HISTORY: There is an existing 10-foot wide public utility easement along the rear property line of 10323 Donner Trail Road (APN 18-683-01) NEW INFORMATION: The owner of the parcel has requested that the 10-foot wide public utility easement along the rear of the property line of 10323 Donner Trail Road be abandoned. There are not any existing water or electric system facilities located within this easement. Neil Kaufman and Joe Horvath do not foresee the need to construct water or electric facilities along this easement in the future. RECOMMENDATION: The Board of Directors adopt a resolution officially abandoning the 10-foot wide public utility easement along the rear property line of 10323 Donner Trail Road. APPLICANT/ OWNER: Stacey Tedsen PROJECT DESCRIPTION: The applicant is requesting approval of the abandonment of the existing 10-foot wide public utility easement located along the rear of the property(eastern property line). The existing upper level deck encroaches into the 10-foot public utility easement. The applicants are requesting the easement abandonment as the first step towards bringing the property into conformity. The above-referenced application has been submitted to for review to the Community Development Department, Planning Division. Please review the requested parcel merger and abandonment, complete the attached comment sheet and return your comments by Monday. October 25, 2004, to the Community Development Department, Planning Division, 10183 Truckee Airport Road, Truckee, CA 96161. Please provide any additional comments or information you may have on the requested abandonment. If you have any questions, please contact, Stacy Wydra, Assistant Planner, at (530) 582-7820. If no response is received from your agency, we will assume that you have no concerns. Community Development Department IC183 Truckee Airport Road Truckee, California 96161 R solu ion No. 2004 - XX AUTHORIZING AN ABANDONMENT, AS TO ITS INTEREST, OF THE PUBLIC UTILITY EASEMENT ON APN 16-683-01 WHEREAS, Stacey Tedsen through the Town of Truckee has requested abandonment of a 10-foot wide public utility easement along the rear of the property line of 10323 Donner Trail Road, Truckee (APN 18-863-01); WHEREAS, District staff has investigated the matter and determined that such abandonment would not cause the District problems in providing electrical or water service; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: That the President of the board be authorized to execute a statement indicating that the Truckee Donner Public Utility District has no objection to the abandonment of the above-described public utility easement as shown on the attached map, which has been entitled Exhibit "A".
