HomeMy WebLinkAbout1973-05-01 Min - Board MAY 12 1973 The regular meeting of the Board of Directors of the Truckee-Donner Public Utility District was called to order by President Roy Waters at 7: 30 P. m. in the conference room. ROLL CALL: H. Loehr, present; D. Anderson, present, arrived late; N. Stone, present; R. Anderson, present; R. Waters, present. GUESTS PRESENT: Winifred Loehr, Jeanne Sollen, Jack and Bonnie Houlgate, Robert and Pat Sutton, Joe Brown, Betty Juliot, Marigrey �•-, Fish, John and Royna Criag. EMPLOYEES PRESENT: Paulus, Kinzie, Krajewski, Silva. MINUTES OF APRIL 17, 1973 The President asked if there were any additions, corrections, or omis- sions to the Minutes of April 17, 1973. It was moved by Director R. Anderson and seconded by Director Stone that the Minutes be approved. All aye; motion carried. BILLS FOR BOARDS APPROVAL After reviewing and questioning a few of the bills, it was moved by Director Loehr and seconded by Director R. Anderson that the bills be paid. All aye; motion carried. RESOLUTION 7307 - ENVIRONMENTAL IMPACT Tom Paulus explained the Resolution which was sent to us from Paul Chamberlain. It states that we will work with the County and State if we are going to put any kind of a bulky object such as a water tank which would be an eye sore to the environment. The Resolution is accom- panied with a 24 page report that explains the provisions that will be followed. Roy Waters asked that a copy of this report be given to the Directors prior to the adoption. The acceptance of this was tabled until after the Directors have had a chance to look over the report. RESOLUTION 7308 - WATER CONNECTION CHARGE This Resolution is only different from the preceeding one in that it states that if a road crossing is required for a new water connection, the x_t al PUD ccst wfl be billed to the applicant. Tom Paulus explained that out of the 60 or so water connections we had last summer, approx- imately a dozen had a road crossing required. These road crossing connections off-set the other connections and made it so that each installation averaged $200. This puts the District in the hole. Director R. Anderson moved for the adoption of Resolution 7308 and his motion was seconded by Director D. Anderson. ROLL CALL: H. Loehr, no; D. Anderson, aye; N. Stone, no; R. Anderson, aye; R. Waters, aye. RESOLUTION 7309 - OMIT MANDATORY CONNECTION This Resolution is the same as the proceeding one with the exception that it does not require the customer to pay the $5. 00 monthly minimum if he is not on the premises . If he desires the electricity to be disconnected, he may do so with no penalty. The original Resolution tended to discriminate against the summer residents at Donner Lake and other second homeowners. So Carried, PONDEROSA PALISADES SOUTH WATER CONTRACT -- The original contract was prepared by Paul Chamberlain sometime ago and was retyped and submitted to the PUD by Raymond Vail and Associates. The Board decided to defer action until counsel for the District had a chance to look the contract over. The subject will be taken up at the next regular meeting. CIRCULAR The circular that will be in the May billings was presented to the Board. This final draft was formed from the discussion on it at the Special Meeting of April 24, and was to be presented for approval by the Board members tonight. With the exception of one line, the circular met with approval by the entire Board. The results of this questionnaire will be brought to the Board on June 5 . Director Loehr moved that a minute order be given to management to print and mail the straw-vote notice. The motion was seconded by Director Stone. All aye; motion carried. RESOLUTION 7310 - EMPLOYEE AGREEMENT Roy Waters explained that after the Special meeting of April 24, the Board held an executive session with the union representative and they came to a decision of granting the employees a 9.4% increase as of May 1, 1973. Also, they raised the insurance payment from 50% to 60%; the District pays 60% of his health and accident policy. An additional paid holiday has been added, the employees birthday. After the Special Meeting of April 30, the Board held another executive session regarding the accumulated sick leave that was paid to the retired manager, George Cattan. This provision was and has always been in the union contracts in the past. Mr. Chamberlain felt this was l6gaL.according to the contracts and Resolutions regarding accumulated sick leave and Vacation pay. Also at the executive session last night, the Board appointed Tom Paulus Acting Manager, and Ken Krajewski Superintendent of both electrical and water and raised his salary by $150. Mr. Paulus ' increase was the same as the rest of the employees , 9.4%. Director R. Anderson moved for the adoption of Resolution 7310 and it was seconded by Director Loehr. ROLL CALL: H. RESOLUTION 