HomeMy WebLinkAbout1974-06-18 Min - Board JUNE 18 , 1974 The regular meeting of the Board of Directors of the Truckee-Donner Public Utility District was called to order by the president at 7 : 30 p.m. in the conference room of the district . ROLL CALL: J. Craig, present ; D. Anderson, present ; P. Sutton, present ; R. Anderson, present ; R. Waters , present. EMPLOYEES PRESENT: Paulus , Kinzie f Director Sutton requested that the meeting, due to its size , be held in another location that would accommodate those present. Roy Waters did not feel the meeting should be moved and continued with the i regular business . i j MINUTES OF JUNE 4, 1974 The president asked if there were any additions , corrections , or omissions to the minutes of June 4, 1974. It was moved by D. Anderson ..-.. and seconded by Craig that the minutes be approved as written. All aye; motion carried. BILLS FOR BOARD' S APPROVAL John Craig questioned the Dart Resorts payment which represented the reimbursement of amounts received from Dart for Unit 10 of Tahoe Donner. Approximately $34,000 in time deposits will mature Friday and be trans- ferred into the General Fund which takes care of most of the obli- gation of funds according to the new contract with Dart reported Mr. Paulus . After questioning a few of the other bills , it was moved by Director R. Anderson and seconded by Director Craig that the bills be paid. All aye; motion carried. RESOLUTION 74-- W. RIVER STREET ASSESSMENT DISTRICT A resolution has been prepared that would authorize Dan Cook of Cook Associates to prepare and call for bids on the W. River Street water line installation as described in Case 4. Director Sutton asked if a bond has been required by the fire district that a private fire flow system be built on one owner' s property in the event that the assessment district did not include this property. She thought this had been required of a parcel on W. River Street. Dan Cook did not know anything about this fire district requirement . Director Sutton asked that this resolution be tabled until after the fire district is contacted regarding their plans on the water require- ments . Dan Cook suggested approving the resolution and continue with the plans to the point of a public hearing which could always result in an amendment to this resolution. The W. River Street resolution and the Electric Connection Fee reso- lution were tabled until after Item 4, Preliminary Draft of EIR, was discussed. At this time , Rex Anderson made arrangements to move the meeting to the Tahoe Truckee Unified School District office in the conference room. The meeting adjourned for ten minutes and reconvened in the School District _office. (In transit, ,_s omething happened. to the tape recorder so the rest of the minutes are done by memory rather than by tape. ) an 1�� PRELIMINARY DRAFT OF ENVIRONMENTAL IMPACT REPORT Mr. McDonough first explained that the draft was initiated as a result of a suit against the district and dart regarding the Donner Lake intake facilities . He said that in July 1973 , the Board of Directors designated the firm of Jones and Stokes to conduct an environmental impact report under Resolution 7319 with Dart Resorts paying the cost of that report. The draft report was first presented to the State Lands Commission in December and they are still examining the report and making changes . When the document is completed, the Commission will issue the report as its own but it will get comment from State Agencies and concerned people and hold a public hearing. AFter the public hearing, the Commission will issue the final report. Mr. McDonough quoted the report as presently being in a "state of f lux" . Charles Hazel spoke about the preparation of the report . He said that his firm, Jones & Stokes , worked closely with the State Lands Commission to bring the report into conformity with State Lands Commission standards . Information was gathered from various sources such as the U. S. Forest Service , Truckee Sanitary District, Regional Water Quality Control Board, School Boards , along with various PUD consultants . Director Sutton felt much of the information contained in the report was outdated and contradictory. Mr. Hazel said he hoped these errors would not appear in the final publication. He stated that the information contained in the EIR was obtained last summer and that much of it was background. Mrs . Sutton felt that the PUD board has some responsibility to review the draft. Director Sutton wanted to know why the Truckee-Carson Irrigation District water rights were referred to in the report without clari- fying their rights . Mr. Hazel said it is a problem raising legal issues in the context of an EIR and felt there should be a separate legal report . Mr. McDonough said he would be happy to prepare a legal opinion on this issue . Director Sutton said she would like that. John Craig asked at what time and on what project will the district reach a limitation of water supply. Mr. Hazel stated he could not answer the Question as he had no such analysis . He did feel, how- ever, that there is sufficient water for the foreseeable future . Mr. Hazel said 3 , 400 acre feet of water is needed to supply all lots subdivided in the district (the number of subdivided lots was later given as 10 , 800) . Director Sutton asked Mr. Hazel who decided that Jones & Stokes would do the EIR. Mr. Hazel said the selection was made by Dart Resorts . She also asked who decided what information and studies would be included in the EIR, and who decided which consultants the district has , or has had in the past, would provide information for the EIR. The answer from Mr. Hazel was that Jones & Stokes contacted the consultants recommended by the PUD and Dart . A member of the audience asked the affect on Donner Lake as a result of the pumping. From the information available over the past 13 years , Mr. Hazel said the approximate drop was between three inches and 2 . 