HomeMy WebLinkAbout1977-05-03 Min - Board R MAY 351977 The regular meeting of the Board of Directors was called to order by the Chairman at 7:00 P.M. in the conference room of the District office. The Chairman adjourned the meeting into executive session at this time. All directors were present at this time with the exception of Mr. Kuttel . The regular meeting was reconvened at 7:35 P.M. following executive session. ROLL CALL: Huber, present; Craig, present; Maass , present; Kuttel , present; Sutton, present; EMPLOYEES PRESENT: Seymour and Reed. CONSULTANTS PRESENT: Grumer. OTHERS PRESENT: See attached list for audience attendance. MINUTES Mr. Craig moved that the minutes of March 29th be approved. Seconded by Mr. Maass. ALL AYE BY VOICE VOTE. SO ORDERED. Mr. Craig moved that the minutes of April 4th be approved. Seconded by Mr. Maass. ALL AYE BY VOICE VOTE. SO ORDERED. Mr. Craig moved that the minutes of April 5th be approved. Seconded by Mr. Maass. ALL AYE BY VOICE VOTE. SO ORDERED. STATEMENT OF GENERAL FUND Bills for Board Approval : Following brief discussion of the bills for approval , Mr. Craig moved that the bills be paid. REPORT FROM ELECTRIC SYSTEM CAPITAL IMPROVEMENTS COMMITTEE The Manager reported that as of this meeting the Electric Committee had not met but would be doing so -and would report at the next regular meeting. PUBLIC HEARING - ORDINANCE CHANGING TIME AND DAYS OF REGULAR BOARD MEETING The Chairman opened the public hearing on this matter at 7:47 P.M. As there was no discussion the public hearing was closed at 7:47 P.M. Mr. Craig moved for the adoption of the Ordinance changing the date and time of regular Board meeti.ngs (Ordinance 7703). Seconded by Mrs. Huber. Mrs.- Sutton asked that the record show, "I am still opposed to the 7:00 P.M. starts-ng time and I plan to support the motion to adopt the ordi nance for the 7:00 P.M. starting time and I would hope that if it, in a three month trial period, does not prove to be workable that the Board would amend it." Mrs. Huber moved that the Ordinance be amended to commence the second meeting in June, 1977. Seconded by Mr. Maass. PUBLIC HEARING - ORDINANCE REVISING RULES AND REGULATIONS FOR WATER SERVICE Mr. Grumer read the proposed Ordinance (7704). The Chairman declared the public hearing opened at 7:55 P.M. As there was no discussion the public hearing was declared closed at 7:55 P.M. Mr. Maass moved the adoption of revising rules and regulations for water service (Ordinance 7704). Seconded by Mr. Craig. Page 1 May 3; 1977 The Board briefly discussed the proposed Ordinance including dis- cussion of Rules 2 on Sheet 16 and the possibility df the District sending disconnect notices by certified mail , however, no decision was made regarding this matter. The Chairman indicated that she had several questions regarding the proposed revision of Rules and REgul ations for water service and requested that this matter be tabled so that they could be discussed before the adoption of this ordinance. ....� The Chai rman' ruled that there had not been adequate discussion for a request for the question without a vote on the question. Mrs. Sutton asked that the record show,"my 'no' vote is because I do not believe that this revision-' is going to be adequate for the District's problems and I believe that it should have further review with the District Engineer and the Manager," CALL FOR BIDS Following discussion Mr. Craig moved that the District call for bids as specified in Contract Document No. 2 "Feeder F Rebuild" as prepared by R.W. Beck & Associates, bids to be opened at 2:00 P.M. on May 27, 1977. (Resolution 7705). Seconded by Mr. Maass. ROLL CALL: Huber, aye; Craig, aye; Maass , aye; Kuttel, aye; Sutton, aye; SO ORDERED. CONSIDERATION OF RESOLUTION RE WRSAD LINE EXTENSION REFUND Mr. Seymour gave the Board a brief chronology of the events involved in this matter. A copy of this chronology is attached to these minutes. Mr. Craig moved that the Board adopt the Resolution "Declaring Surplus In West River Street Assessment District, TDPUD, Nevada County, California" as prepared by Mr. Ness. (Resolution 7706). Seconded by Mr. Kuttel . Mr. Maass moved to close discussion. Seconded by Mr. Craig. ALL AYE BY VOICE VOTE. SO ORDERED. Mrs. Sutton asked that the record show, "I believe there is some unresolved problems and I do not believe that it is that important that this action be taken tonight. " Mr. Lowell Northrup, a property owner in the WRSAD, again appeared before the Board. He indicated that he and .other WRSAD property owners intended to file a written claim against the District regarding the delay in receiving funds. CONSI-DERATION OF RESOLUTION APPROVING SANDER'S SITE .WELL EXPLORATION; ALSO NOTICE