Subject: Easement Abandonment request to be considered by the Board of
Directors
1. WHY THIS MATTER IS BEFORE THE BOARD
Per District Code, section 8.04,020, all easement abandonment requests must be
approved by the Board.
2. HISTORY
The District has Public Utility Easements along side of, around and in front of most every
parcel within the District. The vast majority of these easements are not utilized by the
District and probably never will be.
3. NEW INFORMATION
Staff has received a request for an abandonment of an easement that the District has
some involvement with. Staff has reviewed the request and has determined that we
either do not have facilities in that easement, nor does our Master Plan call for any
facilities to be constructed within those easements.
4. RECOMMENDATION
Consideration of a resolution to request abandonment of an easement along a lot line
adjustment for Joseph Scalmanini, APN 45-240-23 and 45-240-24, located at 11026 and
1010 Sitzmark Way.

PROJECT DESCRIPTION: The applicant is requesting approval of a lot line adjustment to
adjust the shared side property line between Assessor's Parcel Numbers 45-240-23 (Lot 404)
and 45-240-24 (Lot 405). The applicant would also like to pursue the abandonment of the
public utility easement along the lot line being adjusted. There is an existing 10-wide public
utility easement (five feet on both sides of the property line). The applicant currently owns both
parcels involved with the lot line adjustment.
The above-referenced request for an abandonment of a public easement has been submitted
for review to the Community Development Department, Planning Division. Please review the
requested abandonment, complete the comment sheet on the back, and return your comments
to this office by Monday, July 28, 2003. Also please feel free to provide any additional
comments or information you may have on the requested abandonment.

AUTHORIZING AN ABANDONMENT, AS TO ITS INTEREST,
OF A PUBLIC UTILITY EASEMENT
BETWEEN APN'S 45-240-23 AND 45-240-24
WHEREAS, Joseph Scalmanini has requested the abandonment of the public utility
easement along a lot line adjustment of shared side property lines between Assessor's
Parcel Numbers 45-240-23 (Lot 404)and 45-240-24 (Lot 405): five feet on both sides of the
property line. Said lots are located at 11026 and 11010 Sitzmark Way, within the Tahoe
Donner Subdivision Unit 8.
WHEREAS, District staff has investigated the matter and determined that such lot line
adjustment and easement abandonment would not cause the District problems in providing
electrical or water service;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner
Public Utility District as follows:
That the President of the board be authorized to execute a statement
indicating that the Truckee Donner Public Utility District has no objections to
the abandonment of the above-described public utility easement as shown on
the attached map, which has been entitled Exhibit "A".
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within
the District on the seventeenth day of September, 2003 by the following roll call vote:
