MARCH 5, 1979
The Regular Meeting of the Board of Directors of the Truckee Donner
Public Utility District was called to order by President Maass at 7.05 P.M.
in the District office.
ROLL CALL: Directors Hatch, Huber, Kuttel , Sutton and Maass were present.
CONSULTANTS PRESENT: District Counsel Grumer and District Engineer Cook
were present.
EMPLOYEES PRESENT: A. Milton Seymour and Susan Craig.
OTHERS PRESENT: Among those present were Beatrice Thys, Mike Va i 1 1 ancou rt,
Bill Dornberger, Don Strand, Lisa Vere, Mary Waymire, Tim Waller, Don Casler,

APPROVAL OF MINUTES
Director Kuttel moved that the Board adopt the minutes of January 2,
January 15, and January 29, 1979. Director Sutton seconded the motion. ROLL

Director Sutton noted she thought there were some minor spelling errors
in the draft minutes of February 5th and February 13th. Director Sutton moved
that the draft minutes of February 5, 1979, be prepared in final form. The

STATEMENT OF GENERAL FUND AND BILLS FOR BOARD APPROVAL
Mr. Seymour noted that the Wedco bill ($5,694-53) listed for approval
consists of five different purchase orders. He further advised that he has
requested the Bookkeeper, in this instance and in the future, to list all
purchase orders separately when the amount exceeds $4,000, even though one
check is written.
Payment to IBM for a service agreement on one electric typewriter for
the period of February 2, 1979 through August 15, 1979, was discussed. Prior
to making apyment, the Bookkeeper is to investigate the dates of the agreement
to make certain they are correct.
Director Kuttel moved that the bills be paid; Director Hatch seconded the

COMMITTEE REPORTS
No Committees met since the last Board Meeting, the Chairman reported.
MANAGER'S REPORT
General Status of the District - Mr. Seymour reported that, during the past
three weeks, the District has had several electrical outages caused primarily
by storms and heavy snowfall . Noen of the outages have been very serious or
very long - probably because the system is in better shape this year than last.
The Water Department suffered a major outage approximately ten days ago
when a snow plow operated by the County broke a water line on High Street which -
was buried only one foot beneath the surface of the earth. The charges associat-
ed wi th the break wi 1 1 be bi 1 led to the County.
The water production figures for February are somewhat lower than January' s
figures. More water was pumped from Donner Creek Well than from the Nor the i de
Well (due to the transducer having been removed) . A copy of the water production
figures for February is attached to the written Manager's Report which follows
these minutes.

Annual Report - Last week, Mr. Seymour noted, he met with Gail Grimes and dis-
cussed the possibility of preparing an annual report for the District. (She
is currently preparing a like report for the Hospital District) . Another meet-
ing with Ms. Grimes has been scheduled. The Manager will come back to the Board
with a layout and cost estimate at the next Board meeting. If the Board decides
to go forward with the annual report, it wi 1 l take approximately six weeks to
put the report together and have it printed. Mr. Seymour stated he felt it would
be a very worth while project.
Several Directors mentioned they had not received a copy of the water
production figures for the month of February. The Secretary will provide
them with a copy for their records. A brief discussion of the water usage
and completion of Project 77-1 by Roen Construction Co. ensued.
DISCUSSION AND POSSIBLE BOARD DIRECTION REGARDING 1 .9 ACRE PARCEL LOCATED
AT HIGHWAY 89 AND DONNER PASS ROAD
Director Sutton noted it was her understanding that Mr. Grumer would
provide a report on the advertising methods utilized in the call for bids
for lease of the 1 .9 acre parcel . District Counsel advised that, as yet,
he has not received any -of the three affidavit's of publication; the Nevada
State Journal provided such proof of publication to the District directly as
did the Sierra Sun. The Chronic)e has not forwarded the affidavit to Counsel
or the District. He reported that the advertisements appeared in the legal
notice sections of the above mentioned newspapers. Also, he stated that he
had notified the President of the Multiple Listing Service in the Tahoe area
of Nevada regarding this matter, as well as one broker in California. Mr.
Seymour advised that approximately ten Truckee real tars picked up bid docu-
ments at the District office.
Various advertising techniques were discussed. Mr. Seymour was still
not informed as to why Tahoe National Bank did not bid on the lease; he is
expecting a response shortly.
It was Mr. Grumer' s opinion that the present time is not an opportune
time to pursue the lease of this parcel due to the current financial situ-
ation.
Mr. Grumer suggested that, if a determination is made to go back to bid,
an additional paragraph be added to the Resolution calling for bids which sets
forth specific provisions for the manner of advertising.
After discussion, Director Kuttel moved that the Board direct the Manager
and Legal Counsel to reactivate the advertising for bidding - to present pro-
posed display ads for the next Board Meeting, March 19th. The motion was sec-

