HomeMy WebLinkAbout1979-09-05 Min - Board REGULAR MEETING September 5, 1979 The Regular Meeting of the Board of Directors of the Truckee Donner Public Utility District was called to order by President Maass at 7:01 P.M. in the Dis- trict Office. ROLL CALL: Directors Huber, Kuttel, Sutton and Maass were present. Director Hatch was absent. CONSULTANTS PRESENT: District Engineer Cook arrived at 7:04 P.M. ; District Counsel Grumer arrived at approximately 9:12 P.M. EMPLOYEES PRESENT: A. Milton Seymour and Susan Craig. OTHERS PRESENT: Among those present were Mike Clarke, Lisa Rea, Pat Seehutter, Bob Hanna, Ken Ames, Larry Kelly, Anne Kelly, Cecil Weise, Tim Ryan, Don Strand, Marge Adkerson, Kay Kibbe, Kathy Waymire, Roberto Natali, David M. Bakke, Tony Novarro, James Kuykendall, Craig McFarland and Ren Rice. APPROVAL OF MINUTES Director Kuttel moved that the Board approve the minutes of July 2 and July 16, 1979. Director Sutton indicated she had an addition to the July 16th minutes; however, Director Huber seconded the motion. Director Sutton stated there should be an addition to the July 16th minutes having to do with discussion of the interim surplus and permanent surplus water from the Airport Well. She moved to amend the motion to delete the approval of the July 16th final minutes. MOTION DIED FOR LACK OF A SECOND. ROLL CALL vote on the motion to approve the minutes of July 2 and July 16, 1979: Hatch, absent; Huber, aye; Kuttel, aye; Sutton, no; Maass, aye. SO MOVED. Director Sutton stated she would like to submit an addition, in writing, to the July 16th minutes to be attached to the minutes of this meeting. The Chair ordered that, when the corrections are submitted, they be attached to these minutes. President Maass noted corrections to the June 18, 1979, minutes were submitted by Director Sutton after the minutes of that meeting were approved in final form. Director Sutton moved that the corrections submitted, dated August 20th, be incorporated in the final copy of the June 18th minutes. MOTION DIED FOR LACK OF A SECOND. Director Huber moved that the corrections to the minutes of June 18, 1979, be attached to the minutes of this meeting. Director Kuttel seconded the motion. ROLL CALL: Hatch, absent; Huber, aye; Kuttel, aye; Sutton, aye; Maass, aye. SO MOVED. STATEMENT OF GENERAL FUND AND BILLS FOR BOARD APPROVAL In response to Director Sutton's request, Mr. Cook explained his billing in detail. During the course of his explanation he noted that Tupes Corporation, sub-contractor, had prepared reports relating to Prosser Well and exposure on groundwater resources. Director Sutton asked that she be provided with copies. Answering a question posed by Director Kuttel, Mr. Seymour advised that purchased power from Sierra Pacific last year at this time was approximately $114,000 as compared to $139,920.15 this year. Mr. Seymour reviewed a graph with the Board showing the kilowatt hours vs. kilowatt demand. Relating to the Blue Cross insurance billing, Mr. Seymour advised it was a premium adjustment. The policy was changed - the Union was not in agreement with that change - the former plan was reinstated and the District billed for the difference in premium cost. 915/79 pg. 1 Director Kuttel moved that the bills be paid. Not listed on bills presented for Board approval was Jim Lloyd's bill (Public Employer Personnel Consultants) totaling $1,106.68. Pursuant to the agreement reached at the September 4, 1979 Special Meeting, Director Kuttel moved that the Board approve payment of the bill in the amount of $1,106.68 to Public Employer Personnel Consultants. The motion was seconded by Director Huber. ROLL CALL: Hatch, absent; Huber, aye; Kuttel, aye; Sutton, aye; Maass, aye. SO MOVED. COMMITTEE REPORTS No committees have met since the last Board Meeting. MANAGER-IS REPORT Status of the District - Mr. Seymour reported that financially the District is fairly well off. There have been no significant power or water outages since the last Board meeting. The monthly water consumption figures for August are attached to the Manager's written report which follows these minutes. To help place the water consumption figures in perspective, Mr. Seymour reviewed with the Board a graph showing consumption for the past year and a half. He made note of a water leak under the Southern Pacific tracks - a late-night operation is planned to correct the leak. In order to inconvenience the fewest number of people, the work will commence at 2:30 A.M. and stop about 