Subject: Change Order No. 1 for the District Pipeline Replacement-2004 Project
1. Why this matter is before the board:
Approval from the Board of Directors is necessary to issue a Change Order to a constrcution
contract.
2. History:
The Board previously awarded the District Pipeline Replacement-2004 project to Herbert
Suter Construction (HSC).
3. New information:
Construction of the project began on May 10. I am requesting a Change Order to the Contract
for issues covered under seven general items that will cover all of the outstanding issues
encountered as of June 4, 2004.
Item 1: The District applied for and received an Encroachment Permit from Caltrans for the
Work on State Route 89. Caltrans does not change the District any fees associated
with this permit. For some past contracts, Caltrans has required that the Contractor
pay a fee associated with the Permit. Caltrans has not required this on all projects.
On this project, Caltrans made a last minute addition to the Permit requiring, that the
Contractor pay an Encroachment Permit fee. This change was made too late to be
included in any Addendums and HSC was unaware of the requirement so the cost
was not included in the Bid. The cost associated with this permit fee is $970.00.
Item 2: Construction of the project began on west side of State Route where the new
pipeline would connect to an existing 10-inch pipe. Upon excavating the existing 10-
inch pipe, it was discovered that the 10-inch pipe was housed inside of a 24-inch
steel casing. The only drawing in the District files that covers installation of this 10-
inch pipe is hand drawn in pencil and does not have any mention of the casing.
Upon discovery of the 24-inch casing, it was decided to cut the casing out of the way
in order to access the 10-inch pipe. Cutting of the casing proceeded slowly since it
was necessary to remove the casing without damaging the 10-inch steel pipe inside.
This effort took almost an entire day. Installation of the tapping sleeve and
performance of the hot tap was completed this first day.

During the second day, HSC was able to install pipe to the center of the roadway,
backfill the trench and complete the paving work. The existence of this casing
essentially caused a full day's delay for the project. HSC is due $8,529.96
associated with this delay.
Item 3: On Day 3 of the project, HSC encountered an 8" underdrain located along the east
edge of pavement for SR 89. This pipe is at a depth of about 48-inches to the top
and is in a trench filled with gravel to the bottom of the pavement subgrade.
The District was unaware of the existence of the underdrain. Local Caltrans
maintenance personnel and the consultant who designed the traffic circle project
were also unaware of the underdrain pipe.
This underdrain pipe created a number of problems:
1) The underdrain pipe was at the same elevation as the water pipe. It was
necessary to install two elbows in order to route the new water pipe under the
underdrain.
2) The underdrain trench was five foot deep and full of gravel. It was very difficult
to stabilize the trench walls and the excavation became unnecessarily large
since the gravel would just slough into the excavated area.
3) The underdrain and gravel trench provided a pathway for groundwater to enter
the trench excavation. While crossing SR 89, the trench was dry and the
groundwater table was below the bottom of the trench. Once the underdrain
was encountered, it was necessary to deal with unanticipated groundwater for
another 100 feet of excavation.
4) The underdrain is located along the east edge of pavement. The delays and
additional work associated with this problem required closure of the westbound
1-80 to SR 89 north ramp longer than anticipated.
HSC is due $17,357.80 for delays and additional work associated with this
underdrain.
Item 4: On Richards Boulevard, SBC mismarked the location of an existing telephone duct
bank. Once the markings were corrected, it was necessary to change the pipeline
alignment. This required additional sawcutting at a cost of$690.00.
Item 5: During construction of the pipelines on Richards Boulevard and the east shoulder of
SR 89, significant amounts of rock were encountered. So much rock was
encountered on Richards Boulevard that there was not enough screened material to
use as backfill. Removal of this rock from the trench and off-haul of the rock for
disposal falls into the Contract's rock excavation clause. HSC is due $45,545.49 for
rock excavation.
Item 6: The Contract Documents require the use of imported material for bedding around the
water pipe. For the proportion of the trench between the pipe bedding and the
bottom of the pavement subgrade, it is normally possible for the contractor to screen
the excavated native material to remove large rocks and then place the material back
into the trench as "intermediate backfill".

As noted in Item 5, it was necessary to import material for use as intermediate
backfill on Richards Boulevard because there was so much rock. It was also
necessary to import drain rock for use as pipe bedding on both SR 89 and Richards
Boulevard due to the groundwater at both locations. HSC is due $3,819.25 for
trucking and purchase of this additional material.
Item 7: On Parsenn Road, a vertical conflict arose related to an existing sewer lateral and
fire hydrant that are in close proximity. It was necessary to modify the existing fire
hydrant to accommodate installation of the new water pipeline. HSC is due $442.22
for this additional work.
4. Recommendation:
I recommend that the Board authorize Contract Change Order #1, in the amount of a
$77,354.72 payment to Herbert Suter Construction from the District.

relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on
account of said Change Order. The Contractor agrees to furnish all labor and materials and perform all other
necessary work, inclusive of the directly or indirectly related to the approved time extension, required to complete
the Change order items. This document will become a supplement of the contract and all provisions will apply
hereto. It is understood that the Change Order shall be effective when approved by the District.