BOARD DIRECTION RE REQUEST OF A. H. KOEPF (FOREST LANE EASEMENT)
Mr. Seymour advised that Mr. Koepf of Koepf & Lange, by letter, indicat-
ed their continuing interest in the Forest Lane easement and their agreement
to bear the costs to have the easement removed by the County. Also received
by the District was another letter from Koepf & Lange setting forth their
proposal and an acknowledgment of the District's desire to hold a public hear-
ing for the benefit of the surrounding property owners prior to any Board
action being taken on the matter.
Director Sutton recapped for the Board decissions made thus far regard-
ing this item. (The possibility of selling some of the property to Koepf &
Lange after the road easement has been eliminated - prior to any sale, a
public hearing would be held and proper notice would be given to adjacent
property owners - also, the poss i b i 1 i.ty of the District keeping. an easement
for a buffer zone between the residences and new development.)
Mr. Koepf, present in the audience, explained his firm had purchased
property adjacent to Meadow Lane for the purpose of building a small profession-
al complex. When it was discovered access would be a problem, a title search
was made. They discovered the PUD owned the property upon which the County
has an easement - request was then made of the District regarding possible sale.

Director Sutton moved that the Board set a public hearing for 8:00 P.M.
on Monday, March 19, 1979, for the purpose of receiving public comment on the
proposed abandonment of easement and potential sale of the strip of land 50'
by 345' known as Forest Lane. Director Kuttel seconded the motion. Director
Sutton added to her motion that all property owners within 300' of this parcel
be notified by mail ten days prior to the hearing. Director Sutton withdrew
her motion.
Director Sutton moved that the Board set a public hearing for 8:00 P.M.
on Monday, April 2, 1979, for the purpose of receiving public comment on the
proposed abandonment of the easement and potential sale of the strip of land
50' by 345' known as Forest Lane. Further, that all property owners within
300' of this parcel be notified by mail ten days prior to the hearing. Dir-

DON CASLER'S REQUEST FOR QUITCLAIM DEED TO BLANKET EASEMENTS ON PROPERTY
LOCATED BETWEEN ELEMENTARY SCHOOL AND GAS STATION
Mr. Cas 1 er asked the President the status of the above noted item which
did not appear on the agenda. President Maass informed him that applicable
reports and documents had not been received from District Counsel and District
Engineer as yet.
PUBLIC HEARING
WATER AND ELECTRIC CASH FLOW BUDGET FOR 1979
At 8:08 P.M. the President opened the Public Hearing for discussion of the
Water and Electric Cash Flow Budget for 1979.
Mr. Seymour noted a revised budget had been prepared which incorporates
changes suggested at the last Board Meeting. A copy follows these minutes.
He summarized the budget for those present. Questions regarding computer
programming, travel and meetings and insurance were answered by the Manager.
Mr. Seymour explained that a combination of forecasting, predicting and zero-
based budgeting were utilized in preparation of the budget.
The Chairman continued the meeting to 8:00 P.M. on March 19, 1979.
Director Sutton suggested that the Manager complete the narrative concerning
the budget prior to the next Regular Meeting, and provide copies to the Direc-
tors.
REVIEW OF DISTRICT RETIREMENT PLAN (PRESENTATION BY RON RICHARDSON, CLU)
Mr. Richardson exp 1 a i ned that the type of plan the District presently
has is a defined benefit plan. It provides for specific retirement benefit
at age 65, which is based on an average of the highest five consecutive years
of earnings. The plan is designed to work with Social Security retirement
benefits. Eligibility is available to all employees working at least 1 ,000
hours a year and who have completed 12 months of service providing they are
at least age 25. Normal retirement age is the 1st of the month following a
participant's 65th birthday, or after ten years of participation, whichever
is longer. The maximum retirement age is 70. Postponed retirement is per-
mitted upon agreement between the District and the employee.
Concerning the eligibility age, Director Hatch asked if any currently
employed employee in a career position is under the age of 25; there is pre-
sently such an employee. Director Sutton advised that this matter was part
of the Union negotiations two years ago; the Board did not see fit to 1 owe r
the eligibility age. She stated she felt the matter should again be taken
up during the forthcoming negotiations -with the Union.
Mr. Richardson went on to say that the plan provides a monthly lifetime
income at age 65 that a retiree cannot outlive. If a participant wishes to
receive a monthly income for the lifetimes of himself and his spouse, he can
do so and receive a little less each month. A participant can elect to re-
,.ce i ve the value of the monthly income in lump sum, cash form in 1 i eu of a
monthly benefit. The options are very flexible.
The benefit payable at retirement is based upon applying a formula to
the highest five consecutive years of monthly earnings. This formula is