OF DETERMINATION RE NEGATIVE IMPACT Mr. Maass moved the adoption of Resolution 7707, "Approving the Sander's Site Production We 1 l and Related Transmission Main Project. " Seconded by Mrs. Huber. Mr. Seymour read to the Board a letter received by the District from the State of California, Department of Health. A copy is attached to these minutes. Page 2, May 3, 1977 Mrs. Sutton requested for the record that Dart provide the District with a written approval (of the well site by the California Department of Health). Mrs. Sutton asked that the record show, "once again I am concerned about the fact that the Board is not receiving the materials which are necessary for Board decision in advance of the Board meeting." DETERMINATION OF DISTRICT POLICY .RE CONSTRUCTION OF ELECTRIC LINES IN SUBDIVISION BY DISTRICT PERSONNEL Mr. Seymour indicated that he had not prepared anything on this item because it is a part of the overall electric rules and regulations on which R.W. Beck is now working. Mr. Craig moved that this item be tabled until the R.W. Beck study comes in. Seconded by Mr. Kuttel . ALL AYE BY VOICE VOTE. SO ORDERED. CONSIDERATION OF DECLARING CERTAIN ELECTRIC MATERIALS SURPLUS Mr. Maass moved that this item be tabled to the May 17th meeting. Seconded by Mr. Kuttel . ALL AYE BY VOICE VOTE. INFORMATION, DISCUSSION AND POSSIBLE ACTION RE DISTRICT ANNEXATION INTO PLACER COUNTY; REPORT ON FINANCIAL IMPACTS . Mr. Kuttel moved that this matter be tabled to May 17th. Seconded by Mrs. Huber. ROLL CALL: Huber, aye; Craig, no Maass , no; Kuttel , aye; Sutton, aye; PMWM SO ORDERED: CONSIDERATION OF RESERVATION OF RIGHTS AGREEMENT WITH ROYAL GLOBE INSURANCE RE DART CROSS-COMPLAINT IN RICHMOND CASE AND DIRECTION TO COUNSEL Mr. Grumer read letter dated May 2, 1977, addressed to Mrs. Sutton, regarding this matter. A copy is attached to these minutes. Mr. Craig moved that the Answer to the Cross-Complaint by Dart on behalf of the District i n_the Richmond vs. Dart case prepared- by the attorney for the insurance carrier should be filed. CONSIDERATION OF APPROVAL OF 1976 UNION CONTRACT This matter was deferred following discussion of item 1 under new business. REVIEW OF GENERAL MANAGER JOB DESCRIPTION, ETC. , AND DECISION ON FILING PERMANENT POSITION Mrs.- Huber moved that thi s item be tabled either until after the executive session of this meeting or at the next meeting. Seconded by °'--� Mr. Kuttel . ALL AYE BY VOICE VOTE. DETERMINATION OF BOARD POLICY RE ELECTION BY MAILED BALLOT Mrs. Huber reported regarding the meeting with-the County Clerk for the benefit of those members of the Board not present- at the April 25th meeting (See minutes of 4/25). Mr. Craig moved that the District adopt election by mailed ballot. MOTION DIED FOR LACK OF SECOND. Page 3, May 3, 1977 Mr. Maass moved that the District reject the election by mailed ballot as proposed by State Law and the County Clerk for reasons stated at the April 25th meeting and that a letter be directed by the Board President or Manager to the County Clerk explaining with a copy of minutes attached appropriate to the discussion. Seconded by Mr. Kuttel. Mr. Kuttel stated for the record that, "I was involved in a couple of the elections and we had in certain precincts over a 150% increase in voter registration with no new houses." --N" Mr. Seymour stated for the record, "that a ballot is supposed to be .secret and there is no guarantee of secrecy if it is done by mail . " Mrs.�Sdtton stated for the record,. "I would like to have the record show an additional concern that I have which has to do with the method by which the voters' lists are purged which changed this past year and which does not really clean out the dead wood and I believe that in this District in the election i nJebruary there were somewhere between 100 and 150 names still on the registered voter el i gi b,le' e. list which were people who were no longer in the area and who have been gone or dead sometime and I think that that is another reason why this kind of an election should not be held becuase sample ballots are not forwarded but the mailed ballots would be a first class mailing and would be forwarded." MISCELLANEOUS OLD BUSINESS Mr. Craig stated for the record, "We have had three executive sessions within the last week and I think that the vast majority of the business that was transacted in executive session could have been in open session., I think that the Board is abusing the reason for executive sessions. I --� think that the meetings are too long, too many meetings and that the same results could be accomplished in a much shorter time with fewer meetings and shorter hours." Mrs. Sutton asked that the record show, "that it is unfortunate Mr. Craig didn't stay through so that we could accomplish those things. Two of the executive sessions had to do with legal matters which are pending and are proper use.