October 3, 1972 The regular meeting of the Board of Directors of the Truckee-Donner Public Utility District was called to order by Nelson Stone at 7:30 in the conference room. ROLL CALL: R. Waters, present; R. Anderson, present; D. Anderson, present; H. Loehh, present; N. Stone, present. GUESTS PRESENT: Kirk Ward, August Sassarini, Mr. & Mrs. Robert Jones, Mr. & Mrs. Fred Von Fluee, Mr. & Mrs. S. A. Ralfs, Marigrey Fish, H. C. Schwarz, Lottie Horton, Claire Stewart, Carol Jones, Mr. & Mrs. Norm Traverso, Jeanne Sollen, Jerre Mitchell, Robert Bowles,Peter Durkin, Pat Sutton. EMPLOYEES PRESENT: Cattan, Paulus, Craig, Silva, Grow, Hutchinson MINUTES OF SEPTEMBER 19, 1972 The President asked if there were any corrections, additions, or omissions to the minutes of September 19, 19 72. There being none, it was moved by R. .Waters and seconded by R. Anderson that the minutes be approved. BILLS FOR THE APPROVAL OF THE BOARD The bills were presented for approval. There were not questions regarding the bills and it was moved by H. Loehr and seconded by D. Anderson that the bills be paid. Roll Call: R. Waters, aye; R. Anderson, aye; D. Anderson, aye; H. TRUCKEE MOBILE HOME PARK Stone: We will now deal with item number 4 on the agenda, lab led the Truckee Mobile Home P ark. r I notice we have quite a few visitors tonight, some or most of which may wish to speak their mind. So, IIll set the ground rules. To clarify the function of the Public Utility District, you are best served power and water and manage what little land that belongs to the District. This is not a Planning Commission and I will not tolerate any gripes and /or comments about what success or lack of success you've had at Planning Commission meetings. Our sole duty as a landowner is to , as courts are generally held to provide access to a mans property and land locked behind us. So, the question tonight is pretty much, as we see it, I believe, to grant this access or pay which benefits the District or shall we grant it at the request of another. It will probably be to the County or the County Department of Public Works. Now to recap for the people in the public; we discussed this matter several weeks ago and on the premise that we could not duty access to a landowner whose only feasible access to his property is behind P.U.D. land. We agreed at the request of the landowner when he asked for this, that we should grant access ,across P.U.D. land. In a place and position to be selected by the Board of Directors of the Public Utility District property which in this case would be on each side, of the of the road. There was some discussion of it at that time, that this access should be granted to the county. It was agreed by the Board that in view of the fact that this proposed development has an impact on the community and would split in two the piece of property that the Utility District enjoyed; that we would ask a certain sum for this land. We computed the acreage involved in the land, took an assessed evaluation of the land that we had appraised within the vicinity and applied that price to the amount of $1,250. Now, to get down to any further discussion, anyone who wishes to comment on the Boards' actions or anything relating to this parcel, as long as it does not conflict with my previous statement.., step forward, state your name, and address,. aid your connection with the problem, and each pronent-will be allowed three minutes. Jones: My name is Adele Jones, Truckee, California. I don't possibly see how I can go by your ground rules. Afterall from the very beginning of the easement. . . . . .I maintain that if I got the information from your office we wouldn't be here and there would not be any trailer court. Page 266 Truckee Mobile Home Park . . . . . . Continued Jones: They can' t get the trailer court or the permit if there wasn' t an easement. And they claim that there was. Because your office wouldn' t give me any information, so I couldn' t prove it. So how can I not bring anything up about the Planning Commission? �.,., Stone: Evidently Mrs . Jones , you spoke to the wrong people. The easement has never been granted. It was approved by the Board that we would grant an easement. I think the people that you contacted first had no knowledge at that time of the Board' s action, because they were not in the attendance at that meeting. Jones: Where Should I have gone? I come to your office, to Tom Paulis, as I know him, is the Assistant Manager. And if he doesn' t attend the meetings and read the minutes and know what is going on, then where do I go? Stone: Well you are welcome to read the minutes and have access to the tapes. Jones: Why would I know what minutes? I merely come in here and ask, has the easement been talked about, given, sold, anything? Absolutely not ! So there I am. So I wait, I go to the Planning Commission, and I talk to Sharon and she says, yes they have an easement. So they postponed it. Luckily there was the Sanitary District because they didn' t know how many sewers there would be. I come out here O-- again, but this time when I come, I have a letter that Tom Paulis has signed saying that there was somebody that wanted to get invited to the Sanitary District Meeting right here. So all this time he' s telling me over the phone and out here right in the office, that he knew nothing, absolutely nothing about it, this was stated May the 11th. And you did all of this April the 18th. So I call up Sharon again, and I say I just came from the PUD Board and they sware up and down that didn' t talk about an easement or anything and I said, who in the world handled it? And she told me Duane Anderson handled it. I didn' t even know who Duane Anderson was. I went down to the Government Building and asked them. Who is Duane Anderson? Why he is a member of Board. The PUD Board. Stone: You were misinformed. Jones: Yeah, I' ll say I was. Stone: I excused Duane Anderson from this meeting that was conducted. Mr Tom Paulis was not here, it is not his job. He had no way of knowing what was transcribed at that meeting. And Sharon Mahaffey, why or how she informed.