DECEMBER 21 , 1976 The regular meeting of the Board of Directors was called to order by the Chairman at 7:30 P.M. ROLL CALL:.. Waters , present; Sutton, present; Craig, present; Christensen, present; Anderson, present; EMPLOYEES PRESENT: Morey and Reed. OTHERS PRESENT: See attached list of audience attendance. BILLS FOR BOARD APPROVAL Director Christensen moved that the bills be paid. Seconded by Director Waters. ALL AYE BY VOICE 'DOTE. SO ORDERED. HILLTOP LODGE - FREDERICK KOHLER Mr. Kohler was unable to attend this meeting. The matter was placed on the January 4 agenda. WES BENTLEY - PROPOSED GRANT DEED Mr. Bentley appeared before the Board regarding the title to a small strip of land. A copy of the description of this land is attached to these minutes. Following discussion of the apparent dispute over title to this piece of land, Director Christensen moved that the District quitclaim this piece of property to Mr. Bentley. The Chairman gave the chair to the Vice-President and seconded the motion. ROLL CALL: Waters, abstain; Sutton, no; Christensen, aye; Anderson, aye; Craig, no; MOTION FAILED. �.. Director Sutton moved that this matter be referred to counsel and Manager for review and recommendation to the Board at the next regular meeting. MOTION DIED FOR LACK OF SECOND. Director Craig .moved that a Special Meeting be held on Monday, December 27, at 5:00 P.M. for the purpose of discussing the WestBentley property. Seconded by Director Christensen. ALL AYE BY VOICE VOTE. SO ORDERED. QUINTANA WATER SERVICE ON WEST RIVER STREET and SOMA SIERRA PUMP STATION Director Sutton moved that these two items be tabled until the second regular meeting in January. Seconded by Director Craig. MISCELLANEOUS OLD BUSINESS Daven Morey indicated that Dan Cook wished to discuss with the Board the following miscellaneous items at the next meeting he attends: 1 . Sales Office Well 2. Joint Project with PT&T on Highway 267 3. Deerfield. Line Don Strand, project manager at Tahoe Donner, appeared before the Board regarding certain deeds between Dart and the District which have not been recorded. The Manager was requested to determine if the deeds had been accepted by resolution and report back to the Board. Director Craig moved that Mr. Cook's letters of December 21 , 1976, regarding Soma Sierra Pump Station and meter installation at Donner Trails tank be forwarded to Mr. Strand. Seconded by Director Christensen. ALL AYE BY VOICE VOTE. SO ORDERED. A copy of those letters are attached to these minutes. Page 1 , December 21 , 1976 7 NEW BUSINESS Mrs. Sutton inquired regarding Mr. Quintana's variance application. It was agreed that the Manager would communicate with the Planning Department on this matter and convey the District's stand. Mrs. Sutton asked that the record show "that the Manager has been directed by consensus of the Board to communicate with the Planning Department tomorrow by phone with a fol l owup letter . . . . . " DISTRICT COUNSEL REPORT District Counsel Steven Grumer requested that all five items be tabled to the next regular meeting. Mr. Grumer reported to the Board on the fol i oiwng items: 1 . Donner Pines Easement - easements are being prepared by Donner Pines. 2. Union Contract - Union representative John Stral l a has not yet prepared the new contract for the District. Director Christensen moved that Mr. Grumer contact 1BEW attorney for the purpose of ratifying the new Union contract. Seconded by Director Waters. ALL AYE BY VOICE VOTE. SO ORDERED. 3. 7-11 Water Matter - This matter was discussed briefly. No action was taken. 4. Van Wetter Water AGreement - Mr. Grumer indicated that he had received no response from Mr. Van Wetter. Following discussion Director Craig moved that Mr. Grumer file an action to secure the money. Seconded :by Director Christensen. ROLL CALL: Waters, aye; Sutton, no- Craig, aye; Christensen, aye; Anderson, aye; SO ORDERED. 5. Mr. Grumer reported to the Board that the recall election is set and will be held as scheduled. 6. Mr. Grumer asked that the Board consider changing the meeting day to the first and third Monday. This matter was placed on the January 4 agenda for further discussion. It was agreed that the Resolution regarding Transfer Within Trust Accounts would be acted upon at the Special meeting scheduled for December 27, 1976. MANAGER'S REPORT Interim Manager Daven Morey stated that Mr. Hobensack had authorized the bookkeeper to take the REA Accounting Course. The Manager reported that progress was being made on the preparation of the preliminary budget. A deadline of the first of February was agreed upon with the Manager reporting at the January meetings on further progress. Director Christensen moved to adjourn the meeting into executive session. Seconded by Director Waters. ALL AYE BY VOICE VOTE. SO ORDERED. The meeting was adjourned to executive session at 9:20 P.M. First sentence on Page 2, ADD a phrase for future reference so that the sentence reads: "Don Strand, project manager at Tahoe Donner, appeared before the Board regarding certain deeds between Dart and the District for the water s sy tem which have not been recorded." 