20% of earnings up to $400 plus 40 0 of average earnings over $400 a month.
There is a minimum service requirement of 20 years at age 65 to receive a
full benefit. Employees hired over the age of 45 would have their benefit
at retirement reduced proportionately.
The entire cost of the plan, as of three years ago, is paid for by the
District. Employees are subject to a benefit reportable on their W-2 for
insurance benefits paid for by the District.
f a participant dies while a part i,c i pant, the named beneficiary is
entitled to a life insurance benefit from the plan. In most cases, the in-
surance benefit received would exceed the value of their benefit.
Mr. Richardson illustrated benefits under the plan . He noted that
each year a participant works for the District, he or she earns a percentage
of his or her normal retirement benefit. How much of the ''accrued benefit''
a participant is entitled to depends upon the vested interest a participant
has attained.
Mr. Richardson noted there were some recommendations he would 1 i ke to
research and make to the Board at a future meeting as far as improving the
program. President Maass indicated the Board would consider Mr. R i cha rson' s
recommendations at a meeting that is convenient to him.
STANDBY CHARGE COLLECTIONS

Mr. Seymour stated that the purpose of this agenda item is to determine
whether the District should continue b i l 1 i ng standby charges as it has during
the past two years, or request the County to process the billing. He indicat-
ed the cost of going through the County has increased; he would like to obtain
a difinitive price from them. It is possible that the District could bill the
charges for less than the County would charge.
Discussion ensued. Directors Sutton and Maass indicated that the deci-
sion should also be based on information regarding the District's expenses to
bill the charges directly, and the fact that the percentage of collection is
lower with 20% eventually having to be collected through the County tax bills.
The Manager agreed that these things should be taken into consideration.
The Chair directed that the Manager investigate the matter and report
back to the Board at the April 2, 1979, meeting. He is also to make recommenda-
tions at that time.
Director Sutton noted that any exemption requests that result from
1979 billings should be taken care of in April , too. President Maass agreed
that Mr. Seymour should include this matter in his report.
TDPUD - SIERRA PACIFIC AGREEMENT RE GLENSHIRE
The President noted the Directors had received copies of the letter
written by the TDPUD to Sierra Pacific Power Company on February 9, 1970, re-
garding service to Glenshire by Sierra Pacific Power. The possible existence
of a written agreement signed by both parties was discussed.
Mr. Seymour advised that the agreement is for a ten year period - to
expire in approximately one year. The District can attempt to recover the
territory and provide service, or request that Sierra Pacific continue to pro-
vide service under the current fringe agreement. Director Sutton suggested a
formal , written agreement signed by both parties for another ten years be en-
tered into.
Director Sutton recommended that the matter be set over to a meeting
in June - perhaps prior to that time a formal agreement might be discovered.
President Maass set the matter over to the first meeting in July - in
the meantime, Mr. Seymour is to discuss the matter with Frank G i ovannon i of
Sierra Pacific.
REVIEW OF LAIF VS. CERTIFICATES OF DEPOSIT; POSSIBLE POLICY CHANGE OR DIRECTION
Mr. Seymour indicated that, since the time he wrote a memo to the Board
regarding this matter, LAIF interest rates have increased to 8.77%. Bank of
America has six month certificates of deposit that pay 11% - a minimum invest-
ment of $100,000 is required. In response to a question posed by Director
Sutton, Director Huber advised that FDIC covers up to $40,000 in any one partic-
