July 24, 1987
The special meeting of the Board of Directors of the Truckee Donner Public
Utility District was called to order by Vice President Sutton at 10:07 A.M.
at the Truckee Donner Recreation and park District Board room.
ROLL CALL: Directors Aguera, Maass and Sutton were present. Directors
Cooley and Corbett were expected.
EMPLOYEES PRESENT: Debi Black, Tom Buckhouse, Peter Holzmeister and Susan
Macdonald.
CONSULTANTS PRESENT: Consulting Engineer Dan Cook and Counsel John M.
Phelps.
OTHERS PRESENT: Tony Rivara and Cindy Austin.
HIRSCHDALE WATER SYSTEM IMPROVEMENTS -- DISCUSSION AND POSSIBLE DIRECTION
Consulting Engineer Dan Cook explained that Aqua Drilling was the low
bidder for drilling the test hole and well for the Hirschdale water system
and noted they are having difficulty complying with the bonding and
insurance requirements; at this time they have not met the contract
provisions and are in default. The second lowest bidder was not yet
licensed in California at the time of the bid opening.
At this point in the meeting, Director Corbett arrived.
Mr. Cook suggested that the Board rebid the entire project with three
schedules, Schedule A, the test hole; Schedule B, completion of the well;
Schedule C, the pump, tank and distribution system. Upon completion of
Schedule A, the water quantity and quality should be checked. If
satisfactory, the notice to proceed on Schedules B and C should be issued.
Prior to going out to bid the Board should decide how to handle the payment
for bonds and insurance. This can be a separate line item or without
separate payment. It will also be necessary to resolve the
Rodrigues/Rivara rights-of--way issue.
Estimates for the work are as follows: Schedule A, $7,000; Schedule B,
$28,000; Schedule C, $225,000; Bonds, $4,000; Insurance, $2,000. Mr. Cook
suggested rebidding the project on August 3, opening bids on September 3,
awarding the bid at the regular meeting on September 8.
After some discussion, Counsel Phelps recommended that the Board declare
Aqua Drilling in default and reject the other bids received on the
Hirschdale project. Director Maass moved that the Board find Aqua Drilling
in default and move on. MOTION FAILED for lack of a second. Director
Sutton said she does not think this requires Board action since staff
already deposited Aqua's security deposit; this should negate the contract.
She went on to say she doesn't want staff taking action of this nature
in the future without the Board's involvement.

Director Maass moved that the Board declare Aqua Drilling in default and
reject the other two bids received on the first call for bids on the
Hirschdale project; seconded by Director Sutton. ROLL CALL: Cooley,
absent; all other Directors, aye. SO MOVED.
Director Maass moved that the Board ask Mr. Cook to prepare the appropriate
documents relative to rebidding the Hirschdale project as outlined, and
that several options as to how to handle bonding and insurance be included.
The motion was seconded by Director Aguera, ROLL CALL: Cooley, absent;
all other Directors, aye. SO MOVED.
Director Maass moved, and Director Aguera seconded, that the bid deposit
made by Aqua Drilling be placed in the Hirschdale construction account.
ROLL CALL: Cooley, absent; all other Directors, aye. SO MOVED,
ADJOURNMENT
There being no further business before the Board, Director Maass moved that
the meeting be adjourned at 11:04 A.M. The motion was seconded and passed
unanimously.