7311 - SMALL CLAIMS AUTHORIZATION This Resolution authorizes Becky Craig, Merrilyn Kinzie, or Tom Paulus to represent the District in small claims court. This is being done as the employees that are presently authorized to represent the District are no longer employed. It was moved by Director D. Page 96 BEAVERS TRIAL -3- May 1, 1973 The trial of Beavers vs. PUD is set for May 30, in Nevada City. George Cattan has reviewed the facts of the case and will be subpeonaed to come. Mr. McDonough thought it would be advantageous to have him present des- pite the travel expense from Florida to Nevada City. The flight from Florida to California is $370 coach and $430 first class round trip. Mr. Cattan estimates he will be gone a week or 40 hours at $25 per hour. Mr. McDonough is being contacted on the procedures of how this will be done. r-- MANAGERS REPORT Near the golf course last week, the line truck had a pole dropped on it. The damages were not too severe and will cost approximately $750 to repair. The insurance will cover all but $100. It is still operable and will be repaired as soon as it can be laid up. The new Southside spring pump has broken down. It was either a short or it could have been struck by lightening. If it is a short, the warranty will cover the damage. Presently, water is being supplied by Prosser Heights and the spring pump. The lease on the company Ford will be up in June. We will keep it while George Cattan is here for the trail; after that, we may return it; it is not needed. Mr. Paul Chamberlain feels at this time, the sick leave paid to George Cattan in March is legal. His consensus is that it is legal because for some time we have had a sick leave plan. It is up to the District as to how they want to administer it. OWN- At Lakeworld, we have approximately ten miles of line which they are asking us to complete this summer. Management would like to hire--a couple linemen this summer and laborers to get as much line constructed this summer as we can. If it is put out to a contract crew, it will cost approximately 30% more. The new substation will not be ready for construction until sometime in June as the ground is still mushy. The cost to complete the substation is between $15,000 and $20,000, which will be paid by the District. It was decided since the substation can be put off for awhile, we should put it second after the line extensions at Lakeworld. The help hired for the summer would be mainly hired to work at Lakeworld so that the present crew will have time to put services in around the area. Management was asked to look into the cost of having an outside crew do the work as opposed to doing it ourselves . Tom Paulus was asked to get a written agreement with the telephone company regarding the 40% of the poles they have verbally agreed to install. The Board would also like to get an agreement with the cable TV company regarding the poles set. Providing the tapes are kept from each meeting, the Board had no objec- tion to the Minutes being prepared in summary form. It was pointed out that to type them verbatum is time consuming. Management proposed not reading the water meters this summer. Approx- imately half of the meters are broken, cannot be found, or are hidden by a lawn. To replace the meters, it would cost approximately $70 per meter, $40 for the meter and $30 for labor. 300 meters x 70 = $21,000 to gain about $2,500 per year in revenue. In addition to the replacement cost, there will be added cost in maintaining the meters plus an additional meter reader for the summer months. The main com- plaint from the customers is that a person will pay a high water bill during the summer months while the neighbor will pay the minimum because he has a broken water meter (or buried) for the same amount of water consumed. Management would like to charge the customer a water charge Page 97 MANAGERS REPORT . . . continued -4- May 1, 1973 in conjunction to his lot size. This was merely a suggestion and the fee can be worked out at a later date. The Board was in favor of not readingbthe water meters. The subject of the billing of the water will have t04worked out by management to be presented to the Board for their approval. n % There being no further business to come before the Board, it was moved by Director Loehr and seconded by Director D. (b) A regular employee is one who has completed six (6) months of continuous service with the District. (c) A casual (temporary) employee is one hired for occasional or seasonal work or for a limited time. 2.2 New employees hired -for a regular classification shall be placed on a six (6) month probationary period, at the end of which time, if (s)he has demonstrated his ability and quali- fications therefor, (s)he shall be given a definite classifi- cation as hereinafter set forth. TITLE 3 WORKING HOURS 3. 