ular account. Mr. Seymour noted Treasury Bills could be purchased and were
available in $10,000 increments.
Director Sutton suggested Mr. Seymour investigate the matter further and
report back to the Board with his recommendations. The Chair directed that
the item appear on the March 19, 1979 meeting agenda under Unfinished Business.
DISTRICT ENGINEER'S REPORT
Placer County Annexation - Mr. Cook reported that the District has received
- excellent response from the second mailing to the property owners in the area
that is proposed to be annexed to the TDPUD. The majority of the larger prop-
erty owners have responded favorably to the proposed annexation. It appears,
he stated, that the annexation should proceed. Prior to the next Board Meet-
ing Mr. Cook will prepare a summary of numerical responses and a summary of
acreage responses that are requesting annexation to the District. Also, he
will provide a recommended sequence and procedures list prior to that meeting.
The item will be placed under New Business for potential Board action,
the Chairman noted, and should be listed as ''Discussion and possible direction
regarding the Placer County Annexation.''
Mr. Cook advised that he would also reconfirm County jurisdiction. He
further commented that Debi Baker had done a good job on the annexation pro-
cedures.
Abandonment of Prosser Well - As it turns out, the District Engineer stated,
the Section I properties purchased by Mr. Payne and described in earlier contact
with Mr. and Mrs. Payne as ''the Truckee Farm'' is a little bit different farming
operation than that which he envisioned during telephone conversations. They
are anticipating use of the well to fulfill a commitment required in District
guidelines.
M r. Cook provided to the Board a copy of the preliminary map that has
been filed with Nevada County for the subdivision of Section 1 .
The final report in draft form on the abandonment of the well wi 1 1 be
presented to the Board prior to the March 19, 1979, meeting, M r. Cook stated.
Report re pay-back to District for improvements to water system performed at
District expense
Mr. Cook noted that, in the Near Term Source Analysis provided in Novem-
ber, statements to the effect that the District must refit the Southside Booster
and accomplish certain other related work this year in advance of receiving
connection charges, facility fees and in kind facilities provided by subsequent
developers were made. The District will be refunded in total the funds that are
advanced from the general fund to provide the necessary facilities to serve the
Ponderosa Palisades area and the Sierra Meadows area. He further noted that
the Board asked for a review of the facility fees, connection charges and re-
lated duties that are imposed upon new connections. That analysis has not yet
been completed, he stated; the request to provide the narrative description and
analytical formula as to how to derive the above noted charges will be embodied
in the final report.
Ponderosa Palisades Duplexes - Mr. Cook advised that he had provided the Board
with a draft letter to the Nevada County Planning Department.
Timberline Environmental Impact Report and revised site plan - The District
- - Engineer noted that the Timberline Environmental Impact Report quoted the letter
of July 24, 1978 correctly. The mitigation measures that have been incorporated
in the draft document appeared to him to be a satisfactory solution to the ques-
tions raised in the July letter. The revised site plan, he noted, is of an
architectural one-line type drawing that does not reflect any of the mitigation
measures discussed in the Environmental Impact Report.
Director Huber advised that the hearing regarding the adequacy of the EIR
is scheduled for March 8, 1979•
Director Huber moved that the Engineer be directed to write a letter to
the Planning Commissioner regarding the adequacy of the Environmental Impact
Report and supporting documents. The motion was seconded by Director Hatch.