-.on how that easement had been granted, I do not know. Because Duane Anderson was excused from this meeting. I Jones: Well Duane Anderson told Sharon. Stone: As yet the easement has not been granted. Jones : Thats right. But it would have been probably. But now answer me this. I come out here, fighting mad at Tom. I said, look here, I can' t take your word., I've got to talk to Mr. Cattan. He said that he would be here in 45 minutes. Page 267 Mobile Home Park . . . . . . Continued Jones: And I said thats fine. I' ll come out and talk to him. He called me on the phone, in 45 minutes and he said Mr. Cattan, said that absolutely we have not done a thing about an easement or anything. Alright, how about that? You answer me that. Stone: Well, to my knowledge, that the first time that Tom ,,..., definitely knew that an easement had not been granted. Jones: But Tom has been telling me that there hasn' t been any discussion before the Board or anything. Stone: Well, Tom could not have said that, not knowing what the Board had talked about. Jones: Did Mr. Cattan know anything about it? Cattan= Yes. Because I gave it to the newspaper. The local newspaper. Jones : Did they print anything in the local newspaper? Anything about this meeting? Is it up to them to do it? Cattan: They print everything that we give them. Jones : Now I have a copy of that. Because I came right down here. But you can' t hold a newspaper responsible for something like that. They don' t always print everything. I haven' t seen anything in the newspaper about what happened �--+ at your Board Meeting. Stone: Well thats enough for preliminaries for now, Adele, State your business and your case. Well, go ahead Adele. Jones: The whole thing is when I went to the Planning Commission. The Planning Commission was faithful, thats until you get and easement. I had to go to the Board of Supervisors, even they still argued about the easement. But all they would say is the Supervisor' s Meeting. . . .and by the way I even went down and spent $27 to get every tape on everything that was said, including Duane Anderson. And if anybody wants to listen to them they are perfectly welcome. Be- cause over and over again they say that if there was no easement, there is no trailer court. So I have to be happy with that. Because I can' t find out anything. Stone: I find it hard to believe, Mrs. Jones , that the existence of or without an easement dictates the planning use dictated, for a piece of land. Jones: Well thats just the way we did it. on those tapes I've listened to them two or three times at least, and at least seven times shes hollered at the Comissioner Lawrence and all of them. No easement, no trailer court. Stone: Well we weren' t there so we can' t discuss that. Jones: Well, since I can' t tell what happened at the Planning Commission and the. . . .just like I' ll admit that your being put right in the feet of the Planning Commission.. You were exactly right when you said i t. Because thats just the way they have done it. If you've got sense enough to let them do it, and let them have the easement, there will be a trailer court. My name is Norman Traverso, and I live here in Truckee, to. And just like Mrs. Jones , I don' t know most of you people but I have been reading the papers and I've been reading whats going on. So what I think I' d like to do is ask some pertinent questions of this Board. Here is number one, How long have you owned this land? And why was the sudden decision to grant an easement if you' d known about the California land law that states you cannot landlock anybody? Now how long have you owned the land? Stone: I can' t answer that. Traverso: Many years? Fine. Stone: I think maybe since 1930. It would just be a guess. Traverso: So then you've landlock the owner behind you all this while? Waters: We probably have. There was a road grant. I believe the law says that after 50 years, or 40 years or some certain number of years, that it is open to the public and you can' t close it. Not an improved road. Traverso: Well that' s why I asked about this property myself. And I was curious , knowing there was a road there and I was just wondering if it was a public road. I was advised at Mr. Caftan' s office that it was a county road. Is this correct? Loehr: No. It is not a county road. The road leading to this road is a county road. Cattan: The other property there' s a county road. Loehr: The other is being used for Sierra Pacific. Traverso: Used by who? Cattan: By the public. Everybody. It has been a road for forty years. Well, has this been presented to you people as to whether or not it is the developer is doing it on a contingent