1 The established workweek for all employees is from Saturday midnight to Saturday midnight. 3.2 The normal workweek shall be five (5) days of eight (8) hours each, and shall begin on Monday and end on Friday. 3. 3 The hours of work for those employees scheduled on a Monday- Friday workweek shall be 8:00 A.M. to 12:00 noon, and from 1.00 P.M. to 5:00 P.M. ; or 8:00 A.M. to 12:00 noon, and from 12:30 P.M. to 4:30 P.M. 3.4 The normal workweek for Service employees shall be five (5) ,�.., days of eight (8) hours each, and shall begin on Tuesday and end on Saturday. 3.5 The hours of work for those employees scheduled on a Tuesday- Saturday workweek shall be 8:00 A.M. to 12:00 noon, and from 1: 00 P.M. to 5:00 P .M. ; or 8:00 A.M. to 12:00 noon and from 12:30 P.M. to 4:30 P .M. 3. 6 Nothing contained herein shall be construed as limiting the right of the District to schedule Service employees to a Monday-Friday workweek. 3. 7 Service employees are designated as : Serviceman/ Warehouseman, Service Utilityman, and Meter Reader/Collector/Serviceman. -2- TITLE 4 STANDBY 4.1 For one man (alternated) in Electric and Water Department each over weekend, five (5) hours pay per day for employee who stands by from 5:00 P.M. Friday to 8:00 A.M. Monday, plus five (5) hours pay for recognized Holidays under Title 6. 4.2 Overtime compensation for all emergency call-outs worked will be paid in addition to standby pay. TITLE 5 OVERTIME 5.1 Overtime is defined as: (a) time worked in excess of forty (40) hours in a work week; (b) time worked in excess of eight (8) hours on a scheduled work day; (c) time worked on a non-work day; (d) time worked on a holiday; (e) time worked outside of regular work hours on a work day; and (f) time worked through an employee' s lunch period. Overtime shall be computed to the nearest one-half (2) hour. 5.2 If an employee is called out by a responsible authority of the District outside the employee' s regularly scheduled hours and works less than two (2) hours, the employee shall receive not •� less than two (2) hours pay to be compensated at the applicable overtime rate, for each such call-out, provided the employee has finished his first call-out and has returned to his home. If the employee is sent on another job or jobs prior to returning home from the initial call without a break in work time, it shall be considered as a single call-out. 5.3 Overtime shall be divided as equally as is practicable among those qualified and available in each department . 5.4 (a) Except as otherwise provided herein, overtime compensation shall mean a rate of pay equivalent to one and one-half times (lkX) the standard rate of pay. (b) Employees shall be paid overtime compensation at the rate of pay equivalent to two times (2X) the standard rate of pay for all time worked in excess of sixteen (16) consecu- tive hours. -3- (Title 5 con' t. ) 5.4 (c) Employees called out on Sundays and holidays shall be paid overtime compensation at the rate of pay equivalent to two times (2X) the standard rate of pay for all such call-outs. 5. 5 (a) Any regular or probationary employee who has worked eight (8) hours or more at overtime rates between his regular quitting time and his next regular starting time, on regular work days, shall be entitled to a rest period of eight (8) consecutive hours upon completion of such overtime work. (b) If the PUD requires the employee to continue work into his regular work period, the employee shall be paid at two times (2X) the standard rate of pay for all hours worked until he is given a rest period of eight (8) consecutive hours. District will make a reasonable effort to notify such employees of job vacancies which occur within 12 months following the layoff. Employees rehired in the 12 month period will be reinstated with all benefits for which they qualified as a regular employee, except in the case of a temporary employee where no rehire status is necessary. 16 . 3 Journeymen who can demote Apprentices shall retain Journeyman status, (linemen, line working foremen.) TITLE 17 VACANCIES 17 .1 Incumbent employees who are qualified shall be given the opportunity to apply for vacancies before a new employee is hired to fill such vacancy. TITLE 18 DISCHARGE AND TERMINATION 18 .1 The District retains the right to discharge any employee for incompetence or other serious cause. The reason for such discharge shall be given in writing within forty-eight (48) hours of the time of such discharge. 18 .2 Reasons for discharge shall include, but not be limited to, the following: 1. Failure to perform work in an efficient, workmanlike manner. 2 . Insubordination. 3. Absent without authorization or just cause. 4. TITLE 19 INCLEMENT WEATHER PRACTICE 19 .1 Employees who are unable to work in the field because of in- clement weatbe r or other similar causes, shall receive pay for the full day, provided they have reported for duty.
