Subject: Slope Easement Request by Town of Truckee
1. WHY THIS MATTER IS BEFORE THE BOARD
Only the Board can approve easement requests on District property.
2. HISTORY
This easement request was originally presented to the Board on November 17, 2004
(copy attached). At that time, the Board directed staff to have the easement
documents revised to reflect the fee which the District desires to charge for the
easement, and have District counsel review the documents.
3. NEW INFORMATION
Attached for your consideration are the revised easement documents, which have
been reviewed by District counsel.
4. RECOMMENDATION
I recommend the Board approve the slope easement over the District's property
along Brockway Road for the fee of$14,363.50, and authorize the Board President
to execute the appropriate easement documents.

FOR A VALUABLE CONSIDERATION OF FOURTEEN THOUSAND THREE HUNDRED SIXTY
THREE DOLLARS AND 501100THS ($14,363.50),receipt of which is hereby acknowledged, THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT, Grantor, does hereby grant to the TOWN OF
TRUCKEE a permanent slope easement over a portion of APN: 19-450-14 located in the Town of
Truckee, Nevada County California and further described in Exhibit "A" and Exhibit 'B" attached hereto.
The easement granted herein includes the right to do all things necessary for the construction, installation,
upgrade, repair, and maintenance of slopes, and all appurtenances thereto including but not limited to, a
right of ingress and egress, a right to temporarily store equipment and materials, to excavate, to drive
vehicles over, to place markers on, to survey or inspect, and to remove rocks, boulders, trees and
vegetation in the course of installation or maintenance.

SLOPE EASEMENT
A portion of the tract of land described in the Grant Deed to the Truckee-Donner
Public Utility District, recorded in Book 94, Page 440, Official Records of Nevada
County, located in Section 14, Township 17 North, R 16 East, M.D.M., Nevada
County, California.
Beginning at the Southerly corner of the above described tract of land, being a
point on the Northerly line of the Right of Way of Brockway Road as shown on
Right of Way Map R-32610 on file with the Department of Transportation, State
of California, Route 267, and from said point the Southeast one-quarter section
corner of the above described Section 14 bears the following two (2) consecutive
courses and distances: (1) South 59040'52" East along said Northerly Right of
Way line for a distance of 1713.22 feet to a point on the Southerly line of the
Northerly one-half of said Section 14; and 2) North 86049'29" East along said
Southerly line for a distance of 1186.15 feet; thence from the point of beginning
North 59040'52" West along said Northerly Right of Way line and the Southerly
line of said tract of land for a distance of 582.36; thence along the arc of a
tangent curve to the left having a radius of 1530.00 feet, a central angle of
01058'33", a length of 52.76 feet, and a chord bearing North 60040'13" West for a
distance of 52.76 feet; thence leaving said Northerly Right of Way and Southerly
line South 8802517" East for a distance of 20.11 feet; thence South 60003'27"
East for a distance of 239.84 feet; thence South 59034'53" East for a distance of

The meridian of this surrey is identical to that used for the map filed in Book 12
of Surveys at Page 412, Nevada County Records.

CONSIDERATION OF GRANTING A SLOPE EASEMENT TO THE TOWN
OFTRUCKEE
Director Van Gundy moved and Director Aguera seconded, a motion to
approve the slope easement request by the Town of Truckee (through Tom
Grossman) over the District's property along Brockway Road (APN 19-450-
14) for a fee of $14,363.50; and authorize the General Manager to prepare
the appropriate easement documents and come back to the board for final
approval of all legal documents and official action.

Subject: Slope Easement Request by Town of Truckee
1. WHY THIS MATTER IS BEFORE THE BOARD
Only the Board can approve easement requests on District property.
2. HISTORY
The Town of Truckee granted approval in 2003 to Tom Grossman's Wintercreek
subdivision project on Brockway Road, located on the District's former Southside
Well property. One of the conditions of approval included the requirement for
Mr. Grossman to install a turn lane on Brockway Road in front of the Wintercreek
subdivision. in order to accommodate a turn lane, Brockway Road must be widened
on the north side, encroaching over property which the District owns. The Town of
Truckee (through Tom Grossman) is requesting an easement from the District to
accommodate the proposed realignment of Brockway Road.
3. NEW INFORMATION
The requested slope easement area is approximately 6,245 square feet. When the
District sold most of the Southside property to Mr. Grossman, the cost on a square
foot basis was about $2.30. If the District grants the easement, one possible method
for calculating a fee would be to use this dollar amount times the requested
easement area. This would amount to a fee of$14,363.50 for the easement.
4. RECOMMENDATION
I recommend the Board approve the slope easement over the District's property
along Brockway Road for a fee to be determined by the Board, and authorize the
General Manager to execute the appropriate easement documents.

Tom has revised the slope easement document to include the fee which we
discussed at the board meeting in November. If you could review the revised
easement document, I would appreciate it. I have also attached a copy of my memo
to the board for your information.
