We want to bring you up-to-date about various aspects of the important new Federal backstop for terror-
ism legislation that President Bush signed into law Tuesday, November 26.
There are implementation requirements that need our mutual immediate response to make sure that as
business partners we fulfill our obligations under this important new law. Failure to comply with these
mandates can result in significant monetary penalties and eopar6ze participation in the Federal
program.
Who Is Covered
T he law applies to all commercial lines of Property and Casualty insurance, including Excess,
Workers' Compensation and Surety, with only a few minor exceptions. It does not include life or
health insurance, reinsurance, medical malpractice insurance or personal lines.

Availability of Terrorism Coverage
Until December 31, 2004, covered insurers must make terrorism coverage available in all
commercial Property and Casualty insurance policies. Existing terrorism exclusions may be
reinstated only under limited circumstances:
• An insurer has received a written statement from the insured that affirmatively authorizes the rein-
statement; or
• An insured has failed to pay any increased premium charged for terrorism coverage and the in-
surer has provided notice at least 30 days prior to reinstatement of (a) the increased premium for
the terrorism coverage and (b) the insured's rights with respect to the coverage, including the date
the exclusion will be reinstated if no payment is received.

• For new and renewal business policies issued March 1, 2003 and beyond, the no-

will be provided to the necessary parties.
Rates for Terrorism Coverag
Although the Federal law does allow premium charges for the coverage, it does not preempt
state authority to ultimately approve or not approve the amount charged.
Initially, we will not include an additional charge for terrorism coverage on business that previously was
written without the terrorism exclusion. This will enable us to provide the notices on a timely basis, and
secure additional insight into the expedited filing process and the availability of advisory organization
loss costs, Once we have a better understanding of these factors, we will determine what premium is
appropriate.
For certain other accounts where coverage previously has been excluded or currently charged
for New York Workers' Compensation, we anticipate immediately charging (or continuing to
charge) a premium for terrorism coverage. The appropriate premium(s) to be charged for
these policyholders will be determined in the very near future, if it already established and
communicated to all necessary parties.
