Why this matter is before the board: Board Authorization is required to abandon an easement. 2. History: There is an existing 16-foot wide public utility easement along the side property line between 14792 Alder Creek Road (APN 46-310-20) and 14808 Alder Creek Road (APN 46-310-21). 3. New information: The owners of the two parcels have requested an adjustment to the lot line between the properties. This lot line adjustment includes two components that impact the District. a) Abandonment of the existing public utility easement b) Dedication of a new 16-foot wide easement based on the new property line. There are not any existing water system facilities located within this side easement and the Water Department has no objection to abandonment of the existing easement. Similarly, there are not any existing electric system facilities located within this side easement and the Electric Department has no objection to abandonment of the existing easement. 4. Recommendation: The Board of Directors adopt a resolution officially abandoning the existing 16-foot wide public utility easement along the side property line between 14792 Alder Creek Road (APN 46-310-20) and 14808 Alder Creek Road (APN 46-310-21). Foster Civil Engineering, Inc. are requesting the abandonment of a 16-foot public utility easement located at 14808 Alder Creek Road. This easement runs along the property's northern side property line. The applicant is requesting the easement abandonment so that it may correspond with the proposed Lot Line Adjustment (Town Application No. 05- 055/LLA). Currently the residence on lot 46-310-21 is constructed over the property line of APN 46-310-20. The proposed lot line will be relocated to allow the residence to be located entirely on APN 46-310-21, and within the required setbacks of the parcel. The above-referenced request for an abandonment of a public easement has been submitted for review to the Community Development Department, Planning Division.
