HomeMy WebLinkAbout1972-07-05 Min - Board July 5, 19 72 The regular meeting of the Board of Directors of the Truckee Donner Public Utility District was called to order by President Nelson Stone at 7:30 in the conference room. ROLL CALL: R. Waters, present; R. Anderson, present; D. Anderson, present; H. Loehr, present; N. Stone, present. EMPLOYEES PRESENT: Cattan, Paulus, Craig, Hutchinson GUESTS PRESENT: Jean Sollen, Paul Chamberlain, Hank Swartz. MINUTES OF JULY 5, 1972 It was moved by R. Anderson and seconded by D. Anderson that the minutes by approved as written. All ayes, motion carried. BILLS FOR THE APPROVAL OF THE BOARD The Board reviewed the bills. It was moved by H. Loehr and seconded by R. Anderson that the bills be paid. Roll Call: R. Anderson, aye; D. Anderson, aye; H. Loehr, aye; N. Stone, aye. President Stone introduced Mr. Paul Chamberlain to the Board. At the last meeting Directors R. Waters and R. Anderson asked that Mr Chamberlain appear to discuss the Herzog Property. Mr. Chamberlain told the Board that he had been digging into his files regarding the contract between the District and Herzog. He explained some of the occurances of the time when the contract was signed. He said that the property was sold for $40,000 with an $11,000 lein on the property. It was stipulated in that contract that the Land would be used for the recreation and enjoyment of the community. R. Waters said that at the present time, Herzog is using the land for his own profit. Shortly after -the contract was signed, Herzog built apartments on the land and is now renting them to skiers in the winter. Director Waters said that he feels that the land should be developed for sking and the children of the community should be able to en j oy the f aci 1 i ty at a re duce d rate. Mr. Chamberlain said that there are two courses that can be taken by the District. Since Herzog has not fulfiled his portion of the contract, the District could either try to repossess the land or sue for damages in a breach of contract suit. Directors Waters said that he didn't think it was important to "sue Mr. Herzog. He said that the District should try to negotiate with Mr. Herzog to reopen the ski area. He said that an agreement could be reached with the Recreation Department, the P.U.D. and Mr. Herzog. President Stone asked Mr. Chamberlain to write a letter to Mr. Herzog inviting_ him to attend a Board meeting. It was decided that a special meeting should be _- held to resolve the problem. Mr. Chamberlain said that he would write to Mr. Herzog as the Board wished. MR. BUTLER The District received a summons on June 28, 1972 from Wallace L. Stevens, who is representing Robert D. Butler for damages to his land. The suit names the P.U.D. as well as McKnight Construction Co. , who built the Sierra Meadows tank, under County supervision and funds. The suit is for $1001,000; $50,000 for breach of contract, cost of suit and further costs as the court may deem proper. The District's attorney, Paul Chamberlain, will represent us. PONDEROSA PALISADES SOUTH Mr. Chamberlain was requested to remain and participate in the discussion of the Ponderosa Plais ades South contract. Mr. Cattan explained the area and said that the developer, Mr. Beavers is asking for water to this subdivision. He said that there are 93 lots involved and our existing water line runs to the corner of the subdivision. This point would be metered and the meter would be read monthly. This would be the extent of the District's responsibility. Mr. Cattan said that they would be charged at the same rate as the other District customers, $1.00 per 1;000 gallons. Page 233 Ponderosa Palisades South. . . . . . . . . . .continued Mr. Cattan said that the contract would be prepared and a resolution of acceptance would be drawn up on Ponderosa Palisades South, for the approval of the Board. MANAGER'S REPORT Mr. Cattan said that Southern Pacific Transportation Company has paid the $12,000 that they owed the District. Mr. Cattan said that. 3,500 ft. of underground line has been laid at the Martis Dam Poo. Recreation area, A weather station for the Army Corp of Engineers , which entailed 300 ft of U.G. has been completed. The line to Quintana has been completed. Mr. Cattan said that Stanley Sales, the developer of Olympic Heights, has requested an extension of the line to that area. Mr. Cattan said that the District would do it. The substation site has been cleared and leveled. The crew is laying conduit for U.G. at Truckee Intermediate School. UNION NEGOTIATIONS The contract was presented to the Board for their vote and approval. There was some discussion on the funeral leave and other aspects of the contract but the Directors were generaly in agreement. The contract was labled Resolution 7215 and it was moved by H. Loehr and seconded by R. Waters that the Board adopt this resolution. Roll Call: R. Waters, Aye; R. Anderson, aye; D. Anderson, abstain; H. Loehr, aye; N. Stone, aye. There being no further business to come before the Board, it was moved by R. Waters and seconded by H. Loehr that the meeting be ajourned.
