I. WHY THIS MATTER IS BEFORE THE BOARD
The Donner Lake Tract Pipelines Project is complete. It is time for the board to consider
a closeout change order and a resolution accepting the project.
2. HISTORY
The purpose of this project was installation of approximately 5,000 feet of water
pipelines in the area to improve water service for the first time. The installation of fire
hydrants and service connections were also included in this project.
3. NEW INFORMATION
Attached for your review are the change order and resolution.
4. RECOMMENDATION
a) Consideration of contract change order Number 2 to the Donner Lake Tract
Pipelines Project
b) Consideration of a resolution accepting the Donner Lake Tract Pipelines Project
as complete and authorizing the filing of the notice of completion.

BACKGROUND:
The Board of Directors previously awarded the Contract for construction of the DONNER
LAKE TRACT PIPELINES project to Herbert Suter Construction. The project was
completed on September 11, 2003. In August, the Board approved Change Order No. 1
for this project. I am requesting a Change Order to the Contract for issues covered under
seven general items that will cover all of the outstanding issues on this project.
Item 1: The contract was based on a unit price bid. The attached table shows the
differences between bid totals and the amounts actually constructed. This
analysis results in a $14,988 credit to the District.
Item 2: The Contract contains a rock excavation clause whereby the Contractor is
due additional compensation for performing rock excavation. The Contractor
performed some additional rock excavation during construction of the
services and is due $827.00.
Item 3: Under a USA call, TSD does not locate service laterals. During installation of
the service laterals, four unmarked sewer laterals and one unmarked storm
drain were encountered and required repair. The Contractor is due
$1,116.91 for repair of these utilities.
Item 4: During installation of one of the water services, the contractor encountered a
French drain system. The existence of this French drain was unknown to all
parties, including the property owner. It was necessary to purchase some
drain rock to repair the system. The piping materials were paid for by the s
District directly. The Contractor is due $275.00 for purchase and trucking of
the drain rock.
Item 5: During the construction, leaks occurred on the existing water system that f
required repair. The Contractor is due $629.03 for labor and materials
associated with these repairs.

Item 6: Based on discussions with the Homeowner's Association, it was agreed that
the District would place asphalt grindings instead of the aggregate base
specified for a final surfacing of the dirt roads. The asphalt grindings cost
$4.00/ton more than the aggregate base. The initial estimate was that 250
tons of aggregate base would be required. An additional 40 tons of grindings
was needed to properly surface the roads. The Contractor is due$1,000 for
the cost difference between the asphalt and the aggregate base and an
additional $1,144 for the purchase and trucking of the additional asphalt.
Item 7: The owners of 14036 Robin Lane and 14044 Robin Lane have been in an
ongoing dispute regarding the use of a common driveway that served both
houses. The original property corner monuments had been disturbed and
removed at some point in the past.
Based on initial discussions with the owners, a consensus was reached
regarding the proper location of the meter boxes for both houses. After
installation of the boxes, the owners of 14036 Robin Lane hired Sage Land
Surveying to re-establish the corner monuments. The survey revealed that
the actual corner was about 10 feet west of the location agreed at by
consensus. It was then necessary to relocate the meter boxes due to the
unwillingness to the two parties to let the boxes remain at the installed
location. I was able to convince them that the underground water piping did
not need to be relocated. The Contractor is due$1,889.67 for the relocating
these two boxes.
RECOMMENDATION:
I recommend that the Board authorize Contract Change Order #2, in the amount of a
$8,106.39 credit to the District from Herbert Suter Construction.

The amount of the Contract will be decreased by the sum of $8,106.39 and the Contract Time shall not be
extended. The undersigned Contractor approves the foregoing Change Order as to the changes, if any, in the
contract price specified for each item including any and all supervision costs and other miscellaneous costs
relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on
account of said Change Order. The Contractor agrees to furnish all labor and materials and perform all other
necessary work, inclusive of the directly or indirectly related to the approved time extension, required to complete
the Change order items. This document will become a supplement of the contract and all provisions will apply
hereto. It is understood that the Change Order shall be effective when approved by the District.

AUTHORIZING THE ACCEPTANCE OF THE DONNER LAKE TRACT PIPELINES AND DIRECTING
FILING OF THE NOTICE OF COMPLETION
WHEREAS, the Board of Directors of the Truckee Donner Public Utility District made the
determination to undertake the Donner Lake Tract Pipelines Project; and
WHEREAS, Herbert Suter Construction, was selected by the District to perform the work; and
WHEREAS,the District's Water Systems Engineer, Neil Kaufman, has recommended that the work
be accepted by the District;
NOW THEREFORE BE IT RESOLVED by the Board of Directors of the District as follows:
1. That the District hereby accepts the Donner Lake Tract Pipelines Project as complete.
2. That the Clerk of the District be directed to file with the County of Nevada the Notice of
Completion, a copy of which is attached hereto.
3. That 35 days following the filing of the Notice of Completion, the 10% retained from the
contractor payments be released to the contractor if no claims have been made to the District
by material suppliers or laborers.