2. Under New Business , revise the wording for clarity: Strike out "the District's stand" and Substitute an explanation of what the District's stand i s, so that the end of the first sentence under this item reads: "and convey that there is no water service to that property and that Mr. Quintana must make an arrangement with the District for water. " 3. Under District Counsel Report, under #3 perhaps, Mr. Grumer informed the Loard that efforts are being made to collect unpaid connection charges by individuals who have received service, and it sounds like that Daven indicated that there are fifty involved. It may be useful at some future time for there to be some notation in the Minutes that some brief information reached the Board at this meeting about this problem. Add, under #3 7-11 Water Matter: "Mr. Grumer indicated that efforts are being made to collect a number of unpaid connection charges owed by individuals, and that he is helping to revise the procedures and forms. Submitted by -AT S TTGN Director RECEIVED JAN TRUCKEE DONNER P.U.D. �y t � 12/21/76 i OLD BUSINESS � ITEM 3 CA 76340 STATUS REPORT QUINTANA WATER SERVICE - YATES BODY SHOP WEST RIVER STREET i i , This will take the form of a status report as it would seem to me- to be an inappropriate time to take a definitive action rectifying the problem and violation that now exists. Within the week we should know whether or not your application for a grant under the Local Public Works program has been accepted or rejected. If the grant application has been accepted the problem of the Quintana-Yates water service will fall into place and no unpleasantness will be encountered on anyones part in resolving this issue to the benefit of all parties. You will recall that the grant application will provide 100fo financing for the construction of the major transmission main that will pass in fr ont of the county barn and Yates Body Shop. Service will be provided directly to Quintana if the subject line is constructed. Fire service will be provided to the county from the same line. In the event that the application is denied another set of circumstances will confront the Board, however, the decision making body will not be the Board of Directors of the Truckee Donner Public Utility District. You will recall the flow diagram of the . 9 roundwater exploration of the Truckee region as prepared in June of this year provided several alternative methods for Dart to satisfy their total contractual commitment for multiple source yielding 4000 GPM. We are approaching the first decision point at this time. The test pumping of the sales office well is now underway and the results will be noted shortly. In the event of a failure or limited production of the sales office well alternate methods were provided to satisfy the total commitment. One such alternate method was the construction of the transmission e main intertying the airport well with the Truckee Donner Public Utility District system. Should that intertie take place water service will be made available directly to Quintana-Yates. Fire flow would also be made available to the county barn if Dart selects that alternative in satisfying their commitment to the P.U .D. Inasmuch as the results on the possible funding by other sources to the P. U.D . will be in hand within the next 30 days it seems appropriate to me that this item be accepted as an informational item on tonights agenda and placed on a subsequent agenda for action when the necessary information is available to the Directors so that a decision can properly be made. r OLD BUSINESS 12/21/76 ITEM 4 CA 7634c STATUS REPORT SIERRA PUMP STATION There have been conflicting reports about the pumping capacity of the Soma Sierra Pump Station from the District ' s operational people. The first was reported by way of the Hydro-Search letter indicating that the Soma Sierra. Pump Station cculd not handle the Northside Well test. in October. I reported this apparent problem at your mid-October meeting. I reported at your mid-November meeting that Larry Druce had informed our office in response to direct questioning : A. There was no excess water from the Northside Well B. No water was spilled to Donner Creek C . Soma Sierra pump station handled the pump test flow without a problem D. The Soma Sierra pumps had to be turned off for a period of time becauEe they were getting ahead of the flow from Northside. E. The