4 feet historically between June and August. He stated the lake level would not be lowered more than seven inches and will normally be three inches . The effect on Donner Creek would not lower its level more than 5 cubic feet per second (CSF) for fish protection. Director Sutton asked if the Fish and Game might protest the 5 CSF as they have requested a minimum flow of 15 CSF. Mr. McDonough said that Fish and Game has protested the application before the State Water Resources Control Board as is their custom. Eugene Wetzstein asked the Chairman why the district did not engage the environmental consulting firm themselves to assure impartiality. Roy Waters answered that it was strictly a matter of cost to the district. Mr. Wetzstein continued insisting that the choice should have been made by the district and paid by the district. Roy Waters told the audience that the document will come from the State Lands Commission regardless of who made the study. Mr. Wetzstein felt the Commission simply reviews the data that is prepared by the consulting firm. Attorney Adolph Moskovitz representing Dart Resorts stated that the contract that the district signed with Dart required the EIR. Jones and Stokes was selected because it was recognized in the State Page Two - June 18 , 1974 4rkqJ Preliminary Draft of EIR . . . continued as a reputable firm. The State Lands Commission and the Water Resources Control Board were consulted regarding the selection and the district concured in the choice . Dr. Affeldt said that it is good that the taxpayers were not picking up the tab on the report as it was only benefiting Dart Resorts . Since Jones & Stokes is known reputably throughout the State , Dr. Affeldt did not see any objection to their handling the EIR. A young lady asked what conclusions were reached as a result of the report. Mr. Hazel later, after being again questioned by Lottie Horton, read and commented on the beneficial and adverse affects on the environment due to the installation of the intake facilities . A copy of this chart from the EIR is attached as part of the minutes . John Craig stated that it appeared in the EIR that the projection of Donner Lake water affected the entire area and not just the Tahoe Donner subdivision. Mr. Hazel said that the high quality of water to the Truckee-Donner PUD was analyzed over a long period of time . Mr. Craig got the impression from the EIR that the water would be going to the rest of the people in the district , which was not the impression given a few years ago by a previous board. Fred Damavandi said that the Board at the time felt the water could be disconnected and go only to Tahoe Donner. Director Sutton asked Dr. Sharp about the geological study he is presently conducting for the PUD. This report involves a ground water study in the Truckee area. He informed the board that the report is presently 60 o complete and hoped it would be done within a few months . Director Sutton asked why the EIR isn' t delayed until Dr. Sharp 's study is completed as it would show the possible availability of ground water in the area. She thought it would be beneficial to have Dr. Sharp' s study included in the EIR. Nola Smith asked if the "bomb looking tanks' could be hidden or buried. Dan Cook said that technically it would not be easy. Neither t the horizontal or vertical tanks could be buried. There will be four T horizontal tanks ultimately. F f Dan Cook commented that there is presently an overabundance of water and water storage in the Prosser Heights-Prosser Lakeview Estates area. He was later asked if it could be transported for Tahoe Donner j use. . Dan Cook did not feel this was a practical solution. Nola Smith was concerned about just how much water could be pumped out of Donner. Don Kienlen said that the lake level could not be lowered more than 5 ,932 feet before the end of August in any year as specified in a Sierra Pacific contract. Frank Beardsley said according to his calculations , the lake would drop three feet making piers inoperable . Mr. Haze-1 said a study showed a drop of 3-6 inches in lake level did not affect six sample docks . In some places , Mr. Hazel said a verti- cal drop of one foot would result in a maximum 13 foot beachline ex- posure. Normally he felt that one foot of vertical drop would result in a 5- 8 foot beach exposure. Mrs. Sutton asked why Mr. Kienlen' s operational study was based on annual water withdrawal of 1 , 562 acre feet rather than the 4,000 acre feet in accordance with the Sierra Pacific contract. Mr. Kienlen said that it was due to storage level capacity and prescribed water level . When asked how much water is available on the Tahoe Donner project itself, Mr. Damavandi answered that 8 test holes were drilled with negative results . Dan Cook said the other sources on the project would last until 1980-1982 without going to Donner Lake . A woman in the audience asked what action would be followed if the Commission turns down the application for state-owned land which supports the Donner Lake intake facilities . Mr. Doskow answered that first they would appeal and then dig more wells . Mr. McDonough later stated that the PUD-Dart Supplemental Water Agreement provides for diversion of water from Donner Creek should the application be denied. Chairman Waters thanked those present for attending; and announced that after a ten-minute break, the board would meet in executive session.
