NOVEMBER 14, 1974
The special meeting of the Board of Directors of the Truckee-Donner
Public Utility District was called to order by President Waters at
4 : 30 p.m. in the conference room of the District.
ROLL CALL: Craig, present ; Sutton, present; Anderson, absent ;
Waters , present.
EMPLOYEES PRESENT: Hobensack, Kinzie
OTHERS PRESENT: Attorney Joe Joynt
RESOLUTION 7432 - WAIVING APPOINTMENT TO BOARD VACANCY
Mr. Joynt prepared a resolution waiving the appointment and time for
appointment provisions of Section 1780 of the Government Code, request-
ing the Board of Supervisors of the County of Nevada to do the same ,
and calling for a special election to fill vacancy on Board of
Directors. Mr. Joynt has contacted the County Clerk' s office request-
ing an estimate of the cost of a special election which was quoted as
approximately $1 , 500 . The next scheduled election is March 5 , 1975 .
It was mentioned that possibly 120 days are needed to call for a
special election.
It was moved by Director Craig and seconded by Director Sutton that
Resolution 7432 be adopted. ROLL CALL : Craig, aye ; Sutton, aye ;
Waters , aye ; Anderson, absent. So moved.
There being no further business to come before the Board, it was
moved by Director Craig and seconded by Director Sutton that the
special meeting be adjourned. All aye. The meeting adjourned at
approximately 4 : 45 p.m.

RESOLUTION NO. 7432
of
TRUCKEE-DONNER PUBLIC UTILITY DISTRICT
WAIVING THE APPOINTMENT AND TIME FOR APPOINTMENT
PROVISIONS OF SECTION 1780 OF THE GOVERNMENT CODE,
REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY
OF NEVADA TO DO THE SAME, AND CALLING FOR A
SPECIAL ELECTION TO FILL VACANCY ON BOARD OF
DIRECTORS
WHEREAS, DUANE ANDERSON, a former elected director of
TRUCKEE-DONNER PUBLIC UTILITY DISTRICT resigned from the
board of directors by a written resignation dated August
20, 1974 effective on August 31, 1974 , and,

THEREAFTER the remaining district board members gave
notice of the vacancy and have made diligent efforts to
fill said vacancy pursuant to the provisions of Section 1780
of the Government Code without success, and the remaining
district board members having found and determined that they
will not be able to appoint to fill said vacancy, and
THE remaining district board members believing it to
be in the best interests of the district that the vacancy
be filled by a special election to be held as soon as
possible;

I NOW, THEREFORE, BE IT RESOLVED by the Board of

TRUCKEE-DONNER PUBLIC UTILITY DISTRICT

follows :
1. The vacancy in the office of elected member of the
governing board of the district be filled by means of a

special election to be held in the district for that purpose
as soon as possible.
2. The remaining board members of the governing board
I
of the district do hereby waive the provisions of Government
Code Section 1780 which permit appointment to fill said
vacancy for a period of 90 days immediately subsequent to
the creation of the vacancy.

3. The remaining board members of the governing board
of the district do hereby call upon the Board of Supervisors
of the County of Nevada to accept this waiver and, in addition
thereto, urge said Board of Supervisors to likewise waive its
right to fill the vacancy as in said Section 1780 provided,
all to the end that a special election to fill the vacancy
be held as soon as possible.
4. Said special election would be for the purpose of
filling the vacancy in the office of an elected member of

the governing board of TRUCKEE-DONNER PUBLIC UTILITY DISTRICT,

j and the person so elected shall serve for the balance of the
unexpired term of the vacant office.
Passed and adopted by the Board of Directors of

thereof duly called and held in said district on the 14th