Director Kuttel noted his abstention was due to the fact that property
owned by him is in close proximity to this proposed development.
Southside Spring Water Right Application - Mr. Cook advised that his office
was in continuous coordination with Martin McDonough on the progress of the
water rights application for the Souths i de Spring. The revised application
is satisfactory and correct and should be f i led.
A copy of Mr. Cook's report includes a copy of the revised application
and is attached to these minutes .
There was discussion regarding the expanded environmental -imp-act in-
formation requested by the Department of Water Resources last fall . Mr.
Cook explained that the request for additional information relates to
"instream beneficial uses" and impact on the regional wastewater system.
He indicated that he anticipates that the expanded report will be ready in
April .
Ponderosa Palisades Duplexes - The Board reviewed Mr. Cook's draft letter to
the Nevada County Planning Department regarding Ponderosa Palisades Duplexes.
Mr. Seymour advised that the Department of Real Estate is the agency request-
ing District response; it was his opinion that all possible information a buy-
er would want to know should go into the public report.
Director Sutton stated that she believed the TDPUD Board is the agency
that should approve and authorize the sending of will-serve letters whether
for a subdivision or Ponderosa Palisades Duplexes. Mr, Seymour stated that he
would -agree if the Board would impose a time limit on their approval or dis-
approval .
It was Mr. Seymour ' s opinion that the Department of Real Estate required
a response during April .
Director Sutton asked that Mr. Seymour and Mr. Cook prepare a letter
regarding both electric and water service for review for the Board prior to
the next meeting date. Mr. Seymour agreed with Director Sutton that there
should be some sort of a subdivision agreement for service to the Ponderosa
Palisades Duplexes.
President Maass stated the Board would review the draft will-serve let-
ter for Ponderosa Palisades Duplexes at the March 19th meeting. The item will
appear under New Business.
DISTRICT COUNSEL'S REPORT
Conflict of Interest Code - Mr. Grumer advised that he delivered a copy of a
letter to the Directors tonight. Correspondence was final 1 y received from
Brian Bishop (County Counsel) stating that he did not know why it had taken
the County two years to act upon the District's proposed code. Mr. Bishop
suggested three changes in the Code: 1) a typographical correction, 2) a for-
mat change in an enactment clause, and 3) a standardization of the filing
date. It was Mr. Grumer's understanding that when County Counsel 's recommenda-
tions are complied with, the Board of Supervisors will approve the Code.
District Counsel recommended the Board authorize him to make the changes
requested by Mr. Bishop. The matter should be placed on the next meeting
agenda; by that time, Mr. Grumer wi 1 l provide either a new ordinance or an
amendment to the present ordinance. The Chairman requested that District
Counsel advise the secretary as to proper wording for this agenda item.
Director Sutton requested that the Directors be provided with a com-
plete copy of Ordinance No. 7602 and its attachments.
Possible retainer agreement - Mr. Grumer noted that he thought the District
might be interested in a set monthly billing rather than an itemized hourly
billing each month. He further noted that he did not know if this would be
in the best interest of the District, but if it is the Directors desire, he
would be willing to discuss the matter. No direction was given.

Conflict of Interest Code - District Counsel advised that the receipt signed
by the County indicates they received the District Code on August 25, 1976.
He asked that this information be shown in the minutes. Further, the letter
written by County Counsel which was received on today's date states he did
not know why the County had not yet acted upon this matter. A copy of Mr.
B i shop's correspondence follows these minutes.
Director Sutton requested that a letter be written to the County Clerk
notifying her_ that the District would not be filing (Statement of Facts) un-
til the Ordinance had been revised in accordance with County Counsel 's rec-
ommendations as of March 5, 1979. Also, that when the County Board of Super-
visors approves the Code, the Directors will file. She moved that such a
letter be written by the President of the Board. Director Huber seconded the