basis or is it the landowner that is asking for it? I believe we discussed the developer. Traverso: The developer only? S.o =i_n other words it could be j us t like the contractor going up for a building -permit or something _else likethat. -But you don'-t know if =the landowner will- receive .anything from this unless the easement is granted. We don' t really know if the developer may or may not be the landowner. ors-• Traverso: Now I'm just getting familiar with some of the things that are oc-curring in Truckee. But what is the PUD' s purpose in holding this land? Stone: All of the PUD land has been declared surplus. We are disposing of it as we come to an opportune time, when we feel we are getting the best price, -for the people, to get this land on the tax roll. Continued Traverso: So in other words then, the whole package would have to go up for public bid? Stone-, Not necessarily, no, parcel by parcel. Loehr: This would have to go for public bid, if the county requested it. --• Traverso: Now when the county requests this. . . . . I've had dealings with Miss Sharon Mahaffey, and in my opinion. . . . . . I will not announce publicly, I feel that this was an out to ahead and save her face. Now this my own personal opinion. But for you people at this particular time to go ahead and grant this to the county in order for the Planning Department to suddenly look good. In my estimation it is just dirty pool. Because all your saying is that if this is something up for public bid then why don' t you let the public have an opportunity at it? Loehr: Because somebody would buy it for spite. We are in- terested in the development of this area. Traverso: The Chairman of this Board said that in conformance with the California Law, you can not landlock another person' s land. Loehr: You can' t continue? It wasn' t landlocked in the beginning. Never was landlocked. --� Traverso: Why does he need an answer to it if there is a road there already? Loehr: Can' t improve a wheel-track and spread out the yonder. Stone: Anyone in the audience that wishes to speak, must identify themselves. Address the Board. Traverso: I've just had some questions answered, However, I do say that if there is an opportunity that you can do this publicly and legally, to let the public have an opportunity at it. In as much as California Law protects all these owners behine this parcel of land. Then I believe the public deserves that opportunity and that chance in order to go ahead and accommodate a particular developer by dedicating this land to the public. Since your a public entity, and its almost like trading in the family, and then letting them go ahead and declare there is now an easement. I think there is something that has to be investigated. Stone: I don' t think you are into legal minds in this room, can sight to this Board an instance where an easement for a right-of-way has been advertised a public bid. This is something in the normal bid. Traverso: But I notice that the Division of Highways for the State of California, when they have surplus land do put it up for Public Bid. Continued Traverso: You can' t grant and get.. ,money for it. .If you grant you give. - If you se-ll, you sell. Now what are we doing. Are we granting or are we selling? Stone: Whoever requests this easement, we will grant it. Traverso: Well then Mr. Cattan just brought up something, he said you will grant to the county. Why the sudden interest to grant to the County? Have they asked you before? Cattan: T o the count we can grant, but through the Developer he . y has to pay for it. Traverso: I realize that Mr,. Cattan, but why the sudden interest in granting to the County? Cattan: Because we can sell it to the Developer or we can grant it to the County. Traverso: I -under-s tand that. P"^ Cattan: It is illegal when we are given something for nothing. There is nothing illegal. They are both legal. - Every- thing is open and Legal-, There is nothing hid. How much land does that involve? Cattan: The county would not let anyone be blocked. This is the Trailer Court Map here. Sassarini: The main road has to go directly through the Trailer Court. Well why is that? The old road supposedly was on county land. How was that taken with the- Trailer Court? Cattan: Maybe you will have to ask the county, because the roads, they are to decide that. Craig: Personally, 250 acres does not sound like a large number to me, considering I- would take a wild guess that we are using maybe, 10 acres -right now. We- are using that much land and if the system will have- to double every 7 years, thats a conservative-estimate, every 7 years. It will not take long before the 250 acres is use& up by the system. Now you have seemed to make some distinction between selling the easement and selling the property itself. I would just suggest that you may be incorrect on that. And that you should consider further research in that matter. In the actual recording of your meeting on April 18th, Mr. Cattan pointed out that they had a precedent for this sale of the easement. Because they sold one to''Lakeworld. And therefore, you could sell ait again. I' would like to point out that the only people that make precedents that are binding, are the . . . . . , and the Supreme Courts. A precedent is completely teaningful 'to your Board. Now at your meeting on April 18th, Director Duane Anderson rightfully at