-of executive session in discussing those matters and the third executive session has to do with personnel which was this evening and I .bel i eve there was no abuse of the executive sessi onby the Board." Don Strand appeared before the Board regarding electric lines in Units 8, 9, 10 and 11 , Tahoe Donner. Mrs. Sutton stated, "that Mr. Strand has advised us ,that Dart plans to construct the electric lines in Units 8 and 9 in 1978 and Units 10 and 11 in 1979,. " Mrs. Sutton reported that she had been contacted by Mr. Robert Butler who owns property in Ponderosa Palisades Unit 1 . See memo attached to these minutes to Mr. Seymour from Mrs. Sutton. Mr. Seymour reported that he had met with Mr. Butler and indicated to him that he would have to pay for the line extension to his property. However, Mr. Butler is still concerned about the road across his property which is used by the District. It was agreed that this item would be placed on the agenda again at Mr. Butler's request. The Board discussed a UCSB extension course entitled, "Financing Special Districts ," to be fel d i n San Francisco on May 13 and 14. Page 4, May 3-, 1977 Mr. Maass moved that Mr. Seymour be authorized to attend this conference. Seconded by Mrs. Huber. ALL AYE BY VOICE VOTE. SO ORDERED. Mrs. Sutton reported that Arthur Young & Company had indicated to her that the Audit Report should be received by the District in the near future. The Board discussed the possibility of having a Special Meeting in May to discuss with the Accountant Consultant the various financial reports received by the Board. Also discussed was a Special Workshop . Meeti ng wi th Dan Cook re surpl us 1-and of 'the Di stri ct and an executi ve session regarding the Hatch vs. TDPUD case with -Martin McDonough and Dan Cook both in attendance. The Chairman i-ndi Gated she would schedule a p ci al Meeting for May l l th at 4:30 P.M. with Mr. 'Cook and Mr._ McDonough regarding Hatch vs . TDPUD. Mr. Craig left the meeting at 10:00 P.M. A Special Meeting was scheduled for May 10th at 4:00 P.M. with Matt Gomez of Arthur Young & Co. The meeting with Mr. Cook regarding surplus land was deferred until a date in June. Mrs. Sutton inquired if the Board wanted to comment regarding I-2 housing at a hearing to be held within the next few weeks. No action was taken. Mrs. Sutton requested that- the Notice received from the Department of Water Resources regarding Donner Lake Water be attached to these minutes. Mrs. Sutton also commented on a Ndti ce recei ved l from the Planning Department of Nevada County regarding the capability of the District to --- handle projected growth dated April 19, 1977. Mr. Seymour indicated that he would respond to this notice. Mr. Grumer reported- to the Board that there is a matter of 9 or so deeds related to Tahoe Donner which should be acted upon by the Board. The Chairman requested that this matter be brought up again and that a written report be provided to the Board. REVIEW OF UMBRELLA (EXCESS LIABILITY) COVERAGE - STICE & WELLS The Board discussed the umbre l-'aXaexcess liability coverage. Mr. Maass moved that the Board authorize Sti ce & Wells to provide the District excess liability coverage at an annual premiums of $3,013.00. Seconded by' Mrs. Huber. DIRECTION RE OBSERVING DISTRICT'S 50th ANNIVERSARY The Board discussed the possibility of a celebration of the District' s 50th anniversary. No action was taken. MISCELLANEOUS NEW BUSINESS The Chairman read for the record a letter received by Mr. Al O' Brien regard'i ng a claim for .damage to his Carr. A copy- of thart' 1 etter is attached to these minutes. Mrs.. Sutton asked that:. the record show the procedure of filing a claim as outlined by Mr. Grumer, "of the letter and the estimate being sent to the attorney and the attorney then directing- the Board to reject the claim and submitting it to the insurance company." REVIEW AND CONSIDERATION OF PAY DAY CHANGE and CONSIDERATION OF APPROVAL OF 1976 UNION CONTRACT-- Mr. Grumer indicated that he would contact the Union representatives Page 5, May 3, 1977 regarding the matter of the proposed pay day change and possibly avoid a grievance. The matter of a resolution regarding pay day change was placed on the May 17th agenda as well as the':'consideration of the 1976 Union contract. REVIEW OF CONFLICT OF INTEREST ORDINANCE Mr. Grumer reported that h6, would provide the Board with a letter regarding this matter and in the meantime -again contact NevaddaCounty Counsel regarding the Ordinance submitted by -the District for approval by the Board of