HomeMy WebLinkAbout1974-10-01 Min - Board OCTOBER 1 , 1974 The regular meeting of the Board of Directors of the Truckee-Donner Public Utility District was called to order by the president at 7 : 30 p.m. in the conference room of the District. ROLL CALL: Craig, present ; Sutton, present ; Anderson, present ; Waters , present. EMPLOYEES PRESENT: Cash, Kinzie, Hobensack, Craig OTHERS PRESENT: Arthur Broughton (Sierra Sun) , Salty Gebhardt , Dan i Cook, Ed Ness , R. C. Maki , J. C . Smith, Norma Jacobsen, Lowell Northrup , Fosten Wilson, Jr. DISCUSSION WITH MR. JAMES MURPHY Mr. Jim Murphy from Alexander Grant & Company was present at the meet- ing and distributed to the Board, manager and legal counsel the financial report through the month of August . Mr. Murphy explained the reports ; a copy of which is attached as part of the Minutes . Mr. Murphy pointed out that the water and electric inventories were up over $70, 000 from December 1973 which represented the decrease in ` cash. The accounts payable increased from $104, 000 in December to $169 , 000 at the end of August. Mr. Murphy suggested an investigation be made regarding the charges for services. The Truckee charges for service were $50, 800 and the cost of power was $46 , 300 which is slightly over 900 . Mr. Murphy thought the charges should be 60 to 70 percent higher than the cost. The Donner Lake charges are $26 , 000 with $10, 000 costs . The Directors questioned a few of the figures in the reports. Mr. Murphy asked that the Board look at the reports and make a list of questions or suggestions about what the Board would like more in- formation on. Mr. Waters appointed a committee of Pat Sutton and John Craig to meet with Mr. Murphy regarding any questions or recommen- dations they may have regarding the monthly financial reports. INTRODUCTION OF MANAGER Lyell Cash introduced Mr, Paul Hobensack to the Board and public. He officially started work today as the permanent District Manager. j MINUTES OF S,EPTEMBER 17,_ 1 P 7 4 The President asked if there were any corrections , additions , or omissions to the Minutes of September 17 , 1974. It was moved by Director Sutton and seconded by Director Craig that the minutes be approved as written. ROLL CALL: Craig, aye ; Sutton, aye ; Anderson, aye ; Waters , aye. BILLS FOR BOARD' S APPROVAL John Craig asked if the wire ordered several months ago had been received. Mr. Cash said that all wire ordered has been received I with an outstanding billing from Anixter Pruzan. Mr. Cash thought ! that the present wire supply will get the District through the winter and into next spring. Director Sutton questioned the amounts paid under payroll for overtime. Mr. Cash said that the water department' s overtime is being billed to Dart for operation of the Northside Well . Becky Craig ' s overtime was explained as being incurred to bring the books on a current basis . Mr. Cash did not think this substantial cost would be a constant occur - rence. It was moved by Director Craig and seconded by Director Rex Anderson that the bills be paid. ROLL CALL: Craig , aye ; Sutton, aye ; Anderson, aye; Waters , aye. So move . PUBLIC HEARINGS - NEGATIVE DECLARATIONS ON ENVIRONMENTAL ASSESSMENTS Mr. Cash reported that he has received no written or oral protests to the negative declarations on the environmental assessments . Joe Joynt has prepared three resolutions for the three projects which state that the project does not have a significant effect on the environmental , approves the project , and requires that a Notice of Determination be filed with the County Clerk and posted at the Dis- trict office for ten days . Mr. Waters asked if any member of the audience opposed the findings of the Board regarding the environmental assessments. There were none . Director Sutton requested that the proceedings on the Armstrong. System Upgrading and Highway 267 Intertie be tabled until- the Dis- trict knows when the construction could commence. At the present time, the projects would not be started for lack of funds. Presi- dent Waters felt that the financing of the projects could be done by next spring and that the appropriate action should be taken now so that duplication does not occur. Director Sutton moved that the negative declarations on the Armstrong Upgrading and Highway 267 Intertie be tabled. Director Anderson asked if tabling the resolu- tion and Notice of Determination would necessitate duplication in proceedings. Mr. Joynt thought that the resolution and Notice of Determination could be tabled until next spring but would have to look into the Environmental Guidelines to be certain. The Special Use Permits obtained by Cook Associates from the Forest Service and Division of Highways , Department of Transportions , can be held over until next year if necessary. Director Sutton moved that the matter be tabled until the end of the meeting. The board members agreed with this motion. Director Craig moved that Resolution 7423, Approving the Project known as W. River Street Main Extension, Determining that the Project will not have a Significant Effect on the Environment, be approved. Seconded by Director Anderson. ROLL CALL: Craig, aye ; Sutton, aye ; Anderson, aye; Waters , aye. PUBLIC HEARING ON W. RIVER STREET ASSESSMENT DISTRICT The Public Hearing was officially declared open. Dan Cook explained the bid results to the Board. The lowest construction bid received was from H. M. Byars Construction Company from Reno , Nevada, in the amount of $85 , 076. 