APRIL 6, 1976 The Board of Directors met in Executive Session at 7:00 P.M. prior to the regular meeting to discuss fee arrangement with Steven E. Grumer, Attorney at Law. The regular meeting of the Board of Directors was called to order by the Chairman at 7:35 P.M. ROLL CALL: Waters , present; Sutton, present; Craig, present; Christensen, present; Anderson, present; EMPLOYEES PRESENT: Hobensack, Reed, Drace and Connell . OTHERS PRESENT: See attached list of audience attendance. Director Christensen moved that the District retain Mr. Steven Grumer at $40.00 per hour of billable time, $50.00 per meeting for the first two hours after which the $40.00 per hour will be installed on a 6 month trial period. Seconded by Director Waters. ROLL CALL: Waters, aye; Sutton, no; Craig, no; Christensen, aye; Anderson, aye; SO MOVED. Director Sutton asked that the record show that "I do not wish to support Mr. Grumer as being hired as counsel for the District. " MINUTES Director Christensen moved that the Board approve all remaining minutes to date in Jane's original form allowing for only those corrections that are necessary such as the correction of misspelled words and the correction of wrong or misspelled names. There will be no conversation added from the tapes nor will they be made in any way verbatim, nor will there be any additions made. That from this day forward the minutes will contain only .•-. that information that is pertinent to the subject and will contain no conver- sation nor will they be made, in any way, verbatim allowing only for those corrections that are necessary such as misspelled words and wrong or mis- specl l ed names but allowing for a verbal "for the record" request from any Board membeerand statements from any member of the District's counsul ti ng firms or from the audience on a particular subject. Director Christensen asked that the record show that this motion was from the minutes of December 2, 1975. BILLS- FOR BOARD APPROVAL Director Christensen moved that the bills be approved. Seconded by Di rector Waters. ROLL CALL: Waters , aye; Sutton, aye; Craig, aye; Christensen, aye; Anderson, aye; SO MOVED. Director Waters asked that the Pacific Telephone bill for January be placed on the agenda for April 20, 1976. HYDRANT MAINTENANCE AGREEMENT Joe Copeland from the Truckee Fire District presented to the Board a brief prepared by him regarding the hydrant maintenance agreement between the Fire District and the TDPUD. A copy of that brief is attached to these minutes for reference. The Fire District requested that in the proposed agreement the TDPUD stock all parts and hydrants and the Fire District will supply all the labor for maintaining the hydrants. Director Sutton asked that the record show "that I have requested that these three items (damaged fire hydrants , usage of water from hydrants , and flushing of fire hydrants) be added to the proposed agreement." Page 1 , April 6, 1976 12- Z { Following discussion the matter was continued to the meeting of April 20, 1976. DONNER CREEK WELL #,2 William Nork with Hydro-Search Inc. reported to the Board on the pro- gress of the rehabilitation of the Donner Creek Well #2. He reported that the well is presently rated at an optimum of 1000 GPM based on normal operating conditions. DAVID KANTZ - REQUEST FOR WATER REBATE Director Christensen moved that the Board deny Mr. Kantz his request for a rebate on his water bill . Seconded by Director Waters. ROLL CALL: Waters , aye; Sutton, abstain, Craig, no; Christensen, aye ; Anderson, aye; SO MOVED. DRAFT BUDGET Director Sutton asked that the record show the following: Director Sutton asked, "Well , is a budget a waste of time?" Manager Hobensack replied, "I don't think it is necessary that an operation like this to have a budget. However, you want a budget and you have a budget that I think is a reasonable budget and I would, yes, say to the Board, adopt a budget. " Mana er Hobensack asked that the record show "that last year at this time you ?Director Sutton) said that the budget was a bunch of garbage. " Director Sutton asked that the record show, "On the basis of a $102,000.00 rebate from Sierra Pacific Power Co. , a transfer of $28,000 from standby funds from the general fund and a transfer of $19,000 paid by Tahoe Donner. " Director Christensen moved that the draft budget be adopted as written and that Mrs. Sutton will speak to the Manager about her questions regarding the budget. Seconded by Director Waters. ROLL CALL: Waters , aye; Sutton, no; Craig, aye; Christensen, aye; Anderson, aye; SO MOVED. Director Sutton asked that the record show "that my no vote is because of the questions I submitted only today have not had the opportunity to be answered. " A copy of the budget adopted by the Board is attached to these minutes for reference. RATE STUDY - PHASE II PROPOSALS Director Christensen moved that the Board accept R.W. Beck's electric proposal and Dan Cook's water proposal for Phase II of the rate study. Seconded by Director Waters. Director Sutton moved that the matter be tabled until later on the agenda until Dan Cook' s arrival at the meeting. Seconded by Director --f- Craig. MOTION CARRIED BY MAJORITY VOICE VOTE. INTERIM RATE INCREASE - REBATE . Director Christensen moved that the interim rate increase rebate for electric usage prior to January 1 , 1976, take place as soon as possible or as soon as the machine is programmed and as soon as convenient. Seconded by Director Waters. ROLL CALL: Waters , aye; Sutton, aye; Craig, no; Christensen, aye; Anderson, aye; SO MOVED. Page 2, April 6, 