HomeMy WebLinkAbout2005-06-15 Agenda Packet - Board (13) Agenda Item # • . , DONNER U7r- Memorandum To: Board of Directors From: Peter Holzmeister Date: June 10, 2005 Subject: Donner Lake Assessment adjustment Why this matter is before the board: This matter involves exempting a Donner Lake Assessment District assessment on a parcel which has been merged with an adjacent parcel. Our practice has been for the board to approve these exemptions. History: The District is financing reconstruction of the Donner Lake water system by means of an assessment district. The Donner Lake Assessment District was formed and every buildable parcel was assessed; whether improved or vacant. Soon after the assessment were established some owners of vacant parcels who owned adjacent parcels asked if they merged their two parcels if they could eliminate one of the assessment charges. We agreed that we would eliminate an assessment if a vacant parcel was merged with an adjacent parcel. We were advised by our attorney, John Murphy, that we should consider establishing a date after which mergers would no longer result in reduction of the assessment. The idea here is that our financing was determined based on an expectation of receiving a certain revenue stream needed to pay for the water system improvements, and we established that financing based on the circumstances existing at the time the financing was set in place. Subsequent mergers of parcels would erode the revenue stream needed to pay for the improvements. We never adopted a cut off date for consideration of mergers. New information: We now have a property owner who has merged two parcels. Julie Chenu had owned two adjacent parcels, her house being on one of them and the other being vacant. She was assessed the normal residential rate of $6,952.25 per parcel, payable over twenty years. Attached is a document from Nevada County Assessor confirming that the two parcels have been merged, with a new APN 17-321-16-000. Also attached is a draft resolution which, if adopted by the board would rescind the assessments on APNs 17-321-07 and 17-321-14 and create a new assessment of $6,925.52 on the new parcel. Finally, I have also attached a map showing the location of the two parcels which are now merged. Recommendation: I recommend that the board adopt the resolution amending certain assessments for the Donner Lake Assessment District. # CKEE 6 Public Utility District Res lution No. 2005 - XX Amending certain assessments for Donner Lake WHEREAS the Board of Directors adopted Resolution No. 2001-09 which made determinations, confirmed assessments and proceedings,ordered the acquisition and construction of improvements and took certain other actions relating to Donner Lake Water Assessment District No. 00-1; and WHEREAS, subsequent to adoption of Resolution No. 2001-09, certain information has come to light as follows: Certain property owners of record have merged multiple adjacent assessed lots into a single lot WHEREAS THE District determines that, based on the above findings, certain assessment confirmed in Resolution 2001-09 should be amended or repealed; NOW THEREFORE BE IT RESOLVED BYTHE BOARD OF DIRECTORS OF THE DISTRICT AS FOLLOWS: 1.The parcel assessments for Julie Chenu,APN 17-321-07 and APN 17-321-14 shall be rescinded because they were merged into a single new parcel identified as APN 17-320-09, and this new parcel shall be assessed at six thousand nine hundred twenty-five dollars and fifty two-cents ($6,925.52) 2. All other resolutions adopted by the Board of Directors shall remain in effect except to the extent that the terms therein conflict with the terms of this resolution.