6:00 A.M. The District will abandon the water lines under the South Pacific tracks and reroute the water. The District is continuing to receive new applications for service at a record rate. It appears that the new electrical connections this year may well exceed 500 and that the total number of electrical customers will go above 4,400. Vandalism - Southside #2 Well - The Manager advised that, on the night of August "1 29th, somebody ran a large bulldozer through the Southside Well #2 pumphouse and virtually destroyed the installation. Although the pumphouse and well belong to the PUD, the work on the pumphouse, motor and pump was done under contract by C. W. Roen; the District had, on August 29th, not yet accepted the work which was not quite complete. Adjustors from Royal Globe opinioned that the bulldozer owner would ultimately be liable. Twelfth Biennial Conference on Ground Water - Mr. Seymour encouraged Directors who were interested to attend the Twelfth Biennial Conference on Ground Water to be held in Sacramento, California at the Woodlake Inn (9/20-21) . Also, at the same time at the Capitol Building in Sacramento a workshop will be put on by the California Energy Commission regarding load management. Sierra Pacific Power Company rate increase - For the benefit of members of the public present in the audience, Mr. Seymour provided background information on the rate case proceedings. The District and the City of Fallon have now respond- ed to Sierra Pacific's proposed compromise on the rate increase saying that the fuel clause adjustment will be accepted but stated that the demand charge should be higher and the energy rate lower. Sierra Pacific has responded to the Energy Commission relating -to these comments and has documented their proposed rate. REQUEST BY HOME BUILDERS TO ACCEPT TAHOE DONNER ELECTRIC LINES: POSSIBLE ACCEPTANCE OF ELECTRICAL DISTRIBUTION SYSTEM - UNITS 9 & 10, TAHOE DONNER Noting that there were several members of the audience interested in the acceptance of the electrical distribution system in Units 9 and 105 President Maass moved to this item. The item was placed on the agenda at Don Strand's request. Mr. Seymour reported that the District's inspector has completed his in- spection of Units 9 and 10 and has provided to Mr. Richards of Dart Industries a list of safety violations according to General Order 95 of the California Public Utility Commission. As soon as the corrections are made and the inspector has so verified, Mr. Seymour will recommend that the system in Units 9 and 10 be accepted. He anticipates this will be accomplished prior to the next Regular Board Meeting and will be placed on the agenda for that meeting. Both Directors Sutton and Huber expressed concern relating to acceptance of work in Units 9 and 10 prior to completion of the whole project (Unite 8 and 11 ). 9/5/79 - Pg. 2 1 Director Sutton requested that before the item is again placed on the agenda a report addressing the number of homes ready for occupancy and requesting hook- ups in each Unit be prepared. Mr. Strand indicated there were approximately 50 homes now ready to be connected to the electrical system. No direction was given relating to Director Sutton's request. Mr. Seymour reported that the contractor (Harker and Harker) is cooperating in clearing up the noted deficiencies; completion of the corrections is anticipat- ed within the next two weeks. He noted that he suspected the District inspector would be satisfied before the next Board Meeting as far as Units 9 and 10. Director Sutton expressed the desire to know how each Unit relates to the total system before a decision is made relating to acceptance of the Units sep- arately. The Chairman directed that the Manager provide such information to the Board. President Maass stated the item would be placed on the agenda for the next meeting for resolution. REPORT - DONNER HEIGHTS SUBDIVISION, UNIT NO. 1 - REQUEST BY PROPERTY OWNERS FOR ELECTRIC SERVICE - District Engineer Cook provided a map intended to show the Truckee Sanitary District easement locations which could possibly be used for power lines but it was determined that the wrong map had been copied; parcels of concern to those present at the meeting were not shown. A copy of the standard Grant of Easement form used by TSD was reviewed - the language, Mr. Cook noted, is somewhat restrictive for an extension of power lines. He stated he felt it would be neces- sary to approach the appropriate property owners between