WHY THIS MATTER IS BEFORE THE BOARD This item recommends that three District owned parcels be declared surplus. Only the board can declare property surplus. 2. HISTORY In the Agreement for Acquisition of the Glenshire Water System by TDPUD, land was conveyed to the District. The agreement states that the District would sell said land at such time as it is no longer needed. The District is required to follow a specific process prior to selling land. The process set forth in the law requires that we send a written offer to sell or lease the parcel to the following public entities. The offer needs to be sent by first class mail and must include the location and description of the property. 1. Town of Truckee—offer to sell or lease for purpose of developing low-and moderate- income housing 2. Truckee Donner Recreation & Park District—offer to sell or lease for park and recreation purposes or open-space purposes. 3. State Resources Agency—offer to sell or lease for park and recreation purposes or open- space purposes. 4. Tahoe Truckee Unified School District—for school facilities construction or use by a school district for open-space purposes. Following is a sample letter, drafted by Steve Gross, for our use: The Truckee Donner Public Utility District hereby offers to sell or lease the property located at(location and description of the property) to the (name of agency) in accordance with California Government Code Section 54222. If your agency desires to purchase or lease the property, please notify the Truckee Donner Public District in writing within 60 days after receipt of this notification. If your agency does not notify TDPUD of its desire to purchase or lease the property, the property may be sold or leased to another agency or person. If you have notified TDPUD of your desire to purchase or tease the property, the TDPUD will enter into good faith negotiations with your agency, and any other agency expressing its desire to purchase or lease the property as required by Section 5422Z to determine a mutually satisfactory sales price or lease terms. If the price or terms cannot be agreed upon after a good faith negotiation period of not less than 60 days, the property may be disposed of to another person or agency. Please contact Kathy Neus at 530-582-3922(e-mail: kathvneus(7a tdpud.org) with any questions. 3. NEW INFORMATION We are close to bringing the upgraded Glenshire well on line. Once that happens we will formally abandon the wells in Glenshire. That will enable us to sell the land. The proceeds of the sale of land will be used to help defray the cost of the water improvements in Glenshire. We plan to make improvements in Glenshire this summer, so we need the cash from sale of land as soon as possible. Attached for your review is a map showing the location of the parcels that we suggest be declared surplus. The three parcels are: a) The .75 acre lot located on Manchester, APN 49-280-02 b) The 3.45 acre parcel located at 14629 Glenshire Drive, APN 49-011-29 c) The 4.17 acre parcel located at 14630 Glenshire Drive, APN 49-011-31 4. RECOMMENDATION It is my recommendation that the Board adopt the attached resolution and declare three parcels as surplus and authorize the General Manager to offer the surplus District-owned land for sale following the process set forth in law. tliii Public District Resolution No . 2003- XXX Directing that certain District owned properties be declared surplus property WHEREAS, the District owns the following parcels of real property in Truckee, Nevada County, California: (1) .75 acre lot located on Manchester, APN 49-280-02; (2) 3.45 acre parcel located at 14629 Glenshire Drive,APN 49-011-29; (3)4.17 acre parcel located at 14630 Glenshire Drive,APN 49-011-31, as shown on the maps attached hereto as Exhibit "A° and, WHEREAS, the above described parcels of real property will be surplus once the Glenshire Drive well upgrade is completed and is on line, and the existing Glenshire wells are properly abandoned; and WHEREAS,the District could dispose of the above described parcels and utilize the funds from the sale of said parcels to offset the cost of the Glenshire water system improvements project. NOW,THEREFORE, BE IT RESOLVED that the Board of Directors adopts the above recitals as its findings; and BE IT FURTHER RESOLVED that, for the reasons set forth above, the Board declares the above described parcels of real property as surplus property; and BE IT FURTHER RESOLVED that the District comply with the applicable statutory requirements for the disposal of surplus property and actively pursue disposal of the above described parcels of real property.