1976 12-1 JOB DESCRIPTION FOR MANAGEMENT EMPLOYEE Director Waters moved that the Board accept the job description and salary and benefits as proposed by the Manager with the exception that the salary range minimum be lowered to $14,000.00. Seconded by Director Craig. ROLL CALL: Waters , aye; Sutton, aye; Craig, aye; Christensen, no; Anderson, aye; SO MOVED. Director Craig moved that the screening committee as proposed (Dan Cook, Ken Merriman and a personnel officer from either Nevada or Placer County) submit 3 candidates to the Board for their considerations. Seconded by Director Christensen. ALL AYE BY VOICE VOTE. SO MOVED. EMPLOYEE LIFE INSURANCE Michael Connell appeared as shop steward because of a discrepancy between the amount John Stralla, Union representative, indicated employee life insurance would cost and the actual amount billed to the District. Following discussion Director Waters moved that the District pay the life insurance premiums. Seconded by Director Craig. ALL AYE BY VOICE VOTE. SO MOVED. RATE STUDY PHASE II PROPOSALS continued The Chairman indicated to Dan Cook that a motion had been made and seconded to accept R.W. Beck's electric proposal and Dan Cook' s water proposal for Phase II of the rate study, but that a vote on the motion had been deferred until Mr. Cook' s arrival and Board discussion with him on -h i s proposal . Dan Cook explained to the Board his proposal to conduct the water portion of Phase II of the rate study and the affect such a study would { have to the District. A copy of Mr. Cook's proposal is attached to these minutes for reference. (See page 2 for original motion) ROLL CALL: Waters , aye; Sutton, aye; Craig, aye; Christensen, aye; Anderson, aye; SO MOVED. MISCELLANEOUS OLD BUSINESS Director Sutton requested that a report be made at the next regular meeting on the meeting held on March 23, 1976, between the District and Sierra Pacific Power Co. Director Sutton asked about Dan-Cook's reply to the Nevada County Planning Department on the proposed plans for the-P.T. & T. Building in Truckee. Dan Cook commented. It was indicated that the matter would be placed on a future agenda when Board action was appropriate. DISCUSSION OF LETTER FROM DEPARTMENT OF REAL ESTATE REGARDING AVAILABILITY 0 WATER ATER IN THE TRUCKEE DONNER PUBL11C UTILITY DISTRICT The Board discussed the letter received from the Department of Real Estate dated March 10, 1976, a response to that letter from the District prepared by Dan Cook in draft form to be signed by the Board Chairman and a letter received from State Lands Division, James Trout, dated April 2, 1976. A copy of the letter from DRE and State Lands Division are attached to these minutes for reference. Director Craig moved that the Board invite Mr. Trout, Mr. Carlson and Mr. Rosenberger to Truckee on April 19, 1976, for a meeting with the PUD Board at 7:30 P.M. Seconded by Director Waters. SO MOVED BY MAJORITY VOICE VOTE. The Board reviewed the response to the DRE letter dated March 10, 1976, prepared by Dan Cook for the District. The draft letter was revised Page 3, Apri 1 6, 1976 I by the Board. A copy of the final revised letter is attached to these minutes for reference. Director Craig moved that the Chairman be authorized to sign 'the final copy of the letter to the DRE. ALL AYE BY VOICE VOTE. SO MOVED. MISCELLANEOUS MANAGER'S REPORT Director Waters moved that the Arthur Young bills of April 7, 1975 and April 21 1975 be paid and the bill of May 5, 1975 not be paid until the matter is finally settled. Seconded by Director Christensen. ROLL CALL: Waters , aye; Sutton, no; Craig, aye; Christensen, aye; Anderson, aye; SO MOVED. Director Christensen moved that the Manager be allowed to write a purchase order on the repair of the transformer. Seconded by Director Waters. ROLL CALL: Waters, aye; Sutton, aye; Craig, aye; Christensen, aye; Anderson, aye; SO MOVED. Director Waters moved that the Board authorize the employees to go ahead and accomplish the work on the new lunchroom in the warehouse in inclement weather even if it goes into next winter. Seconded by Director Craig. ALL AYE BY VOICE VOTE. SO MOVED. The Manager reported on the Nungester line extension. A copy of that report i.s attached to these minutes . The Manager requested that the Board members working at the District office leave the office by 5:00 P.M. The Manager asked the Board about connection fees charged to the Truckee Sanitary District. Following discussion Director Craig moved that the Sanitary District not be given a special rate. Motion died for lack of aQ,second. Director Sutton moved that the Manager review the problem and recommend whether or not a special category be created in connection fees for 1/10 service for temporary use. Seconded by Director Christensen. MOTION CARRIED BY MAJORITY VOICE VOTE. The Manager indicated that the Telephone Company is willing to pay for the underground for the transformer to the new telephone building in Truckee. However, they feel the District should provide the transformer. The majority of the Board agreed that the Telephone Company should pay for the transformer. This will require the following list of documents : 1. The Rural Electrification Administration agreement in its total and as it may relate to the water system to the Truckee Donner P.U.D. 2. The Lakeworld Inc. and the Truckee Donner P.U.D. Agreement of 1970. 3. The Tahoe Donner Supplemental Agreement of 1973 as it relates to the water system and the administrative procedures of Truckee Donner P.U.D. 4. A review of the policy matters concerning the West River Street Assessment District. 