Why this matter is before the board: The District Pipeline Replacement- 2005 project is complete. A closeout change order and a resolution accepting the project require Board approval. 2. History: The Board previously awarded the District Pipeline Replacement- 2005 project to Hard Line Excavating (HLE). On August 17, 2005, the Board of Directors approved Change Order No. 1 in an amount of $47,101.41. On September 21, 2005, the Board of Directors approved Change Order No. 2 in an amount of $32,029.24. 3. New information: On November 4, District staff performed a final walkthrough on the project. All portions of the project have been completed. I am requesting a Closeout Change Order to the Contract for issues covered under three general items that will cover all of the change order issues that arose during this project. Item 1: The contract is based on a unit price bid. The attached table shows the differences between bid totals and the amounts actually constructed. This analysis results in a $40,951.00 credit to the District. This credit mainly results from two changes that were made during construction - the deletion of a valve/tee assembly on Richards Boulevard and a reduction in the amount of pipe installed on Skislope Way. It should also be noted that rock excavation estimates outside of the Donner Lake area have been reasonably accurate. Eleven hours of rock excavation were estimated on the Bid Schedule and a total of 15 hours were actually necessary. Item 2: The old pipelines on Davos Drive, Schussing Way and Skislope Way and were in extremely poor condition. The pipe on Davos Drive had experienced 18 leak repairs Page 1 over the last 10 years; the pipe on Schussing Way had experienced 38 leak repairs over the last 10 years; and the pipe on Skislope Way had experienced 19 leak repairs over the last 10 years. On Schussing Way is necessary to actually perform additional leak repair once HLE had begun construction and there were two leaks on Skislope Way that were not fixed in the hope that the existing pipe could be abandoned before a repair was necessary. These numerous leak repairs had left the pavement on all three streets with numerous patches of varying size, and quality. After construction of the new pipelines, HLE restored the pavement that was damaged and removed to accommodate installation of the new mains. in addition, the District worked with the Town and HLE to repave some the old pavement patches, pave the unpatched areas, and generally clean-up the damage caused to the pavement by numerous District leak repairs over the years. This resulted in the placement of 4,624 square feet of additional asphalt that was not included in the HLE bid. A unit price of $5.50 per square foot was agreed to based upon Bid Item No. 3N, and HLE is owed $25,432.00 for this work. Item 3: The portion of Skislope Way that was replaced is the only pipeline that serves about 100 customers farther downhill. As a result, the existing pipe could not be removed from service at any time without cutting these customers off from water. The attached figure shows the pipeline configuration in this area. As noted above, the existing pipeline on Skislope Way was in extremely poor condition. There were two active leaks on this pipe at the time HLE was ready to begin construction. District staff also believed that there may have been additional leaks on the pipe that were not coming to the surface. The planned alignment for the new pipeline was 4 feet away from the existing pipeline. Due to the close proximity of the old and new pipelines, and the poor condition of the old pipeline, District staff was extremely about failure of the old pipeline while the new pipe was being constructed. The possibility of constructing a temporary bypass pipe around the construction area was then considered. During construction of the Donner Lake Pipelines — 2004 project, an aboveground temporary waterline was constructed to continue service in Donner Lake while a new pipeline was constructed. The aboveground pipe became the property of the District upon completion of the Donner Lake Pipelines — 2004 project. Ed Taylor and I decided to have HLE use this aboveground pipe to construct a bypass around the construction zone. HLE was directed to move the aboveground piping from Donner Lake to Skislope Way and use it to construct a bypass. The total cost of this work was $25,157,78. I believe that this decision benefited the District in three ways. 1) it ensured that service could be provided to the approximately 100 customers downhill of the construction zone. In the event of a blowout of the existing pipe, a significant outage lasting many hours could be expected. 2) It eliminated the potential for any delay claims or extra work that would have resulted in the event of a blowout of the existing pipe. Page 2 3) Once the bypass was installed, it was possible to remove the existing pipe and install the new pipe in the same trench. This eliminated the possible need for any rock excavation, since any rock along the trench line had already been removed during the original construction. 4. Recommendation: a) I recommend that the Board authorize Contract Change Order No. 3, in the amount of a $9,638.78 payment to HLE from the District. b) I recommend that the Board pass a Resolution accepting the District Pipeline Replacement - 2005 project as complete and authorizing the filing of the Notice of Completion. The Contractor agrees to furnish all labor and materials and perform all other necessary work, inclusive of the directly or indirectly related to the approved time extension, required to complete the Change order items. That the District hereby accepts the District Pipeline Replacement- 2005 Project as complete. 2. That the Clerk of the District be directed to file with the County of Nevada the Notice of Completion, a copy of which is attached hereto. 3. That 35 days following the filing of the Notice of Completion, the monies retained from the contractor payments be released to the contractor if no claims have been made to the District by material suppliers or laborers.