Reed and Denton Avenues and attempt to expand the existing sewer easement to cover the installation of a power pole. After discussion, Director Sutton moved that the Manager and Engineer proceed to contact the property owners adjacent to previous easements existing in the ,�. general area to find out if the District can obtain an easement for a power line from Pioneer to Denton. The motion was seconded and thereafter a ROLL CALL vote was taken: Hatch, absent; Huber, aye; Kuttel, aye; Sutton, aye; Maass, aye. SO MOVED. CONSIDERATION OF RECOMMENDATION BY SWQCB, LAHONTAN REGION, TO REQUIRE A FULL EIR FOR THE AIRPORT TRANSMISSION LINE AND RELATED FACILITIES Director Sutton made note of the letter relating to the Airport Transmission Line project received from the State Clearinghouse which included the attachment of a copy of correspondence from the Department of Transportation and the SWRCB. Attachments referred to in the Cal-Trans correspondence were not included in the mailing and she asked that such copies be requested from the State Clearing- house. President Maass noted he was not concerned about the attachments since Cal-Trans advised they had no major objections to the project. Marge Adkerson, Truckee Sanitary District Director, requested that our record reflect that no item relating to the Airport Transmission Line and Related Facil- ities has appeared on their agenda. The Chairman noted that, in essence, the Board has one comment before it - that one being from Lahontan. Jim Kuykendall of the State Water Quality Control Board, Lahontan Region, was present at the meeting. President Maass advised that, in correspondence directed to Mr. Hampson of the SWQCB dated August 27, 1979, an invitation to be present at the meeting and comments relating to the Airport Water Transmission Main were made. A copy of that letter has been at- tached to these minutes along with a copy of the correspondence from the State Clearinghouse (which includes the attached copy of a letter from the State Water Resources Control Board and the California Department of Transportation) . Director Huber moved, and Director Kuttel seconded the motion, that the Board adopt Resolution 7933 (adopting the Notice of Determination and directing the filing of same for the Airport Water Transmission Main and Related Facilities) . Director Sutton objected to Director Kuttel second4,hg the motion since he abstain- ed from the approval of the Negative Declaration because of possible conflict of interest. She stated that, if the Board is going to consider filing the Notice of Determination, it must respond in some way to the comments from any agency that it has received. These are the things, she stated, the Board should be taking into consideration. She stated she believes the Board has to make certain findings that she is not sure can be found (that the project does not have a cumulative effect unless mitigated) . Mr. Cook, responding to Director Kuttel's inquiry, explained the differ- ence between an environmental assessment and a full EIR. Discussion then ensued respecting distribution lines as compared to transmission lines, the growth issue - Mr. Seymour spoke of the legal, binding requirement of the District to serve water to all the people within its boundaries. Director Huber moved that the Notice of Determination of the Negative Declaration be filed with the County Clerk of the County of Nevada. Pres- ident Maass requested that this be done as Resolution No. 7933 adopting the Notice of Determination and directing the filing of same for the Airport Water Transmission Main and Related Facilities. Director Huber agreed. Director Kuttel seconded the motion. Responding to Director Kuttel, District Counsel Grumer clarified that, in his opinion, Director Kuttel has no conflict respect- ing this matter. AIRPORT TRANSMISSION LINE - DISCUSSION OF POSSIBLE PLACEMENT OF FIRE HYDRANTS DURING CONSTRUCTION - BOARD DIRECTION Mr. Cook reported that he had met with the Fire District; they went over the locations desired for downtown fire hydrants. These locations will be noted on the plans for Phase 4 and installed as part of the initial work. Mr. Cook noted that this matter should be discussed when the project plans are presented to the Board for approval - perhaps in two or three months. REVIEW OF COUNSEL'S OPINION LETTER RE DISTRICT-OWNED RESIDENTIAL PARCELS - CONSIDERATION AND POSSIBLE ACTION RE RESOLUTION Mr. Grumer indicated that he has been able to find no record of the District