50. The Engineer' s Estimate of construction was $68 , 751. Dan Cook is presently working with Byars to reduce the cost of construction. Assessment #9 , John Quintana, is being elim- inated from the construction plans reducing the cost by $4,600. Mr. Quintana believes his property can be served with water from the District' s existing six-inch line further east . The Fire Dis- trict is agreeable to this arrangement. Dan Cook explained that there are three factors affecting the present cost of the project. Mr. Ness has obtained a 30 0 less bond discount than .origin- ally anticipated, incidental . Costs to be incurred by the Engineer and Bond Counsel are the- same as contained in the estimates , and the $20, 000 to be received by the District for Capacity Purchase and Contingency Fund is being reducted to $13,102 . 59. One other factor changed to reduce the cost of construction is the elimination of two originally planned fire hydrants . One was near the Quintana property and the other was placed in such a manner that it gave fire protection benefit to persons who voiced a strong objection to being included in the project. Another change in construction plans is a different location for the Southern Pacific Railroad crossing which is possible since the Quintana property will not be served by the line. With these changes , the total construction cost is $74, 458 compared to the original proposal of $85 , 076 . 50 . To increase the amounts of each assesment , another month' s time. would have to be added to set a public hearing. The delay would increase the cost of construction and would probably mean the project could not be completed this year because of weather. Mr. Rueben Maki of the Truckee Fire Protection District stated that the fire protection on the West River Street is badly needed to allow further development in that area. The present position of the Fire District is that no more development will be approved without ade- quate water systems installed. River Street Assessment District . . . continued owners present all voiced the opinion that the water is necessary and hoped the Board would continue with the project. Prior to Mr. Ness presenting the resolutions that need to be adopted, a ten-minute break was taken. Director Sutton suggested that the District might have to levy a special tax or charge on the properties in the W. River Street area to help make up the difference to the District for the Capacity Purchase and Contingency Fund. Mrs . Salty Gebhardt felt that the cost of each assessment was increased substantially because the loop- I inR_ system was not undertaken and felt additional excess charges would be out of line. Under the present water rate structure , there are provisions for standby water charges according to water line size. The majority of the board agreed that the assessment district should be continued. At this time, the Public Hearing was declared closed. Mr. Ed Ness presented to the Board the necessary resolutions that need to be passed and documents to be filed with the assessment pro- ceedings. It was moved by Director Craig and seconded by Director Anderson that the protest letter submitted by John Quintana dated September 21 i be overruled since Mr. Quintana has been given zero assessment. ROLL CALL: Craig, aye ; Anderson, aye ; Sutton, aye; Waters , aye. Resolution 7424 is amending the Resolution of Intention. The amend- ment provides that interest rate shall not exceed 80 . However, i Mr. Ness said the interest rate to be charged will be 720 . It was moved by Director Craig and seconded by Director Anderson that Resoluiton 7424, Amending Resolution of Intention, be adopted. ROLL CALL : Craig, aye ; Sutton, aye ; Anderson, i aye ; Waters , aye. A Letter of Commitment was received from Stone and Youngberg for the purchase of the bonds. The letter provides that the bonds will be purchased at 930 of par plus acrued- interest. i i Resolution 7427 authorizes the sale of the bonds to Stone and Young- berg. It was moved by Director Anderson and seconded by Director Craig that Resolution 7427 , Authorizing the Sale of the Bonds , be approved. It was moved by Director Craig and seconded by Director Anderson that Resolution 7428, Authorizing Engineer of Work to Make Changes in the Work, be adopted. The Notice of Award of Contract has to be published in the local newspaper as well as filed with the proceedings . The Resolution Authoriz-in Execution of Agreement between H. M. It was moved by Director Craig and seconded by Director Anderson that Resolution 7430, Authorizing Execution of Agreement between H. M. Byars Construction, be passed with the execution following the District receiving the signed Change Order from H. M. Byars. All aye . The remaining items on the agenda were received for filing purposes only. STATEMENT FROM DAN COOK Dan Cook presented the Board with a statement (a copy of which is —' attached as part of the Minutes) that water is not being pumped from Donner Lake for the testing of the pumps at the intake facil- ities . The seal placed on the valve is presently in place. DISCUSSION WITH CANDIDATES TO FILL BOARD VACANCY The Board discussed with the following candidates their desire to become a Director on the PUD Board, their qualifications , and past experience: 1. Robert Christensen, 2 . Brian Flaherty, 3. Karl Kuttel, 4. Jim Maass , 5. Ray Smith, 6. Fosten Wilson, Jr. DISTRICT COUNSEL REPORT Mr. Joynt advised the Board that the attorney for Jones and Rich has filed an amended complaint and settlement talks may be forth- coming. MANAGER' S REPORT 300 KVA Transformer Inquiries Mr. Cash presented the Board with a break-down of the transformer inquiries for two-300 KVA transformers . The lowest price was from Allis-Chalmers in the amount of $2 , 609. 