A physical examination will be required on all new employees by a competent Doctor. B. All employees working under hazardous conditions will be required to take a physical examination every three years. C. The Manager may demand a physical examination more often if, in his opinion, circumstances warrent a check up, D. Any costs incurred from a physical examination requested by the District, shall be paid by the District. ROLL CALL: Waters, present; Sutton, present; Craig, present; Christensen, present; Anderson, present; EMPLOYEES PRESENT: Hobensack, Reed and Connell . OTHERS PRESENT: See attached list of audience attendance at this meeting. MINUTES Director Christensen moved to approve minutes of November 11 , November 18, December 16, December 17, December 30, 1975, January 6 and January 12, 1976. Seconded by Director Waters. ROLL CALL: Waters , aye; Sutton, no; Craig, aye; Christensen, aye; Anderson, aye; SO MOVED. Director Sutton requested that the record show "that it is because I am dissatsified with the minutes in so far as their accuracy and the substance is concerned. " BILLS FOR BOARD APPROVAL Director Christensen moved to approve bills for Board approval . Seconded by Director Waters. ALL AYE BY VOICE VOTE. SO MOVED. WRSAD FUNDS REPORT District engineer Dan Cook indicated that this item should be tabled until further communication is received from bond counsel , Ed Ness. This matter was tabled to March 2, 1976. PRESENTATION OF DRAFT BUDGET The Manager indicated that the budget would be received by the Board members following one more meeting of the budget committee. Director Sutton asked that the record show "that the budget has been delayed since the budget committee was created in October not because the Board has not been ready to act on it or examine it but because it has not been prepared. " Director Waters added to that statement, "Also the fact that one of the members that was on the budget committee is no longer a member of the Board. " This matter was tabled to March 2, 1976. RELEASE OF REA FUNDS The Manager indicated that Darrell Pierce, REA engineer would be present to discuss this matter with the Board at the meeting of April 6, 1976. TDPUD-TTAD AIRPORT WELL AGREEMENT Don Strand from Dart Resorts read the letter to the Board on long term water source alternatives to Dart addressed to Mr. Rex Anderson, President of the Board, dated February 179 1976. A copy of that letter and its attachments is attached to these minutes for reference. A brief discussion of that letter and its attachments followed. Director Sutton moved that a special meeting be set within the next several weeks with this on the agenda and with Dart invited to make a presentation and with some evaluation by both the Manager and- the District engineer on the alternatives and some direction as to where we go from here. Director Sutton amended her motion to indicate that the special meeting would be held on Monday, March 1 , 1976, at 7:30 P.M. Seconded by Director Craig. ALL AYE BY VOICE VOTE. SO MOVED. Page 1 , February 17, 1976 Z JOB DESCRIPTION FOR MANAGEMENT EMPLOYEE This matter was tabled to the regular meeting of March 2, 1976. EMPLOYEE LIFE INSURANCE Following discussion with I BEW representative, John Stral 1 a, Director Sutton moved that the additional cost of the life insurance coverage, a total of less than $4.00 per month be paid in addition to what has previously been approved by the Board. ALL AYE BY VOICE VOTE. SO MOVED. EMPLOYEE SICK LEAVE ADJUSTMENT The Board discussed with John Stralla a problem regarding the sick leave adjustment of Joe Straub. The Board decided not to pay Joe Straub the disputed 2 days' sick leave he states he was allowed to accumulate. CABLE TV POWER CONNECTION ADDENDUM Following discussion Director Waters moved that the resolution entitled, "Amending the February 15, 1965 License Agreement Between the District and Tom's TV to Provide for the Payment of Cable TV Connection Charges" at the rate of $25.00 per connection point, be approved. Seconded by Director Christensen. ROLL CALL: Waters, aye; Sutton, aye; Craig, aye; Christensen, aye ; Anderson, aye; SO MOVED. RESOLUTION - CAL WESTERN LIFE, NEW INVESTMENT CONTRACT The Manager indicated that attorney Martin McDonough had not prepared this resolution as yet. The matter was tabled to the regular meeting of March 2, 1976. --MN R.W. BECK STUDY - POWER SUPPLY PURCHASE FROM PACIFIC GAS & ELECTRIC The Manager explained and commented favorably on R.W. Beck's study to purchase power from PG&E. A copy of that study is attached to these minutes. The Board discussed with the Manager this study also. Director Christensen moved that the Board approach Mr. Spiegel for a proposal on representing the District in Washington on obtaining power from PG&E. Director Sutton moved that the Board invite Martin McDonough to come to the Board meeting on March 2, 1976, and explain to the Board the District' s position in the rate case and what his plans are in the association of George Spiegel in the case and that the Board review the alternatives presented through this study (R.W. MISCELLANEOUS OLD BUSINESS ._._, Director Christensen revi ewed for the Board his visit with the Manager to the State Capitol and their attendance at the hearing for Assembly Bill 2573, the new bid law supported by the majority of the Board. He indicated that the bill as Mr. Chappi a had proposed was dropped until it was rewritten. Mr. Hob-ensack was to meet with Mr. Tom Willoughby on February 25th for further discussion on the proposed new bid law. Computer Loan: The Manager briefly indicated that a loan for the computer would need to be obtained at least 30 days from the time the computer arrived at the District office. Page 2, February 17, 1976 2,�5 I The Manager also indicated that the District had received a check in the amount of $19,187.84 from Dart to cover the cost of one employee (Dave Rully) for one year per Resolution 7526. The Manager asked the Board what account they wished the funds to be placed. Director Sutton indicated that she was of the belief that the accounting of the Tahoe Donner water system should be kept completely separate. The Manager asked for the authority to hire another bookkeeper. He received ,..._ no response from the Board. She requested a monthly report on the revenue and expenses on operating the system. The Manager indicated that additional reports requested by certain Board members increase the expenses of the District. Director Christensen moved that the funds received from Tahoe Donner should be placed in a general fund. Motion died for lack of second. Director Waters moved to have the funds received from Dart for Mr. Rul ly's s-al ary and fringe benefits placed in a trust account. Seconded by Director Sutton. The Manager indicated that Matt Gomez from Arthur Young & Company would be at the Distttct office in March and that he could discuss separate accounting of the Tahoe Donner system with Mr. Gomez at that time. The Manager again indicated that another employee would be necessary in the bookkeeping department. Director Craig moved that the District keep track of income and expenses of the Tahoe Donner water system. Seconded by Director Sutton. ROLL CALL:' Waters, aye; Sutton, aye; Craig, aye; Christensen, aye; Anderson, aye; SO MOVED. .