and the storage tank for his area is at the 6100' elevation. Mr. Cattan stated this tank must be agreed upon by Mr. Beavers. Mr. Loehr mentioned the lines are already in, including a high pressure line. Dan Cook has refused to accept the assessment district for Ponderosa Palisades West unless a tank and booster station are built. Mr. Rose stated the District has spent quite a bit of money to install pressure pumps in this area and on extensive engineering costs, and the results are still not satisfactory. Mr. Cattan felt this problem should be resolved by our legal counsel, that there have to be two tanks because of the pressure zones. Mr. Reddall asked what is he paying for when he pays assessment? Mr. Rose replied for lots, water lines, etc. Mr. Cattan would recommend a booster pump and to wait. f Mr. Jack Marquette, ,from audience stated he was in exactly the same position as Mr. Reddall. He took the 1962 contract to three different attorneys who advised him that the property owners would have a definite claim against the District, that the District has the exclusive right to furnish Ponderosa Pali- sades water and the property owners cannot even drill a well, and that the owners are a third art beneficiary. More people are ready to build property but they are confronted with the same problem and are in this subdivision, y being hurt by construction delays. I Pa e 13 7 August 18, 1970 g (August 18, 1970 - Continued) GORDON REDDALL (CONTINUED) i Mr. Pifer informed Gordon Reddall this case will probably end up in court, that the property owners have a good case against the District. He advised the property owners could sue as a group or the developer could sue on his part. Mr. Rose stated we seem to be confronted with a legal problem, and in the mean- time the property owners are suffering. Mr. Reddall suggested the District's attorney review the contract, and let the property owners know where they stand. If the District cannot supply water and storage, the property owners are j • w need a decision one way or another. going to have to find some recourse; e Y (President Doyle arrived at 8:20 P.M.) Mr. Cattan informed the Board that Mr. Chamberlain is on vacation until September 1 1, and the District will consult him regarding this issue upon his return. Mr. Reddall thanked the Board and left the meeting. Mr. Rose stated the District is vitally concerned with this problem and would also like to resolve this problem, that he thought at the time of the 1962 contract a Mr. Weatherall was the District's attorney. Mr. Moore stated he thought Mr. Chamberlain, our present attorney, should go over the contract for the benefit of the present directors. Mr. Doyle stated if the system passed our 1 specifications and Was deeded back to us, it is our responsibility to provide Mr. Rose stated the property owners neglected to give their adequate water. p p attorneys our resolutions. Mr. Loehr felt one cannot legislate retroactively. Mr. Stone inquired if the District can build the tank and install the pressure valves, etc. Mr. Cattan replied the question of the tank is settled; only the question of the booster pump remains. Mr. Cattan will ask Mr. Chamberlain to attend the next meeting. Mr. Cattan feels a second tank has to be constructed at another 200' higher elevation. PAT SHANE - EASEMENT .-n% Mr. Pat Shane and his spokesman, Mr. Nick Camola, were present. Mr. Camola referred to the August 7 letter from the District and stated they did not under- stand the opinion of the Board regarding compensation for the easement. Mr. Loehr stated it is his opinion that whatever applied to Mr. Hennesy should apply to Mr. Shane. Mr. Doyle stated he felt personally the Board never formally committed themselves to Mr. Shane regarding an easement, that just discussion took place. Mr. Camola stated they will be happy with any right-of-way, whether it be 15, 30 or 60 feet. Mr. Shane stated the Hennessy route was one of two routes originally discussed in 1965. Mr. Loehr stated the access has been i established at $3,000, and f there are any documents bearing on this situation, they should be brought to the Board. Mr. Camola inquired if there were any stipulations in the lease to the Recreation District which allotted any roadway, pathway, etc. to Shane Brothers for access to their property. Mr. Doyle asked that Mr. Paulus check the actual lease, which he did, and found that there is access to a horse corral. Mr. Camola said the original proposed access road went through the ball park into Sha Neva property. Mr. Shane said they were blocked off by subdivision work and their property was left an island. Mr. Doyle recalled an alternate site picked in 196S on a field inspection trip with Directors Aweeka and Firpo and Mr. Shane. (Subject lease with recreation depart- ment was thoroughly checked, and no mention of an access road to Sha Neva property was found.) Mr. Camola reiterated they have a definite problem in gaining access to their property, that there should be some provision that a person can have reasonable access to his property, but they do not want to pay $3,000 for access. ,.... Mr. Paulus mentioned that the Shane access road was discussed at the recreation district, but that Dr. Tapia did not approve of the location. Mr. Doyle mentioned I there are no records this easement was granted by the District, but apparently Mr. Shane as s une s he was given a ve rb al easement. Mr. Shane