00 each with the standard escalation clause. The delivery time is eight weeks. It was moved by Director Anderson that the Board instruct the manager to nego- tiate with Allis-Chalmers for two 300 KVA three phase transformers with the maximum price being $2 , 800 and delivery is eight weeks . Report on Ownership Search Mr. Cash reported that one of the vehicles abandoned at the South- side Well by the well driller is registered with the Nevada Depart- ment of Motor Vehicles to Sierra Drilling in Reno who is the company that the district dealt with at the time of the bidding. The other vehicle has old California license plates on it and the DMV in California has no record of the licensing because records prior to 1971 are destroyed. There are provisions in the State Codes which allows the County Sheriff' s office to impound the vehicles after 72 hours notice to the owner. The Board decided to have the Attorney attempt to contact Mr. Dean again and have the Sheriff' s office take the necessary steps to remove the vehicles from the District ' s prop- erty. The Planning Commission of Nevada County has written the District asking for any comments they may have on the proposed Curran Dis- tributing building to be constructed on River Street . The Board did not have anything to submit to them regarding this installation. Director Sutton asked if the District had been contacted regarding water supply to the proposed campground for Tahoe Donner on property formerly owned by the District. Mr. Cash was not aware of any formal request for water. He did receive notice from the County regarding a public hearing on the Use Permit . Mr. Cash was directed to write Dart Resorts regarding water and power arrangement for the campground. Page Four - October 1, 1974 Manager' s Report . . . continued Miscellaneous Mr. Cash asked the Board if they would sponsor a bowling team con- sisting of District employees at a cost of $20 to join the league. President Waters also said the bowling team would like to know if the District would purchase the team bowling jackets if they are sponsored by the District. The cost of the jackets was quoted as $87. 00. It was moved by Director Craig and seconded by Director Anderson that the Board authorize the expenditure of $100 to go towards the league fee and bowling jackets for the Employee Associ- ation Bowling Team. There being no further business to come before the Board, it was moved by Director Craig and seconded by Director Anderson that the meeting adjourn into executive session to discuss a Vice-Chairman and Treasurer of the District and the Board Vacancy. The meeting adjourned at 11 : 15 . The meeting reconvened to regular session. It was moved by Director 4 Sutton and seconded by Director Craig that Rex Anderson be elected the Vice-President. " and substituting therefor on Page 3 the following paragraph: "NOTICE IS HEREBY GIVEN that serial bonds to represent unpaid assessments , and bearing interest at the rate of not to exceed eight per cent (8 0) per annum, shall be issued herein in the manner provided in Division 10 of the Streets and Highways Code , the Improvement Bond Act of 1915 , the last installment of which shall mature fourteen (14) years from the 2nd day of July next succeeding ten (10) months from their date. COOK OCIA S gineer of Work BY ENGINEER'S REPORT AND ASSESSMENT WEST RIVER STREET ASSESSMENT DISTRICT, TRUCKEE- DONNER PUBLIC UTILITY DISTRICT, COUNTY OF NEVADA, STATE OF CALIFORNIA WHEREAS, on the 29th day of August, 1974, the Board of Directors of the Truckee-Donner Public Utility District, Nevada County, California, pursuant to the provisions of the Municipal Improvement Act of 1913, adopted its Resolution of Intention for the improvements and acquisitions in West River Street Assessment District, Truckee-Donner Public Utility District, County of Nevada, State of California, as more particularly described in said Reso- lution of Intention; and WHEREAS, said Resolution of Intention directed the Engineer of Work to make and file a report with the Board of Directors of the Truckee-Donner Public Utility District containing the follow- ing: a. Zoning b. Planned Land Use c. Developability d. Parcel Areas e. Frontage on Facilities The above factors are determined, analyzed, weighed- and computed to provide an assessment that reflect the demand that the particular parcel is anticipated to make upon the water system. The "theoretical demand" may or may not presently exist, however, the system is designed and will be constructed for that demand. To properly spread the cost the benefits are considered to exist at the time of completion of the works . - The gross cost of the project were proportioned between fire flow demand and consumptive water demands . The resulting respective cost were then proportioned using zoning, land use and net area for the fire flow benefit. The consumptive benefits were derived utilizing frontage, developability and zoning . Background of the, Engineer of Work : Dan J. The valve installed in the intake piping outside of the pump sump is in the closed position and has not been spent since installation in the spring of 1973 . - No water and I would like to repeat, no water has been pumped { from Donner Lake. The pumps have been tested with water from the Donner Trails system.