Tahoe Donner Service area actually ran short Obviously a problem Exists and there appears to be a direct conflict on the face of the information presented. However, each statement is mostly correct. Lets discuss each problem separately. Soma Sierra Pump Station cted a functional pump test on each pump, 2 pumps I personally condu in parallel and all pumps running together with the following results : Pump Cook Test Acceptance Test Concept Design No. Data Data Data 1 260 GPM 286 GPM 300 GPM 2 200 GPM 264 GPM 300 GPM 3 260 GPM 271 GPM 300 GPM t k Accertance Test Concept Design Pump Cook Test No, Data Data Data 1 & 3 480 GPM - - 2 & 3 460 GPM - - 1 & 2 455 GPM - - 1,2 & 3 600 GPM - 800 GPM } Conclusion : As the Soma Sierra Station now exists, the pumping rate is 88% of the tested capacity prior to the pumps being removed to fix the vibration problem. Pump No. 2 is pumping only 66% of the conceptual value. Dart should, be put on notice to fix the problem under the terms of the warranty. Copy attached. . f Question : During the three day test period the Northside Wall a pumped a total of 3,421, 000 gallons in , the direction of Donner Trails tanks. However it would appear that Donner -Trails pumped only 1, 545, 600 (as best we can figure out ) . Working backwards, subtracting McGlashen Springs from Soma Sierra possibly 1, 909, 500 gallons were pumped from Donner Trails (if the power meter is bad ) . At any rate, approximately 1, 100, 000 gallons of water were lost between the Northside Well meter and the Donner Trails Tanks (about 250 GPM) . Recall Larry Druce ' s statement "B" above. Problems that have surfaces as a result of the Northside Well test include : 1. The Deerfield main has been partially repaired as a stop-gap effort - estimated losses temporarily stopped. 100-200 GPM - total replacement is required, { 2. The pumping rate of Soma Sierra is deficient. 3 . The meter at Donner Trails is inoperative and has been for several months. 4. Some of the water meters to the golf course have been inoperative all summer. (How did we bill Dart? ) 5. The Truckee Donner P . U.D. distribution system losses are unknown and are substantial. The need for production meters is underscored by the loss of 1/3 of the total Northside Well pumped volume. 6. The power meter and the water meter for Wells A & B have been inoperative for an extended period of time. 7. The records of the water division are grossly inadequate . B. Communication between maintenance, supervision and the billing 3 • department is inadequate. Recommendations : Set up a record system that has inter-department feedback and expand the data collection started December 1, 1976. Conduct periodic emRloyee motivation meetings stressing the importance of maintenance, records and coordinated billing. a a s i g 3 a 1 r a i 1 e 1 S 3 i i t 9 i i i 3 1 3 e NEW BUSINESS 12/21/76 FOR CONSIDERATION AT TONIGHTS CA 76346 MEETING UNDER THE MISCELLANEOUS CATEGORY 1. SALES OFFICE TEST PUMPING The test pumping of the sales office well was commenced December 20, 1976. For the next two or three days the test pumping will be to waste into the Sanitary District t s facilities. Some time after the Christmas holidays the actual development pump testing will commence. At this point Hydro-Search is in the process of revising and expanding the pump test schedule. The pump testing is a significant item both in terms of the actual delivery rate of the constructed well together with the anticipated recharge area servicing the Donner Creek Well No . 2 and related areas. We will be monitoring the development testing carefully and provide you from time to time with memos describing the information being developed. { 2. REPLACEMENT OF DEERFIELD PIPELINE During the course of trying to resolve the apparent discrepancies involved with the Northside Well test as indicated above in your agenda - tonight, the leakage within the Deerfield pipeline became really apparent. I suspect that this line represents a high percentage of the total loss within the Gateway, Meadow Park, Deerfield, Donner Trails area. Most of the leaks in the Deerfield line are found in the meadow area where it would appear that there is a very high degree of electrolysis taking place. This particular line was included in the local public works application as a replacement and was rated very high on the list of items of work presented to you in your water system analysis. Replacement work will be required in this area during the next construction season. The repairs that are being attempted at this- time will in the end result, be inaffective,however, I have insisted that they be under- taken at this time in order to hopefully eliminate or reduce the losses of up to 250 GPM for the entire winter season. The line in question