Why this matter is before the board: Approval from the Board of Directors is necessary to issue a Change Order to a constrcution contract. 2. History: The Board previously awarded the District Pipeline Replacement - 2004 project to Herbert Suter Construction (HSC). On June 16, 2004, the Board approved Change Order No. 1. That Change Order covered issues encountered from the project start through June 4, 2004. 3. New information: I am requesting a Change Order to the Contract for issues covered under five general items that will cover all of the outstanding issues encountered from June 5 to August 5, 2004. Please note that District staff is currently conducting an audit of timecards and certified payroll on this project. it is possible that the amounts given here will be revised based upon that audit_ Item 1: There are five locations where old deteriorated pipelines were leaking to the extent that it was necessary to repair them before installation of the new pipeline could continue. At these locations, the District directed HSC to excavate the old pipe and perform repairs. There are also other locations where the old pipes were leaking but the quantity of water was manageable and only created a nuisance. HSC is due $34,111.56 for these repairs. Item 2: Rock was encountered at four locations in Tahoe Donner along Sun Valley Road and Lucerne Lane. Removal of this rock from the trench and off-haul of the rock for disposal falls into the Contract's rock excavation clause. HSC is due $14,687.50 for rock excavation. Item 3: On Parsenn Road, it was necessary to install a blind flange near the tie-in point of the old and near piping. This blind flange was inadvertently omitted from the Contract Drawings and was not included in the Bid. On Highway Drive near Donner Pass Road, District maps show two existing pipelines. One that was installed in 1991, and an older pipe that was installed in the Page 1 ........ ............... ... . ...... ............ ......... ...................... ........ .......... .... .. . ... .. ... .... ....... ..... .... . "'Y,"", ...... ................ . . ........ 1960s. The old maps show the 1991 pipe to located east of the older pipe. The Contract Drawings call for the new pipeline to be stopped about 10 feet short of the planned tie-in to the 1991 pipe due to a perceived vertical conflict with the older pipeline. The older pipeline will be abandoned once the Richards Pump Station becomes operational, so it was assumed that a section of the 1960s pipe could be removed to accommodate the tie-in at that time. Once construction began, it was discovered that newer pipe is actually to the west and the tie-in could accomplished as part of this project. Therefore, HSC was directed to perform this tie-in work. These design changes resulted in extra work totaling $13,365.60. Item 4: On Christie Lane, there was an existing service that needed to be relocated. However, District personnel were unable to find the service using pipe location equipment. HSC spent about 3 hours performing exploratory excavations before it was located. HSC is due$1,116.00 for this work. Item 5: On Lucerne Lane, there was an existing service that interfered with construction of the existing pipeline. it was necessary to relocate this service in order to accommodate the new pipeline construction. It was originally planned to perform this work with a District crew, but that was not possible due to other priorities. Therefore HSC was directed to perform this work and is due$3,510.05 4. Recommendation: I recommend that the Board authorize Contract Change Order #1, in the amount of a $66,790.71 payment to Herbert Suter Construction from the District. The Contractor shall construct, furnish equipment and materials, and perform all work as necessary or required to complete the Change Order Items for a lump sum price agreed upon between the Contractor and District. The undersigned Contractor approves the foregoing Change Order as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Change Order. The Contractor agrees to furnish all labor and materials and perform all other necessary work, inclusive of the directly or indirectly related to the approved time extension, required to complete the Change order items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Change Order shall be effective when approved by the District.
