Subject: Consideration of a Revised Grant Deed of Public Easement to
Southwest Gas
1. WHY THIS MATTER IS BEFORE THE BOARD
Board action is required to grant an easement on District property.
2. HISTORY
The District acquired APN 19-400-27 from Mr. Christopher Steele during the summer
of 2000.
Prior to transferring the property to the District, Mr. Steele had reached an agreement with
Southwest Gas (SWG) regarding an easement for construction of a natural gas pipe
across the property. District staff was aware of this agreement and SWG's intent to
construct the gas pipeline.
In 2000 SWG constructed the gas pipeline with the knowledge of District staff. In 2007
SWG was conducting a review of its property and easement records. SWG discovered
that the easement agreement between SWG and Mr. Steele had never been recorded
with Nevada County. At the August 5, 2009 Board Meeting, the Board approve the
easement and the easement was recorded with Nevada County in September of 2009,
Attachment 1.
3. NEW INFORMATION
In October of 2014, Southwest Gas (SWG) was again reviewing easements in preparation
of maintenance work to be performed on their facilities in 2015. It was discovered that the
easement recorded in 2009 only mentions pipeline and pipelines. When the pipeline was
constructed in 2000 facilities including vaults and related appurtenances were installed.
Southwest Gas is requesting the District to amend the easement of 2009 to include
appurtenances to allow maintenance of SWG facilities located within the easement. SWG
is not requesting any additional land, Attachment 2.
This easement currently covers numerous other existing utilities including AT&T
Telephone, TDPUD electric, TDPUD water and TSD sewer. Amending the easement with
SWG will have no impact on the area as this area is already encumbered by easements
covering other utilities.
4. FISCAL IMPACT
There is no fiscal impact associated with this item.
5. RECOMMENDATION
Authorize the Board President to execute an amended easement agreement between
Southwest Gas and the District to include appurtenances on APN 19-400-27.

GRANT DEED FOR PUBLIC UTILITY EASEMENT
FOR VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, Truckee
Donner Public Utility District, Grantor, does hereby grant to the Southwest Gas
Corporation, Grantee, a permanent easement 25 & 15 feet wide over a portion of APN
19-400-27 located in the Town of Truckee, Nevada County, California, and further
described in Exhibit"A" and Exhibit "B" attached hereto.
The easement granted herein includes the right to do all things necessary for the
construction, installation, upgrade, operations, repair, and maintenance of a natural gas
pipeline or pipelines on this easement including, but not limited to, a right of ingress and
egress, a right to temporarily store equipment and materials, to excavate, to drive
vehicles over, to place markers on, to survey, to inspect and repair and to remove
rocks, boulders, trees and plant life in the course of excavation or re-excavation.
Grantee agrees to work with due care in the exercise of its rights on the property and to
restore it to reasonably the same condition which existed before the work was
performed.

FOR VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, Truckee
Donner Public Utility District, Grantor, does hereby amend and grant to Southwest Gas
Corporation, Grantee, an amended permanent public utility easement over a portion of
APN 19-400-27 located in the Town of Truckee, Nevada County, California and further
described in Exhibit "A" attached hereto and conveyed to the undersigned in that grant
deed recorded in the official records of the County of Nevada on September 9, 2009 as
# 20090024440.
The amended easement granted herein includes the right to do all things necessary for
the construction, installation, upgrade, operations, repair, and maintenance of a natural
gas pipeline or pipelines including any appurtenances and pressure regulation
equipment on this easement including, but not limited to, a right of ingress and egress, a
right to store equipment and materials, to excavate, to drive vehicles over, to place
markers on, to survey, to inspect and repair and to remove rocks, boulders, trees and
plant life in the course of excavation or re-excavation. Grantee agrees to work with due
