Why this matter is before the board: This matter recommends that the board adopt a resolution establishing a policy governing annexations. Only the board can adopt a resolution. 2. History: During a recent Board meeting we discussed annexation of a parcel in Placer County into our District. I was directed to prepare a draft policy for the Board's consideration that would govern the process of annexing property. 3. New information: Attached is such a draft policy. It provides for the following: 1. It states that it is the intent of the District to serve all property within our territory and within our Sphere of Influence. 2. It requires the approval of LAFCo before we serve property outside our territory. 3. It requires the applicant to pay the cost to process an application at LAFCo 4. It requires District staff to prepare a report for the Board's consideration stating that either there is sufficient capacity in our system to serve the applicant, or the applicant must provide for the construction of facilities necessary to serve the project. We have been annexing parcels into the District in recent years. The eastern portion of Glenshire is a fairly large area that was recently annexed into the District. There have also been a few small areas in Placer County on Highway 267 (Brockway Road)that have been annexed. As stated in the first sentence of this memorandum, there is another small property in Placer County that is now applying to us for water service. Attached is a map showing the location of this new applicant. If the board approves the draft annexation policy we will follow its provisions in bringing this application to the Board for review and action at the next meeting. 4. Recommendation: I recommend that the Board adopt the resolution establishing the policy governing annexations. ! e w O M Public ik R solu ion No . 2003- XXX District Establishing a Policy Governing the Annexation of Property to the District WHEREAS the District provides water and electric service to residences and businesses within its territory; and WHEREAS the District has prepared a Sphere of Influence map which has been approved by Nevada and Placer County Local Agency Formation Commissions; and WHEREAS the intent of a Sphere of Influence map is to identify areas in which it would be reasonable for the District to provide service as those areas develop and require service; and WHEREAS from time to time owners of parcels in our Sphere of Influence apply to the District for service; and WHEREAS the District currently has no formal policy governing the process by which it will proceed with annexation of parcels NOW, THEREFORE, BE IT RESOLVED by the Board of Directors as follows: The following policy is adopted CHAPTER 5.53 ANNEXATION OF PROPERTY TO THE DISTRICT 5.53A. It is the intent of the District to serve water and electric service to all properties within its territory and within its approved Sphere of Influence 5.53.2. An applicant for electric or water service whose property is not located in the District's official territory will be served by the District only under the following conditions; a. The property must be located within the District's approved Sphere of Influence. b. The property owner must agree to being annexed into the District's territory and pay all costs to process the application through the appropriate Local Agency Formation Commission (LAFCo). c. The District must evaluate and find that there is sufficient capacity within the water or electric system to provide service, d. If the District finds that there is not sufficient capacity in the existing water or electric system to provide service, the applicant must agree to construct or pay for construction of the necessary facilities as determined by the District to provide service. 5.53.3. Any application for annexation initiated under the terms of this policy shall be approved by the Board of Directors. District staff shall provide a report to the Board containing the following: a. Identification of the parcel or parcels to be annexed; b. Stating whether said parcel or parcels are within the District's Sphere of Influence; c. Stating whether sufficient capacity exists in the District system to provide service, or demonstrating that the applicant has agreed to pay for construction of the necessary facilities; d. An executed agreement committing the applicant to pay the costs of processing the application through LAFCo. 5.53.4. Properties that are outside the District's territory will be served only after receiving approval from the appropriate LAFCo PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within the District on the day of , 2003 by the following roll call vote: AYES: NOES: ABSENT: TRUCKEE DONNER PUBLIC UTILITY DISTRICT J.