President Maass requested that Mr. Seymour prepare a draft letter for
his review on March 6th.
LAFCo - Director Sutton requested that items Mr. Grumer was requested to re-
port upon at a prior meeting re latent powers of the District and general in-
formation about the function of LAFCo be placed on the March 19th meeting
agenda as business items. Mr. Grumer indicated he would have the report ready
at that time.
CORRESPONDENCE
None of the Directors commented upon correspondence received since the
last Board Meeting.
PLANNING DEPARTMENT NOTICES
Director Huber noted there were several items having to do with the hear-
ing to be held by the Planning Commission on March 8, 1979 - J. Clark, Timber-
line and the Baptist Church. No discussion was held.
EXECUTIVE SESSION
The President adjourned the meeting to Executive Session at 10:32 P.M.
for the purpose of discussing legal and personnel matters.
RETURN TO PUBLIC SESSION
The Meeting was reconvened to Public Session at 11 :40 P.M.
DON CASLER'S REQUEST FOR QUITCLAIM DEED TO BLANKET EASEMENTS ON PROPERTY LOCATED
BETWEEN ELEMENTARY SCHOOL AND GAS STATION
Mr. Grumer reported that it appears there is no pipe located on the prop-
erty between the elementary school and gas station. However, it appears there
is a well or sorts - perhaps two wells. The paperwork with respect to abandon-
ing the easement is done - there is a resolution that has to be signed by the
Board. Odds are, Mr. Grumer reported, that the well does not meet current
District standards. More likely than not, the well is of no value or interest
to the District. If that is Mr. Cook's opinion, the item will appear on the
next agenda.
Mr. Casler reported that there is no property within the boundaries of this
parcel that belongs to the PUD. It was Director Sutton's understanding, she
stated, that the well is located behind the school .
It was Mr. Casler's request, Mr. Seymour advised, that the District report
on any existing pipeline on the property. Mr. Cook is to investigate and re-
port on this matter (hopefully, at the next meeting) .
Director Sutton estimated that it would probably be April 2nd before
the Board is in a position to take any action on this matter.
Mr. Ca s 1 er stated that two Board Meetings ago the matter was turned over
to Mr. Cook and Mr. Grumer to determine whether there is any reason for the
PUD to not quitclaim its interest within this property easement. It was his
understanding, he stated, that Mr. Grumer's portion of the owrk had been com-
pleted; Mr. Cook has not yet addressed the matter.

President Maass noted that this matter would appear on the agenda for the
March l 9th meeting. Director Sutton requested the record show the Board has
informed Mr. Casl er that, in all probability, some report wi 1 1 be on the agenda
for the next meeting. The President noted that unless Mr. Cook has the report
in his hands by March 15th, the report will not appear on the agenda.
RICHMOND VS. DART ET AL.
Director Huber moved that the President be authorized to sign the Sub-
stitution of Attorneys in the Richmond vs. Dart case. Mr. Grumer noted the
change of venue from the Nevada County Superior Court to the Sacramento
Superior Court is the reason for the substitution of attorneys. The motion
was seconded by Director Hatch. ROLL CALL: Hatch, aye; Huber, aye; Kuttel ,

INCREASE IN MANAGER'S SALARY
Director Hatch moved that the Manager's gross salary be raised 7%,
the same raise as was given the Union employees, effective March 1 , 1979.

By a unanimous vote, the meeting was adjourned at 11 :51 P.M.
MEETING RECONVENED
The President noted that one item of business had been overlooked. The
meeting was reconvened at 11 :53 P.M.

Counsel to evaluate an alternative which would be to agree to abandon the
easement in question and substitute an easement on the east side of the prop-
erty between this property and the school (on the school side of the property)
- that this be investigated by Staff and be made part of the report. The

MANAGER'S REPORT
1 . General Status of the District
During the past three weeks, the District has had several electrical
outages caused primarily by storm problems . None of the outages have been
very serious or lasted very long.
The Water Department suffered a major outage approximately ten days
ago when a snow plow operated by the County broke a four-inch water line..
Apparently, the wate.r line was only buried abol-A one foot beneath the sur-
face of the earth. We have accumulated the charges associated with the
break and are billing the County.
Water product:icri figures for the month of February are attached.
They are in line with previous i-rioritris ' usage, and down somewhat from
J a 11 Lla r y. You wi I I note that we, for the second month in a row, have
pi.,imped more water fr"011 Donner Creek Well than from Northside Well . This
has been because of a control wiring problem at Northside Well that shut
the well down when the pressure transducer was removed. B i I I Avery has
corrected that problem and the well will now go back to functioning more
normally.

