TO DISCUSS THE FOLLOWING ITEMS: AGENDA: 1. Resolution 7511 - Standby Resolution 2. FPC Objections to Opinion No. 730 TRUCKEE-DONNER PUBLIC UTILITY DISTRICT BY: 174r UL HOBENSACK, MANAGER JC:mhk r^ JULY 23 , 1975 The special meeting of the Board of Directors of the Truckee-Donner Public Utility District was called to order by the Chairman at 5 : 00 p.m. in the conference room of the District. ROLL CALL: Waters , present; Sutton, present ; Wilson, present; Anderson, present; Craig, present. EMPLOYEES PRESENT : Hobensack, Kinzie OTHERS PRESENT : Chuck Doskow, Sid Karsh, Charles White , Don Davis , Don Strand RESOLUTION 7511- STANDBY CHARGE The Board was presented with a resolution authorizing Nevada County to collect the standby electric and water charges for vacant lots with power and water facilities . It was moved by Director Anderson and seconded by Director Wilson that Resolution 7511 be adopted. ROLL CALL: Waters , aye ; Sutton, aye ; Wilson, aye; Anderson, aye ; Craig, aye ; SO MOVED. Chuck Doskow asked if Tahoe Donner lots are included among the parcels for the water standby charge. The water lines in Tahoe Donner have not been accepted by the District and Mr. Doskow did not believe the standby charge could be levied against those lots . Mr. Hobensack thought that the lots in Tahoe Donner are included in the printout. This resulted in a motion by Director Sutton and a second by Director Wilson to rescind the action taken on the adoption of Resolution 7511 until this can be checked into and corrected and that the subject be placed on the agenda for the special meeting on Tuesday, July 29 at 9 : 00 a.m. ROLL CALL: Waters , aye ; Sutton, aye ; Wilson, aye; Craig, no ; Ander- son, no; SO MOVED. The Board asked that the water standby charges on the Tahoe Donner lots be checked and the printout be corrected. Director Sutton asked that the electric standby charges on Units 1, 2 and 3 at Prosser Lakeview Estates also be reviewed to make certain that a similar situation does not exist in that subdivision. F. P. C. OPINION #730 - RATE CASE The Board was presented with Opinion #730 from the Federal Power Commission staff regarding the Sierra Pacific Power Rate Case . A letter from Martin McDonough recommends that if the District wishes to object to this opinion, it should be done as soon as possible. Mr. Hobensack recommended that along with the objection to the F.P. C. Staff' s opinion, the District should also file suit against S .P.P. Co. for a possible price squeeze. Mr. Hobensack has been in contact by telephone with George Spiegel, an Attorney in Washington, D. C. , and he has given an estimated cost of $4 ,000 to file and show evidence of a price squeeze. The Board discussed whether George Spiegel or Martin McDonough should handle this matter. It was moved by Director Waters that the Board request Martin McDonough to go ahead with the filing of a rebuttal to Opinion 730 and to use his judgment in pursuing the price squeeze. Seconded by Director Sutton. ROLL CALL : Waters , aye; Sutton, aye; Wilson, aye; Anderson, aye ; Craig, aye; SO MOVED. Director Sutton asked the record to show and the communication to McDonough to indicate that the Board is uncertain and that is why Page One - July 23, 1975 22 o.,3 Rate Case . . . continued the Board is relying on his judgment in the matter of attaching the price squeeze to the rebuttal of Opinion 730 . The Board requested that Mr. McDonough be present at the next meeting to discuss the rate case.
