The special meeting of the Board of Directors of the Truckee-Donner
Public Utility District was called to order by the President at
4 : 30 p.m. in the conference room of the district.
ROLL CALL : Waters , present; Sutton, present; Wilson, present ;
Anderson, present ; Craig, present.
EMPLOYEES PRESENT: Hobensack, Kinzie.
OTHERS PRESENT: Dan Cook Kathie Radtke (Sacramento Bee Reporter) ,
Art Broughton (Sierra Sun Reporter) , Paulua Sutton,
Joseph Q. Joynt.
LETTER TO DEPARTMENT OF REAL ESTATE
The Directors were presented with copies of a preliminary letter
from Dan Cook to the Division of Real Estate (a copy of the draft
is attached) . Mr. Craig stated he was satisfied with the draft
letter and asked what the other directors thought.
Mr. Waters asked if the final decision on the release of the Letter
of Credit was with the Department of Real Estate . Dan Cook said
it was , and the District' s part in the matter is to make them aware
of the current conditions of the Tahoe Donner water situation. His
opinion was that the Board would be equally criticized whether they
recommended to the DRE the release of the Letter of Credit or the
retention of the Letter.
Director Sutton asked if reference should not be made to the fact
that there may be a need for a new water agreement since Donner
Lake water will probably be denied. She also wanted to see the
uncertainty of the date of acceptance spelled out a little more ;
specifically, the problems that are preventing the acceptance of
the Donner Donner water system. It was later decided this would
not be necessary.
Mr. Doskow has asked Dan Cook to expand a little in his letter.
Under Number 1, Mr. Doskow wanted a reference indicating that
Dr. Sharp feel there is adequate ground water available. Mr. Cook
thought the report (Groundwater Study) says this and there is no
need to restate it. Mr. Doskow also asked that the letter point
out that the District has bonds covering the completion of the
water system. Mr. Cook thought this was a matter of record and
does not need to be reaffirmed.
Mr. Joynt stated there was no legal protection in the bonds for
unsatisfactory work on the water lines in Tahoe Donner.
It was brought up that if additional ground water sources are secured
to supply Tahoe Donner, there is still no means to transport this
water to the subdivision and a new water agreement would need to be
prepared. Particular reference was made to water from the Airport
Well and Joerger #1 Well. Mr. Cook said this could be added.
Under Number 1 on Page 1, Mr. Cook said the sentence stating, "Dr.
John Sharp rrepared, in accordance with the supplemental water
agreement, the report entitled 'Availability of Ground Water,
Truckee-Donner Public Utility District, Nevada County California'
dated February 14, 19751 , he would add "a copy of which has been
made available to your office."
It was moved by Director Wilson and seconded by Director Waters
that Dan Cook be authorized to send the proposed letter as presented
tonight with the above modifications . ROLL CALL: Waters , aye ;
Sutton, aye; Wilson, aye; Anderson, aye; Craig, aye. SO MOVED.
Mr. Hobensack requested the Board consider additional information on
the downtown undergrounding project; the Chairman said the item was
not on the agenda for this special meeting. Directors Sutton and
Wilson objected to consideration of any item not posted on the
special meeting notice.

Mr. Hobensack reported that he had received a proposal. from Mande,
ville Construction for excavation, installation, backfill and
repaving for telephone power, and TAT in Downtown Truckee . The
sewer line construction, also being done by Mandeville construction,
is scheduled to commence next week. Mr. Hobensack mentioned that
the Telephone Company is uncertain as to their participation in
the undergrounding project . He felt that if this occurs , the whole
project should be discontinued until the Telephone Company pursues
the matter again.
A question was raised as to whether the PUD could participate in
a joint effort if the cost was more than the amount, $3 ,000 , the
Code requires to go to bid. Mr. Cook thought the construction work
could be handled under a Change Order to the Mandeville contract
with the Sanitary District. The Sanitary District did go to bid
on their work and Mandeville was the low bidder. Mr. Cook said
a similar situation was involved in a contract change order with
the Sanitary District by the School District. In that instance ,
the attorneys for both districts ruled this to be legal since
the Sanitary District publicly noticed for the work and received
bids and awarded the contract to the lowest bidder.

r r Dan Cook looked at the proposal from Mandeville , he recommended
that the change order should be made to the Sanitary District ' s
original contract. The proposal, as submitted by Mandeville,
states that the price is not firm. It also does not specify
what the backfill , paving, etc. , will be. Under a change order ,
the specifications will be the same as the Sanitary District.
It was decided to set up a special meeting to further discuss this
subject. The meeting was set for Wednesday, May 14, at 4 : 30 p.m.
There being no further business to come before the Board, it was
moved by Director Anderson and seconded by Director Wilson that
the meeting adjourn.
The special meeting of the Board of Directors was adjourned by
the President at 5 : 22 p.m.

Dear Mr. Carlson:
It is my understanding that you are considering the release of
Dart Resort's five million dollar letter of credit. At issue
is the ability of the District to supply adequate water for the
development.
Please refer to our letter of August 2, 1974 and our letter of
December 17, 1974 describing the circumstances under which the
District can serve the current needs of the 3700 lots and 200
condominium units for which public reports have been issued,
and how the .increasing demands will be handled as the subdivision
is built out '.
There have been three significant developments which have taken
place since December 17, 1974 that will have a rather profound
impact on the ultimate solution of the water problems of the
Truckee region.
1. Dr. John Sharp prepared, in accordance with the

Public Utility District, Nevada County California"

2. The staff of the State Lands Commission and the
staff of the Water Resources Control Board informed
the District and Dart on March 6, 1975, that most
likely the lease across state lands for the intake
pipe would be turned down .
3 . The District, at Dart ' s suggestion and with Dart ' s
concurrence, requested a 180 day delay in the scheduled
hearing so that other alternatives presented in Dr.
Sharp 's report could be properly analyzed and a
coordinated development plan prepared. The 180 days
commenced April 2, 1975.
Dart is at this time exploring ground water possibilities through-
out the Truckee region. Their early attention has been focused
on existing producing wells such as- the airport well and the
Joerger Well No. 1. The time frame is of concern to the District
and to me. Dart representatives have, at this early date,
expressed pessimism that definitive results can be obtained in
the 180 days. 1
During this interim time the District is proceeding under the
terms of the supplemental water agreement which provides for
projected water needs and ways and means to satisfy those
projected water needs.

Should the water demand at Tahoe Donner equal or exceed the 650
GPM this summer, the District will give Dart notice that additional
source of supply must be assured by years end. I think this
illustrates our concern with respect to the timing.
The intract pumping and storage facilities have not been accepted
by the Truckee Donner Public Utility District at this time and
the probable date of acceptance is unknown. Dart is operating

the system at this time while completing the work and presumably
will continue to do so under the terms of their County Health
Department permit.
The decision whether or not to release the letter of credit is
yours alone, however, the District appreciates the courtesy
that you have extended us and we hope these comments are useful
to you in your deliberation .

The regular meeting of the Board of Directors of the
Truckee-Donner Public Utility District was properly and
duly noticed pursuant to law for Tuesday, May 20, 1975 ,
at 7 : 30 p.m. in the District Office , Truckee , California.
Merrilyn Kinzie , Secretary to the Board of Directors, was
present. There were no directors present and no quorum
to do business.
By virtue of Section 54955 of the California Govern-
ment Code , I , the undersigned, adjourned the regular
May 20, 1975 , meeting to Tuesday, May 27 , 1975 , at the
hour of 7: 30 p.m. at the same place.