5. The Van Whitter line extension agreement. 6. All relevant trust fund implications and agreements. 7. The subdivision agreement for each of the subdivisions within the Truckee Donner P.U.D. S. The Placer County C . S .A . 19 operational agreement. 9 . However, the letter is addressed to the contractual conditions that are presented in the Supplemental Agreement between the Truckee Donner Public Utility District and Dart Resorts as to when additional sources will be required. The North Side Well is presently producing approximately 590 gallons per minute . The anticipated demand this summer for the Tahoe Donner Subdivision alone is expected to be 810 GPM. The District is completing their renovation of the Donner Creek Well No. 2 allowing for the removal, repair and reinstallation of the North Side Pump . A . Acquisition of the Airport Well and the- cost? B. The yield of the Airport Well? C. Will the 1. 6 million dollars cover the cost of the Airport alternative? D. Can the District serve its present commitments? E . How does the District propose to finance additional facilities? A . The cost estimates contained in the alternate studies that Dart presented to this Board March 1, 1976 contained the following costs associated with the Airport Well acquisition . Purchase of Airport Well $2-1509 000 Pump Inventory 1.3 ,450 Pump Revision 399000 Airport Line Work 649740 Water for Airport Use 6109000 Total cost of Airport Well acquisition per 3-1-•76 estimate of Dart $427 , 190. B. The yield of the Airport Well is, in excess of 3000 GPM, possibly as high as 4000 GPM. The present pump is capable of delivering 2000 GPM into the Airport fire suppression system. C. Please see response A to your paragraph 4 above. Our Engineer estimates the cost of the Airport alternative, as refined by him, to be $1, 350,000 including acquisition cost. D. We feel that the District can meet the commitments that have been made in the past. As noted above , the anticipated consumptive demand of 1984 is now connected to the system . There are , however, physical restrictions and operational difficulties within the system. We will review carefully the above outlined operational study to be prepared by Cook Associates . This Board intends to pursue the recommendation as to ways and means for the upgrading of the District ' s total operation . The Truckee Donner Public Utility District is currently ahead of the demand curve and it is the intention of this Board to remain ahead of the demand curve in the future . Sources of money available to the Truckee Donner Public Utility District for future system expansion , modification, upgrading and replacement include the following : 1. Donation of plant, i. e. , wells , pumps , tanks , piplines and appurtenances . 2 . One time connection charges for new services. 3 . One time- source and storage charges for new services. 4 . Special Improvement Districts within the P. U.D. 5 . Depreciation and sinking funds . 6 . Special assessment District within the P.U.D . 7. Revenue bonds . 8 . General obligation bonds . 9 . Federal revenue sharing monies . 10. Department of Housing and Urban Development block grants . 11. Department of Agriculture basic water grants . 12 . Department of Agriculture long term loans . 13 . State of California , Davis-Grunsky long terms loans. 14 . -Assessment of a property tax . 15 . Adjustment of the water rates . ,,Oak The operational study outline above will focus on the physical problems , 4 identify the dollar value and fix the time frame of the water system modification to meet the increasing demand . The Board will select one or more of financing methods that best fit the requirements of the Truckee Donner Public Utility District. 1 (6 ) The District is currently relying on Dr. Sharp 's reports of Feb- ruary 14 , 1975 , November 20 , 1975 , February 11, 1976 , and his letters and presentations to the Board of Directors . We can find no reason to doubt Dr. Sharp 's conclusions as expressed :in the above documents and presentations . However, if you have evidence to the contrary, please share it with the District. Large sums of money will be expended based on Dr. Sharp 's data and if you feel that such expendi- ture would be wasted , the District should know about it now. ( 7) Our Engineer has made several suggestions as to the way the cost of operation and maintenance of the Tahoe Donner Water System can be paid as they directly benefit the area . The Engineer's suggestion in essence , is to isolate the extraordinary cost of the Town System to the Town and to isolate the extraordinary cost of the Tahoe Donner State of California Department of Real Estate Sacramento , California 95814 April 7 , 1976 Page 7 portion of the Truckee Donner P. U.D. system to the Tahoe Donner sub service area . The Board directed the attorney to look into the procedural aspect of complying with the Engineer's suggestion , which has been done. This item is one of many that the Board has taken under advisement with respect to the Tahoe Donner sub service area . We will keep you advised as our deliberations proceed. ( 8 ) The District has requested an 180 day extension on Final E . I .R . and Donner Lake Water Rights Hearing , and an extension has been granted to the 20th of May. A Public Meeting has been proposed for 7: 30 P .M . , April 19 , 1976 with the State Land 's Commission Staff, The Department of Water Resources Staff and Dart here in our offices . You are invited and Mr. Hobensack will be in contact with you to confirm the attendance of all parties .