is about 15 years in age and should have a useful life -` greater than that which it has experienced. The failure of the Deerfield line points out two considerations which I have been attempting to bring to the Board ' s attention. A . A depreciation allowance must be set up for your water system so as to alleviate the budgetary stress conditions that are going to result in the 1977 budget for replacement of this line. B. The need for reasonable record keeping so that the anticipation of major repairs can be properly noted. The development of a five year plan of capital expenditure and major replacement will also relieve the unexpected budgetary demands such as will be experienced in your 1977 budget 3 . BUDGET I noticed under the Manager' s report a request for some budget preparation schedules. Hopefully you will accept our recommenda- tion to form a committee to develop your five year plan and incorporate the results of that committee effort into your forth- coming budget. 4 . YOUR LOCAL PUBLIC WORKS APPLICATIONS TheN\rumor mill that we listen to indicates that Congressman Johnson will be making an announcement this week as to which of the projects within his Congressional Districts have been approved for 100f grant funding. At this point we are still optimistic that your Application A will recieve approval. In recent discussions with the Airport Management, they are keenly interested in the intertie and the District acquiring the Airport Well. Recent tests of the Airport fire protection system have reinforced the District' s desire to integrate the airport system into the community water supply. 5. AUTHORIZATION TO PROVIDE NOTICE OF DEFICIENCIES TO DART I would like authorization from the Board to issue the two attached notices of deficiency so that Dart may accomplish the repairs immediately. I have personally conducted pump tests on this facility and find that the individual pumping rates range from 80J to 66% of- the pump .test data that was obtained by Cranmer Engineers. December 24 , 1-974 and subsequently revised with the assistance of Byron Jackson. Pump No . 2 is the most deficient of the three. The pumps in question have been removed and reinstalled repeatedly during the course of elimination of vibration and other operational deficiencies . On December ls-t -of this year the District began keeping records of daily performance on the Soma Sierra Pump Station . Those records indicate that for the first 20 days of this month the average pumping rate was something in the order of 250 GPM. The conceptual design for this station was pegged at 300 GPM nominal and the pump tests ,conducted in December 1974 yielded 286 GPM actual delivery. In essence , the short term test that I conducted and the average yield for the first 20 days of this month both indicate a major deficiency exists . Your early attention and correction of this deficiency would be appreciated. Under the terms of your warranty agreement, would you please see that this meter is repaired and made operative at the earliest opportunity. U.D. tens of thousands o however, f dollars to defend, The "adversary" is the proported class and/or their attorney. y The cross-complaint is defective in the following areas as they First Cause of Action - Indemnity Paragraph 1: The P.U.D. did not annex the Tahoe Donner area. The Tahoe Donner Area has always been within the boundary of the P.U .D. . Paragraph 4 : Dart has not "fully performed its obligation" and in fact Dart has an on goingobligation to� provide additional water supply sources as required to satisfy the two year projections on demand of the P.U.D. f Dart must provide 4000 GPM in 3 or more sources . This obligation for water source is the underlying cause of action the obligation is Darts and Darts alone, Paragraph 5 : The P. U.D. and Dart are jointly to "do ever thin y 9 possible" to obtain Donner Lake water Donner Lake is -no longer considered a viable alternative by Dart or the P. U .D . The 1973 agreement reserves the decision making to Dart, a fact that they have asserted on several occasions. Dart 's reservation in the decision making also saddles them with the "obligation" of paragraph 4. Paragraph 6, 7 & 8 : Any one who desires to hook up to the water system can and no one has been denied service. The D & R relates to sewer service, not water and I understand the D & R is to be lifted shortly, Second Cause of Action - Declaration of Rights Dart has contended that I have misinterpreted the agreement starting in 1971. The judicial declaration of responsibilities will -be beneficial to all, however, as written Dart wants only the P. U .D. ' s obligations defined which seems sort of one-way. For my part I think it would be best to consolidate all related court actions into one action.
