Subject: Cebridge Connections request for an easement
Why this matter is before the board: This matter involves granting Cebridge
Connections an easement across the District owned land at the Northside well
and tank site for access to their new head end site. Only the board can grant this
easement.
History: There is a considerable history to the District's dealings with Cebridge
Connections, and since the board is familiar with the details of that history, I will
not repeat it here.
New Information: Until recently Cebridge has leased a portion of the Northside
site from the District and had its head end facility there. The District now needs
that land and Cebridge is in the process of relocating its head end. I received a
request from Cebridge that we convey to them an easement across the
Northside site so they would have access to their new head end facility. I
responded that we are not interested. A request has been made that this matter
be presented to the board for consideration. Attached are the a-mails that went
between me and Pete Abel.
Recommendation: I recommend that the request be denied

Peter -- Thanks for getting back to me. I guess I 'm surprised by this answer, and
accordingly, I hope you can help me understand why the TDPUD would not want to take
advantage of a revenue-producing asset, especially when that revenue is achievable in a
manner that will not interfere with your evolving plans for the property in question. My
goal is not to debate, but simply to understand. If you would prefer to discuss this
matter, by phone, let me know, and I'd be delighted to call at a time that is convenient

Peter -- I really hesitate to bother you because I know you're very busy, but as we work
to finalize plans for relocation of our headend this month, we would like to understand
the TDPUD's thoughts on the easement proposal from my August 3 email, and where/how that
proposal might fit into our go-forward plans. I know you have a budget review meeting
this afternoon with the Board, so if you need to wait until that meeting concludes, I
obviously understand. Either way, please let me know.

SO. My thought was to get together, not to talk business, but simply to get to know each
other a little better and maybe discuss common community interests, such as workforce
housing. We have similar challenges on that topic. Would this be something in which
you're interested and available?)

Peter -- I hope you are well. I'd like to exchange several updates with
you and ask for your review/reply (preferably this week) on a somewhat
time-sensitive item, noted below, under Topic #2.
#1. EDUCATIONAL TV SPOTS
I trust things continue to move in the right direction with respect to
the TDPUD's educational/conservation-related TV spots, and hope you
and/or Scott Terrell will keep me personally apprised of the status of
Scott's discussions with Peg Freesen.
Once a basic agreement has been reached between them, I'd be happy to
advocate for the TDPUD to receive incremental time on the schedule for
your educational messages, at no charge, contingent on the availability
of "open" spots, and consistent with our ongoing commitment to community
service.
#2 . TDPUD PROPERTY
As of this morning, we are on track to have our headend removed from the
TDPUD's property by end-August, and once again, we appreciate your
gracious agreement to a 30-day extension of the original deadline.
On a related note, I would like to revisit our prior request for a
temporary easement (primarily for a conduit and utility closet) on this
same property. We are again inquiring about this matter, given that the
other options available to us are not proving as immediately
practical/viable as we hoped they would.
Specifically, I have been authorized -- in a exchange for a one-year
(12-month) easement -- to offer the TDPUD $500 per month ($6, 000
annualized) . Importantly . . .
(a) the $500 per month is negotiable, within reason
(b) the easement would take up very little space on the property in
question
(c) the easement could run along the very edge of the property, well
removed from the primary "useable" area
(d) unanticipated, mid-term relocation of the easement/conduit/closet
would be at our cost, as would the end-term removal
(e) though not as critical as permits/inspections, the easement would
help further ensure timely removal of our headend.
I 'm hopeful we can work something out here, and would greatly appreciate
the courtesy of your reply this week, if possible.

#3 . CHANNEL 6 BOARD MEETING TELECASTS
Per Alan Harry, we are awaiting Joe Horvath' s decision regarding the
poles on the proposed route for the fiber drop that would enable board
meeting telecasts on Channel 6 (TTCTV) . In the meantime, our technical
staff may have identified an alternative installation proposal that
would not impact those poles and could be implemented within days,
pending final resolution of the items discussed above. We stand
prepared to discuss this alternative with you, Alan, and/or Joe, as
appropriate.
