Subject: Consideration of a Resolution Accepting Final Completion of the
SCADA Reliability Improvement Project Phase 2
1. WHY THIS MATTER IS BEFORE THE BOARD
The SCADA Reliability Improvement Project - Phase 2 is complete. A closeout
change order and a resolution accepting the project as complete require Board
approval.
2. HISTORY
The scope of this project involved the installation of optical communications cable and
equipment from the District offices to Richards Drive Pump Station, Donner Lake
Tank, West Reed PRV, and the Wolfe Estates Hydro Station. The Board awarded the
construction contract on June 6, 2012 to Terry Hansen Electric, in the amount of
$236,710 with a 10 percent change order authorization, for a total not to exceed
project amount of$260,381.
3. NEW INFORMATION
During the course of the project, two change orders were reviewed and approved.
These change orders totaled $10,887.50 and did not exceed the change order
allowance established by the Board. The items covered by these change orders
included the following:
Change Order No. 1 (September 25, 2012): The actual field conditions encountered at
Richards Drive Pump Station were different than as shown on the contract drawings.
To accommodate the placement of a communications box, the final location had to be
moved which required the repair of existing conduits and additional new conduit
installation work not covered by the original bid items. These costs totaled $3,350
(Attachment 1).
Change Order No. 2 (January 29, 2013): During the course of the project, it was
necessary to perform some additional excavation work that was not covered by the
original bid items. This work included over-excavation at three locations necessary to
intercept and connect to existing conduits which were buried at depths lower than
anticipated. These costs totaled $7,537.50 (Attachment 2).
In late March, 2013 the District performed a final inspection of the project. District
inspection revealed multiple deficiencies with the installed cable which did not meet
the specifications. On April 17, 2013, the District notified the Contractor that the work
performed was not compliant with the contract. The District requested written
assurances that the project would be completed in accordance with the contract and a
remediation plan to correct the deficiencies. The Contractor did not respond
adequately or in a timely manner to our request. The District therefore notified the
Contractor on May 1, 2013 that they were in default and the District was terminating
the contract. The District met with the Contractor and their surety company on May 6,
2013. At this meeting the Contractor acknowledged that its work to-date was non-
compliant with the contract. After receiving an acceptable remediation plan, the District
and the Contractor signed Addendum No. 1 on June 3, 2013. Addendum No. 1
effectively rescinded the previous contract termination notice and re-established the
original contract supplemented by the stipulations of Addendum No. 1 and the
Remediation Plan.
In October, 2013 the District performed a inspection of the remediated project. District
inspection again revealed many deficiencies with the installed cable plant which did
not meet the specifications. On October 15, 2013, the District notified the Contractor
that the work performed was not compliant with the contract. Despite assurances to
the contrary through November, the Contractor verbally informed the District early in
December and finally later by a letter dated December 23, 2013 that they were
complete with the project and would perform no more work. Due to the remaining
deficiencies and the Contractor's exceptionally poor performance record, the District
requested a preliminary quote to perform the necessary testing and repair work to
address the remaining deficiencies from Curtis and Sons, the SCADA Reliability
Improvement Project - Phase 3 Contractor. Based on the quote, the Board in
December, 2013 approved an increase in the change order allowance for the Phase 3
project necessary to correct the remaining deficiencies and complete the work of this
project (Attachment 3).
Staff is requesting a closeout change order (Change Order No. 3) to resolve the
remaining project issues. The items covered by this change order include the
reconciliation of bid quantities vs. actual installed quantities. The contract is based on
a unit price bid. Attachment 4 depicts the differences between bid totals and the
amount actually installed. This analysis results in an increase of $17,663.30, mainly
due to the installation of an additional communications vault required by the project.
This analysis also results in a decrease of $31,315, mainly due to the value of the
remaining unfinished work not being performed by the Contractor. The net result oll
Change Order No. 3 is a decrease in the amount of $13,651.70. The total of the three
change orders results in a $2,764.20 decrease in the contract for an overall final
contract amount of $233,945.80 as shown on Attachment 4. A draft Resolution
accepting the project and directing that a Notice of Completion be filed is included as
Attachment 5.
4. FISCAL IMPACT
With the authorization of closeout Change Order No. 3, the final project accounting is
shown in the following table:

The original contract amount was $236,710. Once adjustments are made for the items
described above, the final contract price will be $233,945.80, which is $2,764.20 below
the original contract amount.
5. RECOMMENDATION
a) Authorize Contract Change Order No. 3 to the SCADA Reliability Improvement
Project - Phase 2 in a deductive amount of$13,651.70.
b) Adopt a Resolution 2014-04 accepting the SCADA Reliability Improvement
Project - Phase 2 as complete and authorize the filing of the Notice of

