WHY THIS MATTER IS BEFORE THE BOARD This item recommends that certain obsolete water system materials be declared surplus and disposed of in accordance with District policy. Only the Board can declare material as surplus. 2. HISTORY The District adopted the attached policy governing the disposal of surplus materials. It calls for the General Manager and staff of the District to evaluate the continued need for material, and if any items are found to be unnecessary to submit a report and draft resolution to the Board for its consideration and action. 3. NEW INFORMATION Staff has evaluated the materials and has determined they are no longer used in the construction or maintenance of the water system. Attached is a list of the materials with a value of $5,224.50. 4. RECOMMENDATION I recommend that the Board adopt the attached resolution declaring certain obsolete water system materials as surplus and directing the General manager to dispose of it in accordance with District policy. CHAPTER 8.20 DISPOSAL OF DISTRICT PROPERTY Sections: 8.20.010 Disposal of Surplus Inventory, Materials, Office Equipment and Vehicles 8.20.020 Disposal of Real Property 8.20.010 Disposal of Surplus Inventory Materials Office Equipment and Vehicles 8.20.010.1 Items of inventory, materials, office equipment and vehicles considered by staff to be no longer necessary shall be listed on an appropriate form and presented to the Manager. 8.20.010.2 When suitable, the Manager shall direct that a resolution declaring the items surplus and issuing a call for bids be drawn up and placed on an agenda for Board review and approval. 8.20.010.3 The Manager shall advertise the sale of the surplus items in the appropriate newspapers and journals. 8.20.010.4 The bid opening date shall be as indicated on the pertinent resolution. 8.20.010.5 In the event that bids are not received on some items, or the General Manager determines that the bids received on certain items are not sufficient, the Board may authorize the General Manager to dispose of such items at his discretion. 8.20.010.6 No Board member may bid on or purchase surplus property from the District. No person who makes, participates in the making of, or influences the decision to dispose of surplus property may bid on such items. This includes District staff, consultants, advisory committee members and all other individuals who make, participate in the making of, or influence the decision regarding the disposal of surplus property. NOW, THEREFORE, BE IT RESOLVED that the Board of Directors adopts the above recitals as its findings; and BE IT FURTHER RESOLVED that, for the reasons set forth above, the Board declares the water system material listed on Exhibit A attached, as surplus property; and BE IT FURTHER RESOLVED that the General Manager is directed to dispose of said property in accordance with District policy. BE IT FURTHER RESOLVED that the buyer must purchase materials"as is"and acknowledge the disclaimer that"materials do not meet District standards and cannot be used within the District water system". BE IT FURTHER RESOLVED that the bid opening date will be June 8, 2005.
