ROLL CALL: Waters, present; Sutton, absent; Craig, present; Chri stensen, present; Anderson, present; EMPLOYEES PRESENT: Hobensack and Reed OTHERS PRESENT: Steven E. Grumer, Robert Sutton and Kathie Hoxie. PENDING RECALL ACTION OF DIRECTORS PATRICIA SUTTON AND JOHN CRAIG The Chairman indicated that the Board is in receipt of a letter from Mrs. Sutton.. - , Director Waters moved that the Board take no action on Item #2 until the general meeting of Tuesday, June 15. Motion died for lack of second. The Board discussed Mrs. Sutton's letter, a copy of which is attached to these minutes , with Mr. Grumer. Mr. Grumer concluded that notice of the meeting appears to be sufficient and that by her own admission Director Sutton received sufficient notice of the meeting. Mr. Grumer stated that pursuant to Elections Code Secti on23625 once the Clerk's Certificate to Recall Petition is received the Board has no choice but to call a recall election. The election must be held not less than 80 days nor more than 125 days after ordering said election unless a Notice of Intent to Circulate a Petition to Cancel the REcal 1 Election is filed. Director Waters moved that an election be ordered pursuant to Article 2, Chapter 2, Uniform District Election Law, Division 12, Part 3, of the California Elections Code and District Counsel recommendation. Seconded by Director Christensen. ROLL CALL: Waters , aye Sutton, absent; Craig, abstain; Christensen , aye; Anderson, aye; SO MOVED. The Manager requested that Counsel keep him informed as to the necessary steps which must be taken by him as Secretary of the Board. At this time Director John Craig personally served Directors Waters , Ghristeasen and Anderson and the secretary of the District a "Notice of Intention to Circulate Petition Seeking a REcall Election. " A copy of that notice is attached to these minutes for reference. The Chairman adjourned the meeting to Executive Session at 6:00 P.M. to discuss the 1976 Union Contract Negotiations. 1976 UNION CONTRACT NEGOTIATIONS - EXECUTIVE SESSION At 6:15 P.M. the Chairman called the meeting from Executive Session back into regular session. Director Christensen moved that the Board form a committee made up of the Manager, District Counsel and Director Waters. Seconded by Director Craig. ALL AYE BY VOICE VOTE. I have not waived written notice of meetings at least 24 hours in. advance . When I arrived at the office yesterday afternoon sometime before L p.m. , I removed the available materials from my file folder. Included among these materials was a meeting-notice for June 10 and June 15. I reminded Jane at this time that I still expect to receive meeting notice-agendas by mail. About 4;30 P.m. Jane came into the Board Room where I was doing some research and asked if I rad picked up stuff from my file , which of course she knew I had, uhe then informed me that I had made a mistake and had picked up stuff from Director Watert' file insteadof mine . I told her that I was certain I had not taken the materials out of the wrong file , but at her insistence , I made the switch of materials . .When I got home later and went through the materials about LJ 6 P.r.' I discovered that I had not been Fiven an agenda/meeting_ notice for the June 10 and June 15 meetings after all. I wa.s unsuccessful in my attempt to reach you at home so I placed a call to Rex Anderson as the Board Chairman to officially notify him that I had not been given notice of the June 10 S-oecial Meeting. The District had the contractual right 'm%' to a completed system. Construction deficiencies affecting the life of the system mean a $1 rail li on liability to the District * At the same time they waived �,60, 000 in Tahoe-Donner hook-up fees , and later ignored Pleas to submit the matter to a public vote 2)These three directors Persist in their desire to draw water from Donner lake after the People of the District have exrressed a strong desire to use other sources (which are available) . 3) The three directors perpetuate ineffective management by retaining a manager who is unprer.,ared for and cannot answer the Board' s financial or technical questions . �} The District' s finances are handled haphazardly; two examples being late billings and no budget for car.,ital improvements or major repairs Utilities are becoming a major expense in our lives . Quality service is possible in Truckee at rates com-j�ara_ble to other utilities , to keep, this expense ender control we need board members who can develop_ informed, intelligent solutions to our problems .Anderson, W aters ,and Christensen not only lack solutions , they are a costly burden to our district .
