Why this matter is before the Board: The District is proposing to adopt an update to its Water System Master Plan. Prior to adopting the master plan update, the District is required to complete an environmental review in compliance with CEQA. 2. History The Board of Directors authorized the filing and distribution of the draft Initial Study and Proposed Mitigated Negative Declaration at the April 7, 2004 board meeting. The Board held a public hearing at the May 5, 2004 board meeting at which time no comments were received from the public, To date,no comments have been received from any of the reviewing agencies. The State Clearinghouse review period closed on May 12, 2004. 3. New information We have completed the final Negative Declaration and Notice of Determination for Truckee Water System Water Master Plan Update. Also included with this package is the Department of Fish and Game Certificate of Fee Exemption. The final documents need to be filed with the County Clerks of Nevada and Placer Counties and State Clearinghouse, 4. Recommendation I recommend the Board take the following actions regarding the environmental review for the Truckee Water System Water Master Plan Update: I. Adopt the Final Mitigated Negative Declaration. 2. Approve the project for purposes of CEQA. 4. Findings of Exemption: An initial study has been conducted by the Truckee Donner Public Utility District so as to evaluate the potential for adverse environmental impact. When considering the record as a whole there is no evidence before the Truckee Donner Public Utility District that the proposed project will have potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. The Truckee Donner Public utility District has, on the basis of substantial evidence, rebutted the presumption of adverse effect contained in Section 753.5 (d) of Title 14, Code of California Regulations.