—, Director Sutton asked that the record show "that the faithful performance bonds on all 11 units were still held by the county and are still being held by the county as a result of the temporary restraining order signed by Judge Wolters on February 2nd. There had been some doubt as to whether the faithful . performance bonds were in fact still there and the total amount of the bonds that are tied up by this temporary restraining order are something like $26,000,000.00. I didn't total what just related to this District, I guess it was abount $10,000 because there were some faithful performance bonds in the amount of 100% coverage plus the payment bond or labor and material bond which also is 100% and that would be about $10,000,000.CO and they: the 10% maintenance bords would be about $50,000.00. " Director Sutton questioned the procedure used on Resolution 7601 , the interim .rate increase adopted by the Board on January 69 1976. She asked how the retroactivity of the resolution to January 1 . 1976, affected the billing. She requested that Martin McDonough review the resolution and advise the Board of his findings. The Board discussed the problem arising out of the effective date of the interim rate increase as provided in that resolution. Director Sutton moved that the District refund customers for the 3 mil increase in the month of December. Motion died for lack of second. It was agreed that the Manager would report to the Board -at the March �--- 2nd meeting on the cost of refunding District customers for December usage billed at the new rate. VAN. WETTER WATER AGREEMENT Mr. Van Wetter was not present at this meeting. The matter was tabled until such time as the Manager contacted Mr. Van Wetter and determined his concerns. WES BENTLEY - LEASE PROPOSAL OF DISTRICT LAND Mr. Wes Bentley appeared before the Board and proposed leasing from the Page 3, February 17, 1976 2,L01 District a parcel of land owned by the District adjacent to the Tamarack Center across the street from the Safeway store. A copy of Mr. Bentley's lease proposal is attached to these minutes. The Board discussed the lease proposal with Mr. Bentley. It was agreed that- the matter would be tabled to the next regular Board meeting on March 2nd. In the meantime Mr. McDonough, interim District counsel would be provided a copy of the lease agreement -so that he would be prepared to comment on the matter on March 2. RICHARD WHEELER - SURPLUS LAND Richard Wheeler read for the Board his letter to John Craig dated January 28, 1976. A copy of that letter is attached to these minutes. The Board indicated to Mr. Wheeler that his proposal might possibly conflict with the proposal received from Sierra College. Following discussion with Mr. Wheeler it was agreed that Mr. Wheeler's proposal would be kept in a file for reference in the future in the event the District became interested in services such as Mr. Wheeler provides. OBTAINING NEW GENERAL COUNSEL FOR TDPUD It was agreed that a letter would be sent to all local attorneys indicating the Board's intent to obtain new District counsel . Interested attorneys would be interviewed by the Board at a special meeting set for March 8, 1976 at 7:30 P.M. MISCELLANEOUS NEW BUSINESS The Manager indicated that waterservi ceman Larry Drace had informed him that a man named Racich had applied for two new water services and had hooked up 12 new services , none of which meet District standards. It was agreed that the services must be paid for and meet District standards. -- Following discussion regarding the charge for copies made from the District copy machine Director Craig moved that in the interim the copy cost would be 10� per copy. Seconded by Director Christensen. ALL AYE BY VOICE VOTE. SO MOVED. Director Craig moved that the Board seriously consider joining the Northern California Power Association. Seconded by Director Christensen. ALL AYE BY VOICE VOTE. SO MOVED. The Board discussed the letter received from the Truckee Sanitary District dated February 10, 1976, regarding a joint water evaluation study with TSD. The Manager indicated he would follow through with the matter. Director Craig requested that an item related to Mr. Zion's letter dated January 26, 1976, regarding District reorganization be placed on the agenda. The matter was placed on the agenda for March 16, 1976. The Piresident adjourned the meeting to Executive Session at 12:10 A.M. The meeting reconvened i-nto regular session from executive session and the Chairman adjourned the meeting at 12:50 A.M. Licensee ' s use of said poles shall be confined to 7 supporting those cables , wires and appliances , together with associated messenger cables , guy wires , anchors and other appur - 8 tenances , all hereinafter called "equipment ," which Licensor has given Licensee written permission to install . Licensee may use 9 said equipment in a community antenna television system operating within the aforesaid areas to distribute television programs to 10 the homes and businesses of Licensee ' s subscribers within said areas . Licensee may make incidental use of said equipment for 11 distribution to its subscribers of FM music (studio-originated or off-the-air) or the occasional transmission of other television 12 signals for educational or enter rai nment purposes . Licensee ` shall use said equipment only for such community antenna televi- 13 sion and related incidental purposes . 14 2 .
