The MOU generally defines costly matters and ground rules that effect our relationship with District employees. This is important and needs Board involvement early on. History: The three year MOU that was last negotiated with the Union expires on December 31, 2005. We have begun to meet with the Union committee to discuss amendments to that MOU. A few meetings ago I discussed with the Board the law that defines our obligation to meet and confer with the Union, the kinds of issues likely to be raised by the Union, and the terms of the existing MOU. New information: Attached to this memorandum are the twenty-seven proposals offered by the Union as suggested amendments to the MOU. Also attached are the proposals that I offered to the Union on behalf of the District. There is still time to propose additional District issues. The District's decision is not subject to the grievance procedure. Any Letter agreement conflicting with this language is repealed. DP #2 A rubber gloving practice will be used under the following circumstances: a. The situation is such that rubber gloving can be safely performed b. The crew involved in the work agrees unanimously to use rubber gloving procedures Employees who are trained and certified to use rubber gloving practices shall receive a wage differential of 3%for all hours worked. DP #3 District will implement a dress code DP #4 6.5 (e) Employee may elect to accrue and use up to twenty-four (24) hours per calendar year of compensatory time. if an employee who is normally assigned to work in one department performs overtime work in another department, that overtime work may not be converted to compensation time. (Rest of section remains unchanged) DP #5 Section 19.1 is eliminated (19.1 states that the District will not alter the overall level of service or benefits of any of the programs identified below unless otherwise agreed by the Union) 19.2 (a) Group Medical Insurance Plan: The District will pay 100 %of the premiums for employees. Employee shall pay premiums that apply to spouse and dependents Other parts of 19.2 (a) may need to be updated 19.2 (b) is eliminated (19.2 (b) requires the District to subsidize a portion of drug benefit) DP#6 5.4 (c) The District may place the standby employee on a rest period when in the District's sole discretion it determines that the standby employee has worked enough hours that a rest is needed. While the standby employee is on rest period standby shall be assigned to another employee. DP #7 6.4 is eliminated (6.4 says overtime will be divided as equally as is practicable among those qualified and available in each department) DP #8 6.5 (f) Not withstanding any other provision contained herein, when any employee is driving an automobile, or is a passenger in a vehicle, to or from a site for purposes of attending training or a conference ... The District retains the discretion to refuse approval of travel by automobile when, in its discretion, a more economical mode of travel is available. DP #9 8.2 (a) If the District requires an employee to perform work on a work day and such work begins two hours but not less than forty-five minutes prior to the employees regular starting time, .... 8.2 (b) First sentence is okay. Second sentence changed to read as follows: Thereafter meals will be provided at intervals of four hours, provided such work continues at the conclusion of the meal. ... 8.2 (c) This section needs to coordinated with 8.2 (b) DP #10 Eliminate 19.2(g)3 (19.2(g)3 allows employees to sell back unused sick leave at retirement) DP #11 16.5 Change probationary period to six months (it is currently 3 months) DP# 12 19.2 (g) Change to reflect PIERS, eliminate (4) and (5) Add a section that states: The District's normal retirement age is sixty years of age. DP #13 19.3 (b) Longevity payments will be made as soon as possible after the first pay of the year, but not later than the last day of January of the calendar year for those employees who are eligible. DP #14 11.1 Add a sentence that states that when the District is required to provide safety glasses to any employee and the employee requires prescription lens in his or her safety glasses, the cost of the exam used to determine the prescription shall be limited and be part of the benefit set forth in section 19.2 (i).