Supervisors. Bid Policy Summary: Mr. Grumer indicated that he would update the bid policy previously discussed by the Board several months ago so that it could be put into resolution form and acted upon by the new Board. Staff Accountant: Mr. Grumer read a letter dated May 10, 1977, regarding -this matter. A copy is. attached to these minutes No action was taken. Photocopy Charges: Mr.' Grumer read a letter dated May 11 , 1977, regarding this matter. A copy is attached to these minutes. No action was taken. REPORT ON DEERFIELD LINE REPAIR, ETC. The Manager reported that the Deerfield line was repaired butt a new leak developed which was also repaired. The -repairs are making other leaks worse. The Manager reported that new covers for water services downtown have been ordered. ELECTRICAL CONNECTION TO MULTIPLE TENANT UNITS The Manager reported on Ordinance 7502, the current ordinance govern- ing electric connection fees. He indicated that in his opinion a revi- sion should be made. The Board agreed-that-Mr-. Seymour--would- prepare a proposed revision, including an analysis and justification, of this ordinance and present it at the next regular meeting. REPORT ON DEERFIELD LINE REPAIR, ETC. coat. Mr. Seymour reported that he had' di scussed with- representatives from Bank of America the possibility of financing the replacement of the line with a bank loan and had received a favorable response. No action was taken: The Manager briefly reported on the work being done on the Southside Well building. The Chairman requested another report at the May 17th meeting on work progress. The Chairman adjourned the meeting into executive session at 11 :52 P.M. The Regular meeting was reconvened at 11 :59 P.M. Mr. Maass moved that the Board direct District Counsel to draw up a resolution for the permanent employment of Milt Seymour as Manager of the District and also the termination of the consultant agreement. This Ordinance shall become effective after the lapse of thirty (30) days from the date of adoption and commence with the second meeting in June, 1977 . The Clerk of the District shall immediately cause a copy of this Ordinance to be published once in the local newspaper and copies shall be posted in at least three (3) public places within the District. Failure to deposit said amount within fifteen (30) days of presentation of the bill shall warrant discontinuance • of service under the notice provisions of Rule No. 13 . The District , after notification that a dispute exists , shall forth- with make such investigation as shall be required by the particular case the report the result thereof to the customer. In the event that the complaint is not satisfactorily adjusted , the District shall notify such customer of his right to an appeal to the Board of Directors of the District as provided herein . NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Truckee-Donner Public Utility District as follows: 1. That the Board of Directors of the Public Utility District hereby finds that the balance of $4,158. 96 is on hand in -1- the improvement fund for West River Street Assessment District and hereby declares that said -amount is surplus. 2. The surplus shall be disbursed in accordance with the provisions of Section 10427 of the Streets and Highways Code of the State of California, as. provided in the original Resolution of Intention, as amended, and more specifically said amount shall be applied as a credit upon the assessments levied in the assessment district as set forth in the policy document hereinabove referred to. 3. In accordance with said provisions, the current owners of any properties upon which the assessments have been paid in full shall receive a cash payment. 4. The Treasurer of the Public Utility District is author- ized and directed to transmit a certified copy of this resolution to the Auditor/Controller of the County of Nevada with instructions to make such cash payments and to apply credits against the assess- ments where appropriate. This standard is about the same as the one presented in Section 8, Part II, Chapter II of "Water-Well Standards: State of California" Department of Water Resources, February 1968. We are greatly concerned about the number of wells we are finding near potential sources of contamination and pollution and the resulting threat to the water using public. For these reasons we are asking all domestic water suppliers to start immediately on the following threefold program: 1. Comply with the attached standard whenever new wells are drilled or added to the system. 2. Protect existing wells against future encroachment of sewage hazards by land purchase and by agreements or under- standings with public works or sewerage agencies. 