HomeMy WebLinkAbout4 LAFCO Vacancy Agenda Item # Memorandum To: Board of Directors From: Peter Holzmeister Date: February 11, 2005 Subject: LAFCo vacancy Why this matter is before the board: This matter involves appointing a person to fill a vacancy on the Nevada County Local Agency Formation Commission. Only the board can take this action. History: The LAFCo commission is comprised of two members from the county supervisors, two members appointed by the cities in Nevada County, one member representing the general public and two members appointed by the special districts in the county. There are also alternate members representing those same categories. When a term of office of a LAFCo member representing the special districts expires, the special districts are asked to nominate a person to fill the vacancy. After the nominations are received by LAFCo a ballot is sent to each special district, votes are cast, and the vacancy is filled. It often happens that the incumbent LAFCo member wants to be reappointed to another term, and that is permissible if the special districts agree by so voting. New information: Attached is a letter from SR Jones, Executive Officer of Nevada County LAFCo. The letter notifies us that the term of office of John Drew, a special district alternate member, is expiring on May 2, 2005. We are asked to nominate a person to fill the vacancy. We are not required to make a nomination. I have spoken with John Drew and he is willing to remain on LAFCo. It is likely that Nevada Irrigation District will nominate him to a second term. We generally like to have the Truckee area special districts represented on LAFCo. Ron Sweet, a director of Truckee Sanitary District, is a long-tenured member of LAFCo. I have not yet spoken with the other Truckee special districts to determine if they have a preference on filling this vacancy. Recommendation: I have no recommendation at this time. The current representative is John Drew, Chairman of the Nevada Districts Irrigation District Board of Directors. We are therefore now calling for District nominations for this position. John Drew The last time a meeting of the Special District Selection Committee was scheduled Districts Alternate to select a LAFCo member, lack of quorum prevented action and a mail ballot Karen Grimes had to be used, delaying selection of a Special District member by several weeks. Nominating Districts may also forward a brief resume for their nominees, one paragraph or so in length, noting the qualifications they have for this position. The resolution and resume must be received by LAFCo no later than March 4, 2005. R6sum6s for nominees will be copied and included in the ballot packet. 4. Upon receipt of nomination resolutions and rdsumes, LAFCo staff will prepare the ballot and send it by certified mail to each Independent Special District. The ballot may not be photo- copied—only the original ballot will be accepted by LAFCo. Only the Chairperson of the Board of Directors or an appointed substitute may complete and sign the ballot. 5. The ballot must be returned to LAFCo no later than the date stated on the ballot. 6. The votes will be tallied by LAFCo staff under supervision of the Nevada County Elections Office. Results of the election for the LAFCo Alternate Special District member will be sent to each Special District and each nominee. The attached resolution may be used if your Board so desires. Name (printed): Signature: Responsibilities of a LAFCo Commissioner What is LAFCo? The Local Agency Formation Commission (LAFCo) is an independent public agency with authority over local government agency changes of organization—that is, annexations, de- tachments, and consolidations of cities or districts, formation and dissolution of Special Districts, and incorporation and disincorporation of cities. Additionally, LAFCo is respon- sible for adopting a Sphere of Influence for each agency in the county. The Sphere of Influence is a plan for an agency's probable future boundaries and should represent a logi- cal growth plan for the agency. LAFCo's Composition The Commission is composed of two Special District Members (elected by the Special Districts);two County Members (appointed by the Board of Supervisors); two City Mem- bers(appointed by the City Selection Committee); and a Public Member (appointed by the other LAFCo Commissioners). In addition, each category has an Alternate Member who votes in the absence of one of the members of that category. Alternate Members attend all meetings and participate in discussion. The Commissioner's Role LAFCo Commissioners approve or deny proposals for changes in organization based on the procedures and standards of the Cortese-Knox-Hertzberg Local Government Reor- ganization Act of 2000 (Government Code Sections 56000 et seq.). Additionally, LAFCo is subject to the California Environmental Quality Act, as are all public agencies. LAFCo Meetings The Commission usually meets once a month on the third Thursday. Commissioners are expected to attend all meetings and participate in the deliberation process. LAFCo also has an appointed staff to coordinate meeting logistics and to research and make recommenda- tions on proposals before the Commission.