is set and the outline. approved, it will take approximately six weeks to

The Di.s tr-ic.t Staff has received excellent response from the
second mailing to the property oxmers in the area that is
proposed to be annexed to the Truckee Donner Public Utility
District. A majority of the larger property owners have
responded favorably to the proposed annexation, It would
appear, based on the results of the first mailing and the
pos i t:Lve results of the second mailing thclt the annexation
should proceed„ Milt and I will prepare for you a summary
of ni merical responses and a summary of acreage responses
that are requesting annexation to the District, We will also
provide a recommended sequence and procedures list prior to
your March. 19 Bloa.rd. Meeting,,
2. ABANDONMENT OF PROSSER�WELL
As it turns out the S ec t:Lon 1 properties purchased. by My:%
Payne and described in. our earlier contact with fir, and. Mrs .
Payne as "the Truckee Farm" is a little bit different farming
operation than that which I envisioned, during those telephone
conversations , Attached as page 4 of this report is the
preliminary map that: has been filed. with Nevada. County for
the subdivision of Section 1, From discussions with Nor. Payne`s
engineer, it is apparent that they are anticipating the use of
the Prosser Well as a facility meeting the District's source
requirements for the subdi"Vi.s►ion of the size and nature proposed.
We have had, preliminary discussions with Tom. Lott., Mr. Payne's
engineer) describing the unsuitability P of the Prosser Well as
a. public water source a regardless of the current ownership.
I have completed to d the. report in draft form on the abandonment

of the well and have reduced the contamination potential -to a
s i m ':�.e probability lit�r for the Board's consideration. The final

in November,, statements to the effect that the District must
refit the South,,it;ide- Boos ter and accomplish certain other related
work this y ear in advance of receiving connection charges ,
facil,]Lty fees and in kind fac:1.1ities provided by subseqUent
developers . The District will. be refunded in total the funds
that are advanced from the general fund to provide the necessary
facilities to serve the Ponderosa Palisades area and the Sierra
Meadows area. Some time back you asked us to review the facility
fees , connection charges and related duties that are 'imposed upon
new connec ti oils . That anal yS *is has not yet 'been completed and
the request to provide the narrative description and analytical.

Suffice to say at -this point that the District funds that are

4. PONDEROSA PALISADES DUPLEXES
The Ponderosa Palisades Duplexes were approved by the Board of

Directors last fall. The Di.strict received and deposited the
fac:Llity fees for the subject project Just prior to the November
election. You will recall. that Keith Sauers representing the
om,mer of the Ponderosa Duplexes , appeared before the Board at
a special meeting, at which time the final authorization of the
project was givert.,
5. TIMBERLINE ENVIROXMEi NTAL IMPACT REPORT AND REVISED
S I TE PLM.4
Th E! Timberline Environmental Impact Report quotes our letter of
J'uly 24, 1978 correctly. The mitigation measures that have
been incorporated in the draft: document -would appear to me to
be satisfactory solution to the questions.• raised in our July
letter. The rev3Lst:_%.d site plan however, is of an architectural
one line typ e drawing, that does not reflect any of the mitigauon
measures discusse.d. in the Ex-nrironmental Impact Report, It would
seeirt appropriate to me to have a cormnitment in the form of a
draw-.Lng that crin be reviewed and interpreted by all persons
that details the narrative mitigation measures, that are de'scribed
in the. Environmental Impact Report. In absence of such a
draw'.Lng, several, interpretatiens can be made based on the
narrative desc ription of the report.
6. SOUTHSIICE S PRING WATER RIGHT APPLICATION
We were and. have been in conti*nuouS coordination with Martin
McDonough on the progress of the water rights application for
the Southside Spring. A relzised application that is attached
to th is report as page Is satisfactory and correct and sho'uld
be filed. The District should not contest the call revision
contained in t-he application*