3. Be alert to new sewer construction so that existing wells remain protected. Where existing wells fail to meet the attached standard, special precautions should be taken to assure protection of the water supply. Our engineers will be glad to review your proposal for such special protection. All wells shall be located a safe horizontal distance from potential sources of contamination and pollution. Most of the factors involved in determining safe distances are usually not known. However, the following horizontal distances, which are based on past experience and general knowledge, are safe where dry upper unconsolidated formations, less permeable than sand, are encountered:* Sewer or watertight septic tank 50 feet Subsurface sewage leaching field 100 feet Cesspool or seepage pit 150 feet Where in the opinion of the enforcing agency adverse conditions exist, the above distances shall be increased or special means of pro- tection, particularly in construction of the well, shall be provided. B. In addition, if possible, the well shall be up the ground water gradient (upstream) from the specified sources of contamination. C. When possible, the top of the casing shall terminate above any known conditions of flooding by drainage or runoff from the surrounding land. D. Where a well is to be near a building, it shall be far enough from the building to be accessible for repair, maintenance, etc. * Because of the many variables involved in determination of the safe horizontal distance of a well from potential sources of contamination and pollution, no one set of distances will be adequate and reasonable for all conditions. In areas where adverse conditions exist, the distances listed should be increased. His lots are #24 , 39, and 40 in Ponderosa Palisades Unit #1. I didn' t ask which lot he was planning to build on. He has been informed by Butch Beavers , the developer of Unit #1, that that line extensions were arranged for with the District at - the time of development. I told him you would look up the a�,rreerment , etc. , and would be able to tell him whetter there was any extension fee involved. (Let me know too, please) 2) That I would advise the board under Miscellaneous Old Business next Tuesday that he is not satisfied with the terms of his agreement with the District on the road to the water tank. That I would ask for the new Directors to receive copies of the correspondence which was exchanged last fall regarding his Droblem with the road. (Availabilit at the Board Meeting on May 3 would be best probably. 3) That I would suggest to the Board on May 3 that we follow through on your suggestion that a conference be arranged with TV,'r. Butler, you, Steve , and me , and possibly Dan, to discuss his problem and possible solutions , with a report .back to the Board, perhaps May 17, if feasible . 4) That the District would advise him of an appropriate time to appear before the board after these things have been accom-plished, I hope these commitments to Mr. Butler to try to provide the means for some possible resolution of his problems are okay with you. Cash re PT&T building addition 9/14/76 - Received check for $5300 - Deposit to checking. Contacted Dan Cook - said to send money to County - would probably need Board approval . 12/26/76 - Report bo Board of transactions for year on WRSAD - showed amounts to be credited to each assessment and asked for Board approval . 1/4/77 - Above report received by Board and transfers approved 1/6/77 - Letter from me to Marcella Carson including check for credit - copy of letter to each assessed parcel owner. 2/15/77 - Received letter back from Marcella Carson saying she was unable to accept the check 2/77 - Calls to Dan Cook - He agreed we should contact Ness. Calls to Bond Attorney Ness. He said they would discuss in his office and arrive at a solution. 3/28/77 - Received resolution from Ness' office for Board action - authorizes Marcella Carson to accept check and apply toward assessments. 4/19/77 - Lowell Northrup called and said he was calling in reference to my 1/6/77 letter to Marcella Carson- wanted to know what was taking so long. I told him I had contacted Ness and a resolution was being prepared - told him County had returned check He said he had not paid his last tax bill becuase of the refund - told him I would check into the matter and get back to him. Checked with Jane - resolution received and still in file, no action taken. Called Grumer immediately, he said to put resolution on agenda at his request for next Board meeting - said we had the right to take as long as we wanted - said that Northrup should not have not paid his tax bill becuase a credit was coming - asked if I would like him to call Northrup - I said "yes."
