Relating to Mr. Garbutt' s proposal to purchase an easement from the PUD,
Director Maass moved that the Board not consider selling an easement on the
Ponderosa Palisades Tank site. The motion was seconded by Director Huber. ROLL

The Board briefly spoke of a possible drainage problem from the Ponderosa
Palisades Tank onto the Garbutt property. Director Sutton thereafter moved that
the Manager be directed to provide the written record of the incidences of over-
flow from the Ponderosa Tank that have created a problem, and also a written report
on the complaints over the last five years for overflow. In addition, she request-
ed a report as to the engineering of the tank site and whether or not it has been
altered somehow. MOTION DIED.
Mr. Seymour requested that the Board direct Mr. Cook to determine the exact
property boundaries of the tank site. Thereafter Director Maass moved that Mr.
Cook be directed to determine the location of the pipe and runoff, and ascertain
whether the runoff can be diverted. Also, that he determine the exact property
boundaries. Director Sutton seconded the motion. ROLL CALL: Hatch, absent;

REVIEW OF STAFF RECOMMENDATIONS; CONSIDERATION AND POSSIBLE ADOPTION OF RESOLUTION

REVIEW AND CONSIDERATION OF RESOLUTION ADOPTING CONFLICT OF INTEREST CODE
Mr. Grumer noted that he had, as yet, received no changes or corrections to
the draft code from the Directors. The Chairman tabled the item to the second
meeting in January.

Relating to the adequacy of the amount of the letter of credit, Mr. Cook
reported that the apparent overage that was expressed in November, 1978, of
$200,000 has now grown to well in excess of $800,000. The Board requested that
Mr. Cook provide a letter regarding this information.
REQUEST BY SHANE FOR RIGHT-OF-WAY
It was noted that no further information or the $500 deposit to research
the requested right-of-way has been received from Mr. Shane. The matter was
tabled until such time as these requirements are met.
ANNEXATION PROCEEDINGS - POSSIBLE DIRECTION AND/OR ACTION RE RESOLUTION OF INTENT
Mr. Cook provided some historical data on the proposed Placer County Ser-
vice Area 19 annexation. He noted the next step is for the District to authorize
the filing of the annexation with Placer/Nevada County LAFCo.
Mr. Cook stated that it is essential that those facilities (in CSA#19)
that are not similar to those the District requires be made similar before the
annexation is considered.
Director Maass moved that the Board direct the Engineer to prepare the list

of conditions relative to what needs to be done before annexation in terms of up-
grading the system, source and storage fees, if appropriate, as well as an inven-
tory and resolution of intent for the January 21st meeting. Director Huber sec-

SOUTHSIDE WELL #2 - REPORT BY MANAGER
Mr. Seymour stated he felt it was in the best interest of the people of
the District to proceed with repair of the Southside Well #2 building concurrent-
ly with taking action against Mr. Roen.
Director Maass moved that the Board direct the Engineer to resubmit the
plans and specifications for the bidding proeess (and calling for bids) and that
the matter be placed on the January 7th meeting agenda (to replace the demolished
Southside Well #2 pumphou se) and further, that the Board direct the attorney to
file suit against Roen and Gregg Brothers and that the $8367.40 due on the con-
tract to Mr. Roen be held by the Board. Director Huber pointed out that it still
has to be determined whether or not the pump is good or will have to be replaced;
she thereafter seconded the motion. ROLL CALL: Hatch, absent; Huber, aye; Maass,
aye; Sutton, aye; Kuttel, aye. SO MOVED.
REVIEW AND POSSIBLE DIRECTION RE WATER USE ORDINANCE
After discussion by the Board, Mr. Cook summarized what he understood they
wished with respect to the water use ordinance: a report written in a format that
will assist the FmHA preapplication as discussed during the Manager's Report
and covering water available, water used and monthly reporting. The preliminary
draft outline prepared by Mr. Grumer was reviewed at length. Mr. Cook then clar-
ified that the Board desires individual subservice zones addressed in a mini re-
port fashion as was the case in the southeast subservice zone and the report of
1978.
Director Maass moved that the Board direct the Engineer, Manager and At-
torney to proceed on the draft water use ordinance in a "creeping-up" manner in
all haste - the matter is to appear on the agenda for the second meeting in Jan-
uary. The motion was seconded by Director Sutton. ROLL CALL: Hatch, absent;

ANNUAL REPORT
Director Sutton recommended that the Annual Report not be issued at the
present time under the present circumstances. The other Directors agreed.
ALLEGED SEPTIC SYSTEM FAILURE AT HILLTOP
Director Sutton made note of an alleged septic system failure at Hilltop.
Due to the close proximity of a District water source, she suggested that Mr.
Cook investigate the matter.
1977 MINUTES
In response to Director Sutton's question, Mr. Seymour advised that the
1977 minutes are approximately 50% complete. Mr. Seymour suggested that the
Executive Secretary outline the problem with their completion and report to the
Board.
SASSARINI PROPERTY
Relating to drainage into the Sassarini's basement from District tank or
spring overflow, President Kuttel advised that a trench has been placed to divert
the flow.
COMPLAINT PROCEDURE
Director Maass expressed concern about the length of time between filing
a service report with the District and investigation and repairs being done.
BOCA AND PROSSER DAM HYDROELECTRIC PLANTS - REVIEW OF FEASIBILITY STUDY; BOARD
DIRECTION
The Board requested that representatives of Tudor Engineering appear at a
meeting to go over the feasibility study with them.
TRUCKEE TOWNHOUSES; CONSIDERATION AND POSSIBLE APPROVAL OF FINAL PLANS
Mr. Cook advised that representatives of Truckee Townhouses would appear
at the January 7th meeting. At this time, materials and information requested
have not been received.

ENGINEER'S REPORT
Request to grant an easement - SAD#5
The District Engineer noted that an easement for one of the main collector
lines in SAD#5 should be executed before March. Further, he advised that this
location is the only possible one for the line.
The Board requested that Mr. Cook provide a written response as to whether
or not the best interest of the PUD is being served by granting this easement.
Also, he is to ascertain how much the Truckee Sanitary District will pay for this
acquisition.
DISTRICT COUNSEL'S REPORT
Mr. Grumer reviewed with the Board action he will be taking with respect
to the Garbutt matter.
CORRESPONDENCE
Mr. Seymour advised that the District has received correspondence respect

in security light agreements. The letter states that the costs noted in the
agreement signed cannot be changed unless both parties agree. The matter, by
Board consensus, was referred to Counsel for a written opinion.
PLANNING DEPARTMENT NOTICES
Respecting the Planning Department Notice for 180 condo units at the
northwest end of Donner Lake, Mr. Seymour stated that the Donner Lake Substation
is the least loaded at the present time.
Regarding both FHK and Martis Valley Estates #4, Mr. Seymour noted that he
and the Engineer must come up with specific conditions. The developers must be
ill the
advised that they will have to provide a facility fee that w re place
water in kind or drill the District a well, build the necessary system, and com-
ply with other District requirements.
PERSONNEL MATTERS
The Board did not feel it necessary to adjourn back into Executive Session.
Mr. Seymour advised that the Union members have unanimously rejected the contract
that was drawn up by the negotiating committee composed of two Union members,
the Union assistant business agent, Mr. Lloyd, Mary Chapman and himself. Direc-
tor Sutton suggested that a meeting between the Board, Manager and Mr. Lloyd be
held prior to further negotiations with the Union.
