Why this matter is before the board: This matter involves consideration of the salary scale for management and exempt employees. The board sets salary scales for that group of employees. 2. History: The board has established a salary scale for management and exempt employees. I am authorized to place employees at a point within that range based on my judgment. The idea is that the scale would be reviewed periodically to keep it current with comparable salaries. No salary adjustment has been adopted for this group of employees since January 2003. Normally this matter would be presented to the Board in January. However, we spent many months dealing with pension issues, so the salary adjustment matter was postponed. We have an agreement with the IBEW Local 1245 regarding hourly wages for employees for 2004 which calls for a 3% increase, plus various equity wage increases to let them catch up with the wages paid in comparable organizations. I am suggesting that the salary scale for management and exempt employees also be increased by 3% for 2004. 3. New information: I would like the board to consider increasing the management and exempt salary scale by 3%. A copy of the current and proposed salary scale is attached. We have assembled a group of superb professionals and they perform extremely well in a busy environment. I believe they should be recognized for their dedication. 4. Recommendation: I recommend that the board adopt the amended salary scale for management and exempt employees affecting a 3% increase, retroactive to January 1, 2004. I indicated to Mrs.Sutton that I would take it under advisement. I have discussed the issue with Peter and staff and what follows is a summary, prepared by staff of a recap of information regarding the issue. Summary: During the week of July 12th, the District's contractor for the Donner Lake Pipeline—2004 project caused some brush and slash material to be deposited in a wetland area. This is not permitted. During that week staff received a phone call from Scott Ferguson of the Lahontan Regional Quality Control Board regarding this matter. The following week, the District's environmental consultant Glenn Merron investigated the problem. On July 16, Glen directed the contractor on how to proceed with the site clean-up. Glenn prepared and submitted a report to Scott Ferguson detailing the wetland impact and the clean-up effort. On August 9th, District staff forwarded a copy of this report to every Director. Emilie Kashtan, a Donner Lake Homeowner and activist complained to our General Manager and a meeting was scheduled with Ed Taylor on August 181h. Ed and Emilie spent 2 hours discussing every element of the Donner Lake project. Emilie claimed that another wetland was impacted and presented a photograph as documentation. After careful review, staff determined that this other wetland that Emily claimed to have been disturbed was in fact the same site that was initially reported. This determination was made by comparing Emilie's photograph with photographs taken by Glenn Marron and presented in the report. Mr. Ferguson of Lahontan agrees that another wetland is not involved. This other area that Emilie is concerned about is not a wetland. It is characterized as a seam of underground fractured rock that allows water to move through it. We are proposing to maintain this underground flow of water by backfilling the trench with pea gravel where it crosses the fractured rock seam. This should allow the underground flow to follow its natural course. Again,this is not a wetland and there is a solution to the water flow issue. At the August 18th board meeting, Mrs. Kashtan presented her argument to the Board and requested that her concerns be agendized at an upcoming meeting. Ed Taylor felt that Mrs. Kashtan's comments at the board meeting did not reflect the conversation at their meeting. District staff reviewed every element of this project. Each element was then brought to the Board for approval. I do not see the need for the Board to discuss this matter again, and therefore I do not pan to place it on the agenda. If two Directors in addition to Mrs. Sutton wish to have this matter agendized please contact Peter no later than 10 AM this coming Friday morning.