the very beginning asked that he be excused because he had an interest in the matter to be discussed. However there is already a road through there and the only reason you would have to grant an easement is to favor a land owner or developer that needs to use a bigger road. That road has been there for many years contrary to what Cattan said in the meeting of April 18 th. He said at that time that there was no road through . there and now tonight he said he knows of a road for 12 years. The road is there. It has been used for years and there is no purpose in granting an additional ease- ment unless it is for the benefit of somebody;,_a private individual that has to have a wider road to use the land for his own personal use. Another thing that you mentioned at the beginning, as Chairman of this Board was that in your eting of April 18th, you discussed the necessity .of this easement to the private property owner. You further indicated that the land had been appraised and that there was acertain value for it and so, I'd like to ask you who appraised that land? Stone: We had the land appraised at hilltop. We call it the South Side area. And * we used that appraisal as a basis. . . . Stevens: When was that appraisal? Stone: This summer, on the Brockway Short Cut. . . . . We used the land as a basis for the valuation for this land. Roughly a quarter of an acre. Stevens: The only thing that I would like to add is I believe with all the people talking I covered almost every area of the discussion. I would just like to suggest that if you do grant an easement for the benefit of a private individual, as this obviously is, that I think you will find that you are making a big mistake. I would suggest that you may incur considerable liability; and as a tax payer and citizen here, I would certainly object to the Board incurring unnecessary 1 i ab i li ty for no reason whatsoever. In the event that the County of Nevada requests that easement. . . .if the County of Nevada requests that easement they better have a pretty good reason why they need i t, or you still don't have to grant it. And I think that if you will check that out you will find it to be correct. Stone: Mr. Stevens, are you questioning the value of the paved road through P.U.D. property, which is partly yours? Stevens: I certainly am. Stone: Are you questioning the value it would render to that piece of property? Stevens: I certainly am. It runs right through the middle of it and I think with very cursory study on the subject you will find that the value of that land has decreased considerable by running a paved road right through the middle of it. Particularly when it is to the benefit of a developer that will have tremendous traffic right through this piece of land. I think that is the point that Mrs. Jones and the other land owners right there are trying to make. Their property will be decreased in value by probabl)& 1/3 by having the road �nning through there. Likewise the P,U.D. property will be decreased in value by a certain percentage, what ever that might be. Stone: Could you clarify my understanding that if a ground had been used by motor vehicles for so many years , is it considered a public road and tan it be closed off? Stevens: Well, there are five contingencies in the case of this road and as far as I know, all five of there contingencies have been met. It would be opened to public use. R.Anderson: So then our property is already split in half. Because the road goes right through where the easement is running now. Stevens A two wheel road going through ,there, but not a sixty foot easement with a big paved road with a thousand cars a day. . .as they testified that there would be down below. R. Waters: Now according to you -this Board is Mder- serious liability right now on the easement granted to Lakeworld. Is that correct? How come all of you people didn't come here when this was going on two years ago? Stevens: I didn't know about the Lakeworl d easement. R. Waters : Its the same thing . . . an easement was granted to Shane Brothers up on the hill Page 288 Truckee Mobile Home Park. . . . . .continued R. Waters: there was no objection to that. But that was some time ago, before I was on the Board and it:was done after I was gone, but nobody objected to that. And look what you have up there, now. Pat Sutton: Some people objected to other dealings 6f the P -U-M�= with-the Tahoe-Donner Development, in the early stages and we did appear before this Board which was constituted differently at that time. You were not here at that time. But there were those who did address the Board on that problem. . . .well, not particularly the easement but on other matters. Stevens : I would like to say that Duane is my friend and I hate to say anything that is conflict with his interests, but I believe this is the way this is the legal position that anyone should take on it. I don't thing anyone feels that you are to b lame. I want to point out that I'm not directing them toward Duane's actions. Pat Sutton: Mr. Stone, can I clarify one thing that seems to be coming up again and again from different Board members. The thing that concerns me is that several Board members have remarked that the Department of Public Work%!. will require this easement. I believe that what has happened is that the Planning Commission and the. Board of Supervisiors have approved the