RIM O To: Board of Directors From: Peter Holzmeister Date: October 31, 2003 Subject: Policy requiring maintenance of yard lines Why this matter is before the Board: This matter involves a proposed ordinance for the Board's consideration. Only the Board can adopt an ordinance. History: The District constructs and maintains a water system to the point of a service box generally located at the edge of the customer's property. From that point the customer is responsible for constructing and maintaining the yard line from the service box to the customer's point of use. We have been giving a high priority to water line leak repair because we want to avoid wasting water and because it is expensive to pump water. We have been expending considerable effort to reduce leaks in the District maintained system. We have not solved the problem of leaking lines, but we are working on it. A related program would be to see that the customer yard lines are properly maintained. We have not had a formal program to require the repair of leaking yard lines, but we may want to consider such a program. New information: Our Code of Policies currently does not contain a clear requirement for customers to maintain their yard lines with an appropriate enforcement provision. Attached is a draft ordinance for your consideration. If you adopt the draft ordinance a process would be established for staff to work with customers to have leaking yard lines repaired. Recommendation: I recommend that the board set a public hearing to receive input on the proposed ordinance ..... . III I��VIIJII�III�1 �� � III Ordinance No . 2003 - XX Amending Ordinance 8204 Providing for the Maintenance of Customer-Owned Yard Lines WHEREAS the District constructs operates and maintains a water system to provide potable water to businesses and residences in the District service territory; and WHEREAS the District constructs and maintains said water system to a service box at or near the customer's property corner; and WHEREAS the customer transports water from that service box to the structure or structures where customer intends to put the water service to use; and WHEREAS the customer is responsible for construction and maintenance of the line from the District service box to the customer facility; and WHEREAS said customer yard line if not maintained in good repair can result in the loss of water to the detriment of the entire District; NOW THEREFORE BE IT ENACTED BY THE BOARD OF DIRECTORS OF HE TRUCKEE DONNER PUBLIC UTILITY DISTRICT that effective 30 days from the date of passage of this ordinance: Chapter 6.48 of the District Code of Regulations shall be amended by adding Subsection 6.48.010.4 as follows: 6.48.010.4 Maintenance of customer yard line or piping It shall be the responsibility of the customer to maintain the yard line in good repair and operation. If the District determines that the yard line is leaking, the customer shall be notified to repair said line at customer expense. If the line is not repaired within sixty days, District shall have said line repaired at customer expense. Be it further enacted that all portions of prior ordinances and/or resolutions that are inconsistent with the provisions of this ordinance are hereby repealed insofar as they are inconsistent; all other portions of such ordinances and/or resolutions that do not conflict with the provisions of this ordinance shall remain in full force and effect. Holzmeister, Clerk of the Board CHAPTER 6.48 SERVICE PIPE CONNECTIONS AND CONSUMER'S GACILITIES Sections: 6.48.010 Service Pipes 6.48.020 i»tuber of Service Pipes 6.48.030 Service to Multiple Units 6.48.040 Control Valves 6.48.050 ronsu rier's Facilities 6.48.060 Right of Access 6.48.070 District's Facilities 6.48.010 Service Pipes 6.48.010.1 The District shall at the request and expense of any applicant, furnish and install service pipes of suitable capacity from its water main to a point to be determined by the District, between the existing or proposed curb line and the property line of the premises abutting upon a . street or other thoroughfarw, r alcrsg ;;is[ ;c s right-of-way or easement. The service pipes, the met r. and meter bcx are the property of the District and shall be maintained by it and removed upon discontinuance of service. 6.48.010.2 The customer's yard line or piping shall extend to that point behind the curb line or ' property line of easiest access to the District from its existing distribution system. The District shall be consulted and approval obtained, before any installation of service pipes. 6.48.010.3 Only duly authorized employees or agents of the District are permitted to install service pipes from the District's main to the customer's premises. 6.48.020 Number of Service Pipes - Separate premises under single control or management will be supplied through separate individual service pipes unless the District determines that multiple service pipes are appropriate. 6.48.030 Service to Multiple Units - Repealed 8/7/95 by M095-87. 6.48.040 Control Valves -The District shall install a suitable valve as close to the meter location as practicable, the operation of which will control the entire supply from the service. 6.48.050 Consumer's Facilities - The customer shall, at his own risk and expense, furnish and install all equipment that may be required to receive, control, apply and utilize water service. 6.48.060 Right of Access -The District or its duly authorized agents shall have at all reasonable times the right of ingress to and egress from the consumer's premises for any purpose properly connected with water service. 6.48.070 District's Facilities -The customer shall be liable for any damage to meters or other ' facilities owned by the District caused by an act of the customer or his tenants, employees, agents, contractors, licensees, or permittees including damage caused by freezing, steam, hot water, chemicals, or other factors outside the control of the District.