declaringthe ten i` parcels surplus. Therefore, the resolution adopted should declare the parcels surplus, require notice to appropriate agencies and provide for a 60-day period in which an agency may purchase said parcels. Discussion ensued relating to the location of the parcels. Regarding parcels "f" and "G" , Mr. Cook was asked to establish whether or not there is access. Director Sutton moved, and Director Kuttel seconded the motion, that the Board delay action of the proposed resolution declaring five parcels unnecessary for District use and authorizing their sale until the District Engineer has provided information regarding access to parcels "F" and "G" and located north of Rocky Lane in Meadow Lake Park. ALL AYE BY VOICE VOTE. SO MOVED. REVIEW OF ENGINEER'S RECOMMENDATIONS RE CATEGORICAL EXEMPTIONS FOR PROPOSED EMERGENCY IMPROVEMENTS IN THE SOUTHSIDE AREA IN ACCORDANCE WITH ADOPTED CEQA GUIDELINES The Board discussed Project 79-1 water system improvements. It was Mr. Cook's recommendation that the improvements be declared exempt from CEQA he provided a draft resolution and Notice of Filing that would effectuate the recommendation. Director Sutton stated she felt the District should go through the entire environmental process. The District's CEQA Ordinance was discussed and Mr. Cook spoke to the various projects he was recommending for exemption from CEQA. Director Kuttel moved that the Board postpone this item until the Engineer has had the opportunity to recheck the matter. At this point, District Engineer Cook requested specific direction if this motion passed. MOTION DIED FOR LACK OF A SECOND. Director Sutton moved that the Board direct the District Engineer to reexamine. . .the motion was not completed. Director Sutton stated that what she wanted was to have an environmental assessment of the five projects. Therefore, she moved that the Board authorize the preparation of an initial 9/5/79 pg, 6 study and environmental impact assessment on the five projects known as Sched- ules A, B, Cr D and E because it would be in the best interest for them not to be considered categorically exempt. Mr. Cook advised that it would simplify his job if such report and environmental documents were prepared on all the Schedules instead of just those mentioned by Director Sutton. DIRECTOR SUTTON WITHDREW HER MOTION. Director Sutton moved that the Board authorize the preparation of an initial study and environmental impact assessment on elements in the project which are known as Schedules A through G and for which the Board hopes to i receive funding from FmHA. Director Sutton moved that the problem of the recommendation on categor- ical exemption and the motions that have been unsuccessfully made be turned back for some resolution by the Engineer. STATUS REPORT - REMODELING OF DISTRICT OFFICE - CONSTRUCTION OF NEW BOARD ROOM Mr. Seymour suggested that Mr. Cook be asked to provide a cost estimate and plans for an entirely new District office building - possibly to be built adjoining the existing building. The Directors accepted his suggestion and r--- asked that Mr. Cook do so and report back to the Board. CONSIDERATION OF RESOLUTION DECLARING CERTAIN INVENTORY, MATERIALS AND OFFICE EQUIPMENT SURPLUS AND ISSUING A CALL FOR BIDS Relating to office equipment, Director Sutton moved that the dictaphone listed as surplus (which was used to record long-ago Board Meetings and is necessary to listen to those particular recordings) be deleted from the surplus items, and that the Board adopt the resolution declaring inventory, materials and office equipment surplus (No. 7934) - bids received will be opened by the Manager on November 2, 1979, at 4:00 P.M. SAD#5 STATUS REPORT; POSSIBLE ACTION RE CONSTRUCTION AWARD Mr. Cook presented to the Board a bid summary on the SAD#5 construction. He noted that the Sanitary District passed a resolution recommending the 9J5_/79 Pg. 7 award of the contract to Hood - he requested, if the Board is so disposed, that a resolution similar in form be considered and delivered to the Nevada County Board of Supervisors. They are requesting 36 fixture units which, according to District standards, requires an 1 meter - the service for the structure should be an Southside Well No. 2 - The District Engineer provided the Board with copies of the Sheriff's investigation report and the Contractor's Obligations under the Specifications. He noted that appropriate notice has been given to the contractor, insurance company and FmHA.