rezoning and use permit of this trailer court with eleven conditions. one of which is that they will recieve an easement from the P.U.D. Your not going to get a request from the Public Works Department. The request has to got to come from the developer, because this is a condition of his development . I think that you are in a position where the pressure is on where everything was done despite other actions and despite some misunderstanding and misconceptions and misrepresentation. and you are infact the last court zof appeal, you might say, on this matter. I also like Duane Anderson, but I feel that there is a serious conflict of interest in him representing a developer in matters before this Board. I think that you've put your self of being publicly repremended for allowing him to have participated ir the previous discussions on this and I think that Mr. Trave rs o's suggestion that you take this back to the County , would be a good suggestion, because of all the things that have happened on this particular permit. Stone: I will at this time take,---the opportunity to sparsly answer:--one of your --- comments.. In a community such as this, it would be extremely difficult with this small representation that you have to find qualified members on this Board who did not at one time or another come up with some kind of conflict of interest. You must recognize this when you go to the polls. Pat Sutton: Well, T can't, as a voter, anticipate what you or Mr. Anders ons-' -private interest might be several years from now. Stone: Both Mr. Anderson and Mr. Loehr at one time or another have had to excuse them- selves from participation in the subject matter. They have been very nice about doing this and recognize every opportunity to withdraw themselves from any discussion where conflict might be evident.They are both extremely valuable members of this Board and I think you people can be proud that they are serving on it. Stevens: There is one thing to be disqualified from discussion and there is another thing to be disqualified from voting. Now, as Duane has done tonight he has disqualified himself from discussion. He has made no comment on the whole subject. However at your meeting when you did make a decision I would say that Duane did more talking than anyone else on the Board. So that is a little bit different than what you are pointing out now. I don't think that it is even relevent to this matter right now. You haven't excused him from the Board. You haven't done that yet. I think it was revelent to your decision at the time because when it was suggested that maybe the whole land be sold the only discussion that arose out of that was the statements that I quoted Duane s ayinr'` that we might lose it, it would go up for public auction. . . .other than that, it probably didn't make any difference Loehr: Terminate the hearing, we have other work to do, no use going on. Stone: No, I want to hear from everyone that may have something to say Kuttle: I guess everybody knows me around hear. My name is Karl Kuttle and I'm from Truckee. While I'm here I would like to put one question up. I was here in April and asked to put up the land for bid. I want to bid on it presonally. I don't know.Vhy this as not- been done. Kuttle: Well, the next Question is do any of you Board members or management own any property over there? On that perticular land that you are talking about? I wish you would. I would like to clarify that statement. You want me to go further into that? I think personally at this time, granting an easement is the wrong thing to do. You go through residential area. Can you grant an easement through a residential area? Stone: I think that question would be best directed to the Planning Commission. , who evidently gave this type of zoning back of this, Kuttle: This is why I wish you would live back there. Loehr: Anymore before this sleepy head Board disburses. Jones:'- Thats all they are asking is just for to give that private developer an easement. Then when you do. . . . . R. Anderson: I think we're at a Mexican stand off. We:;have already stated that we are not going to grant the developer and we will grant the county an easement. They are going to have to request it in writing. Pat Sutton: The County didn't have a need for it. R Anderson: Well, fine then. I don't know whats going to happen. Jones: Well, then lets let it go at that. Theres a road down there that developer Stone- can go over il,_Lffie Board feel that the matter should drop right there and closed until such a time the County Department of Public Workd asks this Board for an easement for A.County road. Kirk Ward: Mr. Chairman, can I say something? The County and their-General Plan show a public road from 267 through to 89. They require me to build a lead through my property, contrarty to what you said. It is to be County dedicated road and approved to their standards and that is in the general plan. Stevens : Well, contrary to the meeting of April 18, 1972 stated that there would be a private road on your proposed property. A public road up to that development. Kirk Ward: I didn't even know about this, in fact this meeting as far as I'm concerned is unfair. I heard about this in the paper.