stated Mr. Longo delayed the formal action on the easement because of a V-shaped piece of property south of the proposed road. Mr. Shane asked the Board's consideration in that they had another route for access, but now it is blocked. Mr. Moore stated it is blocked on both ends, that there was an old telegraph line which is now discontinued. Mr. Camola stated a Mr. Daly has been going through the recreation district property to get to a horse corral on Shane property for the 1 as t 3 years, August 18, 1970 Page 138 (August 18, 1970 - Continued) PAT SHANE - EASEMENT (CONTINUED) but they do not feel they should be traveling an improved road with heavy construction equipment. Mr. Camola stated they will build a road to county specifications if this is what the District wishes. Mr. Camola stated they had access years ago and are asking for access again. Mr. Moore stated he does not agree. with granting an easement free and going against our legal advice. Mr. Stone moved we grant a 30' easement for $1,500 with access to Shane the same as for Hennesy. (Motion died for lack of a second.) Mr. Loehr stated a 30' road would never be accepted by the county Mr. Stone f stated his thinking was that we could grant 30' now and at a future request grant another 301 . Mr. Loehr felt we would be faced with the same problem. Mr. Camola stated building this road would be no problem, the cost being estimated at $8,000 not including blacktop. Mr. Moore felt the easement, if granted, should be no less than 601 . Mr. Rose questioned their access to the state highway. Mr. Camola asked what did the District's attorney say regarding access previously discussed? Mr. Paulus replied that our attorney was not contacted regarding previous access but only compensation for ease- ments in general. Mr. Stone suggested we obtain Paul Chamberlain's opinions in writing. Mr. Doyle stated the District will: Conmunicate with our legal counsel regarding the easement across District property by Sha-Neva; Educate legal counsel regarding the prior request for access as far back as 1965 in relation to state highway 267; Ask legal counsel for an opinion inion regarding old original trail, that there g is an existing roadway that gives access to the property in question that is being used at the present time; Inform legal coons e 1 that the easement was requested again after five years. Mr. Shane said he would send the District a letter from Mr. Hennesy stating j he was no longer interested in the easement. E RESOLUTION 7016: M4ENDMENT TO RE SOLUT ION 6701, ELECTRIC SERVICE MINIMUM CHARGE Mr. Cattan explained that the present minimum of $l.50 doesn't cover the cost of the transformer, loss in the transformer, cost of installation, distribution lines, metering, etc. , that it costs the District $1.21 to process one bill. This resolution will affect mostly the homes in Donner Lake that are closed for the winter and transient renters and retirees in Truckee. It was agreed that the District is losing money at $1.50 minimum. Mr. Paulus pointed out that recent computations indicate we have purchased $141,000 worth of power from Sierra Pacific that is not accounted for in billings, that our investment is $800 per customer and the District can expect only at least $1.50 back per month on this investment. After a brief discussion, a motion was made by Mr. Rose and seconded by Mr. Moore that the minimum charge for electric service be increased from $1.50 to $3.00 per month effective January 1, 1971. Mr. Stone suggested a mailer be included in the billing prior to the increase. .� Mr. Paulus informed the Board that the District had received a check for $9 37.9 8 from State Compensation which indicates our accident rate has decreased. Mr. Hal Silva's roof was burned due to a faulty weatherhead. Damage was esti- Ic mated at approximately $30.00, and the District will reimburse Mr. Silva this amount. Mr. Stone suggested a maintenance program to check these conductors, etc. Mr. Paulus stated he had been approached by a Mr. Kramer who would like to present a retirement program to the Board for employees. The Board allotted Mr. Kramer a half hour for his presentation on September 15. i i �I Page 139 Au st 18, 19 70 gu (Augus t 18, 19 70 - Cont inue d) Bids have been received from three office suppliers on 8 chairs for the confer- ence room. Two of the bids (Carlisle & Armanko) were identical ($511) . The third bid (Siri) was high. A motion was made by Mr. Loehr and seconded by Mr. Stone that Mr. Paulus be authorized to purchase 8 new chairs. ROLL CALL: Rose, aye; Loehr, aye; Stone, aye; Moore, nay; Doyle, aye. Motion carried. So ordered. Mr. Paulus mentioned the District should consider finishing the painting on the exterior of the office. This work will be accomplished in October if the work schedule permits. Mr. Moore suggested the District obtain expert advice regarding the type of paint to be used from a paint manufacturer's representative. Mr. Doyle brought the Board's attention to the fact that last week a small boy was missing, and someone thought he might have climbed into one of our water storage tanks. This was not the case; however, it was unanimously agreed that all our tanks be checked to ascertain they are padlocked and covered. No further business to come before this Board, a motion was made by Mr. Loehr and seconded by Mr. Stone that the meeting be adjourned. All ayes. Meeting adjourned at 10:22 P.M. PAUL A.