This letter is notice of a Change Order. Due to field conditions and improper installation of
facilities, a series of changes are required at Richards Drive Pump Station. At the time of
installation, the Contractor connected the new communication box to the wrong conduit.
Instead of using the conduit stub specified in the Contract Documents, the Contractor made
connection to a conduit which bypasses the station. Additionally, the B3048 box was Installed
with only one extension and the top of the cover was not at the right elevation. Per drawing
UBOX-S4, a communication box consists of one (1)B3048 box and two (2)extensions, In
addition, per Contract Section 16801, Paragraph 3.3.A states "The CONTRACTOR shall install
the communication vaults and boxes such that the top of the vault or box cover in paved areas
is approximately 1/2-inch below the restored pavement...".
The District agrees to negotiate payment for the following:
1. Removal of the B3048 box with one extension;
2. Removal of sweeps and repair of continuous conduit.
-The District will not pay additional moneys for the trench and conduit installation across the
pump station driveway to pick up the conduit stub, as it was included In the original Contract
Documents.
Prior to proceeding with the work described in these documents, please submit an itemized,
detailed invoice which spells out all costs associated with this work The change order is not
valid until complete and signed, and no additional payment is authorized without signatures.

SUBJECT:FIELD CHANGE#1 FOR SCADA RELIABILITY IMPROVEMENT PROJECT—PHASE 2
This letter addresses field changes associated with conditions within the boundaries of the Donner Lake
Substation. The 12ct. and 96ct. fibers shall be installed between Work Locations 33, 34, and 44 in accordance
with the attached drawing described as follows:
1. The original conduit routing indicated in the gray cloud shall be deleted from the Work. This includes
approximately 162' of 12ct. and 177' of 96ct.underground fiber cable from the B3048 box(WL 33)to
the risers(WL 34 and 44). The two pole risers on the north side of the substation and as shown on the
communication riser drawings for Work Location 34/Pole 77019901 and Work Location 44/Pole
76709907 shall be deleted from the Work.
2. Install 12ct. and 96ct. fiber as indicated on the attached drawing by the red and orange lines,
respectively. Install both cables underground from the B3048 box(WL 33)to the pole approximately
20' southwest(WL 33A). This work is indicated with dashed lines. The riser shall be constructed in
accordance with WL 34 and WL 44 requirements. Install both cables overhead for 3 spans(WL 33A,
33B, and 33C)for a total of approximately 195' to Work Location 44, The 12ct.fiber shall be installed
one additional 35' span overhead to Work Location 34.The overhead work is indicated with solid red
(12ct.)and orange lines(96ct.).
3. Fiber installations other than those described in this package shall be installed per the Contract
Documents.
It is expressly agreed that these field changes do not constitute a Change Order and shall be accomplished by
Terry Hansen Electric without substantially impacting the project schedule. Compensation for changes shall be
made through the final accounting of bid versus actual quantities installed,per the Bid Schedule. Please
acknowledge and indicate your agreement to these changes by signing below and returning a copy of this letter
to the District.

Subject: Consideration of an Increase in the Change Order Authorization for
SCADA Reliability Improvement Project - Phase 3
1. WHY THIS MATTER IS BEFORE THE BOARD
Board approval is required to increase an authorized change order allowance.
2. HISTORY
The SCADA Reliability Improvement Project - Phase 2 was awarded to Terry Hansen
Electric (THE) on June 6, 2012. During construction of this project, THE encountered a
number of difficulties. Ultimately, this led to the District filing a Notice of Default on
May 1, 2013. Subsequent to this notice, the District negotiated an acceptable Contract
Addendum and Remediation Plan with THE and their surety company. This addendum
was issued on June 7, 2013.
On August 7, 2013, the Board awarded the contract for SCADA Reliability
Improvement Project - Phase 3 to Curtis and Sons (CSC) in the amount of $328,041,
plus a 10% change order authorization for an amount not to exceed $360,845.
3. NEW INFORMATION
Terry Hansen Electric (THE), the Phase 2 contractor, has verbally indicated that they
will do no further work associated with that project. Upon inspection, there are
deficiencies which need to be addressed for project completion. Staff proposes
negotiating a deductive change order with THE for this work and closing the project.
Staff anticipates presenting the Phase 2 closeout at the January 15, 2014 Board
meeting.
Construction is currently underway for the Phase 3 project. Change orders have been
issued to address needed changes to the project scope. The executed change orders
total approximately $14,000.
Staff proposes to transfer the remaining work associated with the Phase 2 project to
CSC. This change will require an increase in the change order allowance for Phase 3.
The scope of this work includes retesting approximately 150 fibers and performing
necessary repairs.
4. FISCAL IMPACT
CSC has submitted an estimate for this work of $44,526. Staff is requesting an
increase of $50,000 to the change order allowance. Sufficient funds exist in the
Electric Capital budget.
5. RECOMMENDATION
Authorize an increase in the change order allowance to Curtis and Sons for SCADA
Reliability Improvement Project - Phase 3 from $32,804 to $82,804, for a project total
not to exceed $410,845.