-- This is not a Planning Commission of the County of Nevada nor the- Board of Supervisiors. I am a private person asking for an easement across your property and you have always granted easements now you've involved yourself in planning in land use for the County of Nevada.. Now i've been to four public hearing of the County of Nevada. Public Hearings are published and none of these people were there except Mrs. Jones who seems to attack me in some manner or other. She accused be of underhanded dealings with your Board. How many of you have ever met me? I have never seen these gentlemen before tonight. Okay I made a proper request to your Board for an easement across your property which is already there to some effect. I have zoning approved unanamous ly on my property. I have use permit. What in the hell is going on right here? S Stevens: Did you make the request to the'Board? Ward: Yes Stevens: Well, that is strange. It sure didn't come out that way. The request was made from Duane Anderson. Ward: You sit here and condemn Duane Anderson. A lot of people in this room are condemning him., Murray.- McCormic , does about 90 of- the engineering in this area. So I'm sure they are going to be involved in most of the developments that are going on in this area. But now Mr. Traverso; he knew about those hearings he wrote a letter so he knew about the hearing. So where was he? A hearing is a- public thixtg and he could have been there. Ward: Who wasn't honest, you've said that several times , now who is it who was not honest. Jones: I told them that I came down here and talked to Tom Paulus.. . . Ward: Mrs. Jones you have accused me of being dishonest you have accused me of being in cohoots with this Board and now we're not interested in hearing what you have to say, because you make up things to say. Jones : Did I accuse him of being dishonest? Traverso: Mr. Chairman, as I understand the Board of Supervisors approval of this development was contingent and conditioned upon the grant for the sale of an ease- ment. This Board is here to consider that one fact. I think that there has been enough demins trati on of concern over the granting or the sale of any easement particulary in the light that it was misrepresented before the commission and the Board of Supervisors that you either say you will not give it and then defend your actions or you will not give it till the public has had another opportunity to go ahead and be heard without any of the misrepresentation from their own planning staff. Ward: The public has had four opportunities to be heard. Your Board agreed to grant me an easement. , is that not so? Stone: Thats right. Ward: Alright. Now that is the normal procedure right there. What more can you ask? This Board agreed to grant me an easement. Now all these people are coming in here in their select little group and I feel that it is very unfair. You've had those public hearings. Your supervisor from this area made the motion. - -1 Traverso: These people are not elected to plan the zoning in this County. These people are hear under the Utility District. There not here either to be a rubber stamp for something that somebody uses. Ward: They are not a rubber s tamp. Traverso: They made a decision an misrepresentation. There was misrepresentation. . Ward: This Board agreed to grant me an easement. Traverso: This Board stated that it didn't. Ward: Did you or did you not agree to grant me an easement? Stone: We did agree to grant an easement. Traverso: Under what conditions? Ward: I just paid $1,2 0 0 they said its worth $4,0 0 0 an acre and th ats about a quarter of an acre, or whatever it is sand I paid $1,200 for it. R. Anderson: I think that this easement was also contingent that we heard from our legal counsel and he stated that we could do i t. s Stone: Yes, but he also recommended that rather than give ti to the individual property owners , if I'm not mistaken, or the developer, that we give it to the County; and so this is why at our last meeting we then amde the motion that we would wait for a formal request from Nevada County rather then from the developer, because we felt this was more in the best interest of the District and there is a letter on September 18th from Chamberlain & Chamberlain under the circumstances it would appear valid that the District grant an easement to the County of Nevada for roadway purposeg. If it be in our understanding that the County would require the developer to install a road to county standards within the easement area which will provide and improved road through the District property with water and sewer facilities avai lab le and the roadway and so forth. Bohls : The School district would be very interested in what is going on, in the best interest of, the children of the schools, Loehr: Then we have -the Recreation District, all of these people will have priority;* and Jif they refuse, then its open to the public, Cattan: Let' me make some clarification on 'Mr, Bohl' s advertisement I only just met him, his representative asked me to put Mr. Bohls on the" agenda, and he was going to explain to the Board his proposition. And -that Is all the discussion we had, Bohls: Right. There has been -no agreements or anything. We' d like 'the site, and we would develope it into something like this and my proposal is to you. I wasn' t aware of what you were talking about the time elements and the bidding, and all, _but, we think the property might be right for this type of development. If so, we' d like to purchase it and develope it. Loehr: Could you make your studies more or less quietly and then come back and ask us to put it up for bid? And that way you don' t know if your going to get it, even if we do put it up for bid. Its a gamble either way. Bohls: Well I think we need-,more of an assurance of some kind, Anderson: The only way we can give you any kind of an assurance would be to declare the land surplus, and ask the other public agencies if they would like to have first crack at it. And if they say no. . Then we could say to you alright, and in so many days we could put it up for bid. Then you could have some assurance, Bohls: That reasonable. That are we talking about the time limit? Anderson: First of all, do we want to declare the land surplus? This is going to take some discussion. Cattan: The Board decided not to declare any land surplus , unless we do have a serious buyer, because we do not want to go through the expense like we did four years ago. Loehr: Well, we won' t expend anything,- exc ep t, for the advertising for bids. But by the time we put it up for bids , we won' t know. Anderson: Well, we. won' t put it out for bids. And then its declared E surplus and frome that. time on, you know its going to be sole. Thate the only answer we can give you, Bohls: I understand that you have a process that you have to go through, Loehr: Well Chats public land. Continued Bohls: Well let me ask you -this , do you have a: .legal counsel that .you use? Stone: Yes. Bohls: Well, could I have my appointed legal counsel, contact your legal counsel to see if there is a way that we could resolve some sort of -a -basis of a future ,sale of property, or whatever has to take place? Loehr: The- laws are pretty clear on it. There might be some way, I don' t know. I've been a Supervisor for 24 years and I have run .into a lot of things. As I understand it, you can' t sell the .property until you have declared surplus and if you do declare it surplus , you have to put it up for bid. Thats correct, .in the way I understand it. With the least acceptable bid, Bohls First you have to clear it up with the other utilities, companies of the school or whatever before you can call it surplus. Loehr: The� only twe► that would probably be interested are the Recreation and School District: They are the only ones 1 can think o f. I. don' t imagine the Sanitary District would be, because it' s too expensive. Anderson: Maybe the.-Truckee-Tahnel.rani ta.ry Agency. .. Loehr: The hospital; �do they have finances? Bohls : Could I ask the Board your permission .to have a, my legal counsel contact yours to pursue whatever the process we might fall into, to work towards acquiring :the property? Loehr: I. don' t see anything wrong with that, do . you gentlemen? Waters: No. Not at all. Loehr: Let his counsel talk with Chamberlain & Chamberlain. The bids-,were too low, so they were rejected. This was back in 1967, or 1968. Traverso: Is it still surplus? I would assume that when the land - rather bid was rejected.; it-.-was then taken off of the surplus list. Isn' t that what your saying? Actuatl we talked one . out of it. , so the other could- buy it. Sutton: Mr. Stone- as long- I am here I want the record to show that I asked some questions bout this particular -thing now. I wish to address the Board regarding this matter. My questin is , on what basis you, - do you establish whether land is surplus When someone says I will give you $90,000? Anderson; . It is " surplus because it infact surplus property- of this govenmental agency. Stone: Mrs. Sutton, we do have what you might call a sort of a policy. Any land that is not- being placed or shows possibility of being'- in actual production by the Utility-District. In other words we determine if the land is or is not needed for our future developmen t Sutton: So you wait until someone`' approaches ; -offering $90,000? Loehr: Would you suggest that we hold the property, and put it- up for Lid? It is very expensive. It goes into the thousands-,' ` Wewrite' letters: All right? ' Then all I'm saying is that we try to be a responsible -Board. Rather we are a responsible *Board. Sutton: All I say is to do ' this through the proper channels, don' t put yourself in the position of doing some preliminary, unofficial negotiation with anyone. Local or not local. Loehr: Would you like to know how much the land is costing us to hold it. It costs $6300 a year. We don' t pay tax, that is j us t inter-est. So- don' t you think there is a good, reason for selling it? Sutton: Okay, okay. I understand. Stone: Well George-, I would like to know who -this letter is to or from,- Max 'Jones of and who do they represent? Cattan: Sierra Pacific.' when- we' made' the Donner Lake Sub Station we had an understanding in words. Sierra Pacific put the incoming structure and the metering structure when they billed us, that September 1st, : . . ..,.Nov:ember and December. And they charge us for this metering structure, which I Objected _to. -I had a meeting with''them and they took it off. Because you see on the billing, , the dead end -will pay for that, but the metering structure, l e daft l t think we should. He kindly moved that we should pay $9,842, - instead of $13,887. After they submitted their bid'. they found they had made a mistake in charging.- The- total should have been$14-, 719. But they said they would. forget ?bout it since it `was their fault.
