Why this matter is before the board: Approval from the Board of Directors is necessary to issue a Change Order to a construction contract. 2. History: The Board previously awarded the Donner Lake Pipelines-2004 project to Jurin Construction. On August 4, the Board approved Change Order No. 1 that covered all outstanding issues from the project start through June 2, 2004. On August 18, the Board approved Change Order No. 2 that covered all outstanding issues from June 3 through August 6, 2004. On September 15, the Board approved Change Order No. 3 that covered all outstanding issues from August 7 through September 3, 2004. On October 18, the Board approved Change Order No. 4 that covered all outstanding issues from September 4 through October 10, 2004. 3. New information: I am requesting a Change Order to the Contract for issues covered under six general items that will cover most of the outstanding issues encountered from October 11 through November 12, 2004. There is one outstanding issue related to work performed during the October 11 through November 12 period that has not yet been resolved. Please note that all of the work covered under this Contract has not been completed and work has been suspended for the Winter since the District's permit with the Lahontan RWQCB has expired for 2004. 1 expect to discuss the status of this Contract and the remaining work with the Board at the December 15 meeting. Page 1 f S 5 Item 1: A total of 487.5 hours of rock excavation were performed during the period of October 11 through November 12, 2004. Jurin's rate is $450 per hour for an excavator with a rock hammer and $525 per hour for a rock saw. Jurin is owed f $222,337.50 for this rock excavation work. Item 2: In order to construct the pipeline connection to West Reed Avenue, it was necessary € for the District to acquire easements from two private parties that front on West Reed Avenue. Part of the agreement with one of the property owners required that the District install 140 feet of trench with two additional 4-inch conduits along with a pull box for future use by SBC. Jurin is owed $4,675.60 for this work. Item 3: As part of the agreement with Mr. Montano, the District agreed to install a natural gas sleeve pipe in the joint trench for future use by Mr. Montano. Jurin is owed $1,760.00 for this work. Item 4: The Board was previously informed issues that arose regarding an existing spring pond on the Montano property. During discussions with the Lahontan RWQCB, a number of measures were identified for the District to implement in order to protect the spring pond. One of these items involved the placement of rip-rap along the slope above the spring pond to prevent erosion. Two small detention ponds and cross ditches were also constructed to prevent water that is moving along the pipeline alignment from reaching the spring pond. A third measure required that the District place gravel and filter fabric at those locations where groundwater was encountered. The gravel would provide a porous medium and allow the groundwater to continue its underground movement. Jurin is owed $14,722.20.00 for this work. It should be noted that the District will need to perform some additional work in this area next Summer to complete the items identified by the Lahontan RWQCB. Item 5: Due to issues associated with the spring pond, construction of the pipeline on the Montano property was delayed by about a month while the District held discussions with the Lahontan RWQCB. Due to this delay, and the amount of rock excavation necessary to construct the pipeline, it became apparent to District staff that Jurin would be unable to complete all of the work included in the Contract. In October, District staff reviewed what steps could be taken to put the pipeline across the Montano property into service. It was determined that if the new pipeline could be completed to Donner Lake Road, a temporary connection to the existing pipeline feeding Cedar Point Drive could be installed. This temporary connection would be necessary for two reasons: 1) A portion of the existing pipe feeding Cedar Point Drive is in extremely poor condition. This section is located in the bottom of a drainage ditch and it is believed that at least half the flow in the ditch is the result of leaks on the existing pipe. Periodically, the leaks in this pipe increase in volume to the point where the Greenpoint Pump Station cannot keep up with system demands and District crews must try to find the worst of the leaks and patch them. The temporary tie- in would allow this portion of existing pipe to be removed from service. Page 2 S t 2) The Richards Pump Station will become operational in late December. At this time, the Donner Lake Intake Pump Station will be taken out of service. In addition, the spring water collected at the Greenpoint Springs property will no longer be used for water supply. As discussed in the presentation by Ed Taylor on November 17, the District is planning to dismantle the spring collection system during the Summer of 2005. However, until that time, water will continue to flow t into the existing tanks at the Greenpoint Springs property. This water must be controlled and discharged carefully to prevent damage to the property owners downhill of the tank. It is planned to route this spring water through a portion of the pipe that currently feeds Cedar Point Drive and then into a storm drain for conveyance into Donner Lake. t This connection was installed in early November and Jurin is owed $3,751.00 for installing this pipe connection. Item 6: During excavation of the pipe trench along Cedar Point Drive, there were a number of locations where the trench was involuntarily widened due to the removal of rocks. These locations require importation of additional backfill material and extra compaction effort. At total of about 28 cubic yards of excess backfill material was necessary due to this issue and Jurin is due$2,940.00 for this work. 4. Recommendation: I recommend that the Board authorize Contract Change Order No. 5, in the amount of a $250,186.30 payment to Jurin Construction from the District.
