The Special Meeting of the Board of Directors was called to order by
the Chairman at 7:30 P.M.
ROLL CALL: Waters , present; Sutton, present; Craig, resent; Christensen,
present; Anderson, present;

PREPARATION OF FINAL ENVIRONMENTAL IMPACT REPORT; APPLICATION TO LEASE STATE
LAND AND DIVERT WATER FROM DONNER LAKE, SCH #7408202
Mr. James Trout, State lands Division, appeared before the Board
regarding the District's request for another 180 day extension on the
application to lease state land and divert water fro Donner Lake. He
indicated that the recommendation of State Lands is that there seems to be
little value in continuing to keep the application open. He also indicated
that State Lands would like to be assured that conti ued work on the project
will result in public good.
Director Sutton asked that the record show "that I have inquired why
Mr. McDonough is not here and why Mr. Cook is not here and I would like
the record also to show the answer which was nobodyknows."
Richard Carlson, Department of Real Estate, reac to the District a
statement regarding the water supply problems in the Truckee-Donner Public
Utility District. A copy of that statement is attached to these minutes
for reference.
Richard Rosenberger, State Water Resources Control Board, discussed
with the Board his agency's stand on the matter of the application to
lease state land in the form of a summarization of��e ents leading up to
the present time. He indicated that the State Water Resources Control
Board has reviewed the draft EIS and has submitted their comments. As
soon as the final EIS is completed the SWRCB will analyze that statement
and will take necessary steps to proceed with a hearing on the District's
application. He stated that the extension is up to the State Lands
Division.
Sid Karsh, President of Dart Resorts , read to the Board a letter
dated April 19, 1976, regarding preparation of Final Environmental Impact
Report and the application to lease State land and divert water from
Donner Lake. A copy of that letter is attached to t ese minutes for
reference.
John DeHorn, chei f engineer with Cranmer Engine ring, Dart's engineer,
explained briefly to the Board Dart' s alternative solutions to the water
problem, Plans A through H. A copy of those al terna i ve plans are attached
to the minutes of March 1 , 1976.
Dr. John Sharp, Hydro-Search, Inc. , Dart's hydrologist, reviewed ground
water sources available to Dart including present sources and those being
studied at present and the zones of favorability. He indicated that he has
recommended to Dart that they confirm Hydro-Search's intimations and drill
r-- exploration holes at several sites from which additional specific sub-surface
information can be obtained permitting them to make a more accurate
projection of the quantity of water that might be obtained.
Dan Cook explained the District's position on serving water to Tahoe
Donner and other subdivisions within the District. e indicated that at
the present time the District has connected to its system water that
meets the consumptive demand on a projected basis until 1984 for all of the
subse rvice areas.
Following Mr. Cook' s statement Director Craig commented on Sid Karsh's
letter to Mr. Trout, a copy of which is attached to 'these minutes.

Following discussion between the parties involved, James Trout
suggested a 90 day extension after which time a progress report would
be prepared and submitted to State Lands Division on Dart's exploration
for ground water. Mr. Trout also requested that the District respond
to his letter of April 2, 1976.
Director Christensen moved that the District reapply for a 90 day
extension on the application to lease state lands and divert water from
Donner Lake.
Director Sutton moved that the matter be tabled to the meeting of
May 4, 1976. Seconded by Director Craig,

A review of some important information was included in Dan Cook' s
statement at this meeting. The draft minutes states simply:
"Dan Cook explained the District' s position on serving water to
TD and other subdivisions within the District. He indicated that at
the present time the District has connected o its system water that
meets the consumptive demand on a projected basis until 1984 for all
of the subservice areas ."
It seems that a more detailed account of "the District' s position
in the Minutes of this meeting would' be valuable for the District,
the Board, and the public . Therefore, I askthat the Minutes include
a recap of his statement so his comments become part of the record
of this meeting.

Mr. Cook said that the Dart-TDPUD agreementi, specifies 4,000 gpm
total supply and provide* multiple pumps at the intake which was
anticipated to be Donner Lake. He said that the Board is on record
that in the event Donner Lake is not utilized the multiple source
or multiple facility will be maintained.
Mr. Cook said that the Board is also on record that the Northside
Well can be rated at 1500 gpm. He said that by implication.)if not
official action the Board' s policy is that the additional 2500 gpm
k must come from other Sources rather than upgrading of the rating of
the Northside Well. He said that the desire situation would be
three equal sources totalling 4000 gpm available to the District to
supply water to Tahoe Donner, as is the case with the booster stations
where there are multiple pumps in case of failure.
Mr. Cook said that the Board is also on record as requiring that
the sources of water, other than Donner Lakelbe pump-tested, be
measured, be rated, be visible for all to see. He said that the
sources need not be connected to the system in the total 4000 gpm
because the District Could not afford to operate it in thair manner,
so the requirement is that the sources be available to the District."

He said that the present consumptive lead in the District is somewhat
in excess of 6500 gpm, and that the Board ha's taken steps to define
the problems that exist in the total service area and resolve any
problems that may be found.
Mr. Cook said that the Board asked for the 180 day extension so
that ground water exploration would be conducted, and so determination
could be made on whether any of the alternatives other than ''Plane"
are a possibility. He aaid that he believed, that the public interest
can be best served by the 180 day extension to allow time for this
exploration and to allow for the results to �be included in the
decision-making process of the Board, the State Lands Commission and
the DRE."

If one or both sites are deemed unfavorable, several alternate sites are
available. These would be explored by pilot holes and if favorable, wells
would be constructed. _
Northside Well has been rated (interim) by us as being capable of providing
a long-term continuous yield of minimum 1500 gpm. Our on-going investi-
gations of this well under production use will continue into this summer
and we feel that a final rating in excess of 1500 gpm is quite possible.
It is our opinion that a combination of Northside Well and newly constructed
wells at the proposed sites has an extremely high probability of meeting the
required 4,000 gpm peak demand for Tahoe Donner.
In the event that this high probability is not realized, backup is provided
by the optioning by Dart of the Airport Well as discussed in Mr. Cook's
letter.
It is our opinion that the well exploration-construction program embarked
upon by Dart will provide within the 180-day period definitive results on
the availability of ground water as an alternative for Donner Lake water.

or proposed improvements reflected in the subdivision offering
(including storm sewers, sanitary sewers, water systems, roads,
utilities, community facilities, recreational amenities) will be
adequate to serve the projected population of the entire land
project. - -
Once a Public Report is issued, a material change in the
s-
offering can constitute grounds for issuing a Desist and Refrain
Order stopping further sales.
We rely heavily on "will serve" letters from public utility
districts and similar entities for evidence that water, sewer and
other services will be available, since we do not have qualified
personnel to investigate and evaluate each district' s capabilities.'
As early as 1973, we became aware of water supply problems
within the Truckee-Donner Public Utility District and the Tahoe
Donner Subdivisions. By agreement with the Department, Dart-
Industries stopped sales. Further water studies were conducted and
Dart entered into a supplementary Agreement with the District. We
also consulted with Dan Cook. From the documentation and evidence
presented, we reached the conclusion that the water supply problem
was resolved.
In the past six months, we began receiving comments which caused
us to question the Districts ability to serve. As a result, a letter
was addressed to the Board on March 10, 1976. We are now in receipt
of the Board' s reply. We have not reached a conclusion but we must
consider other subdivisions within the District as well as Tahoe
Donner.
We were pleased to learn that the District will not issue any
more "will serve" letters until studies to be undertaken by the
Board show that there is an adequate supply of water and adequate
methods to finance delivery.
