Why this matter is before the board: Board Authorization is required to grant an easement on District property 2. History: The Town of Truckee Trails &Bikeways Master Plan calls for a paved trail running from Trails End Road at Pioneer Commerce Center to Bridge Street. This trail segment is shown on the attached map taken from the Town document. 3. New information: A condition of the Development Agreement between East-West Partners (EWP) and the Town of Truckee calls for EWP to construct the trail. The trail is actually located upon land owned by the District. This land has been identified as the site of the District's new corporation yard. EWP would like to begin construction of the trail in the near future. Either in the Fall of 2007 or the Spring of 2008. EWP is requesting that the District grant approval for a right-of-entry to allow EWP to construct the trail. Granting of the right-of-entry would also correspond to granting of an easement to the Town of Truckee for public use and future maintenance of the trail. District staff has reviewed the proposed trail and believes that it can be accommodated within the design of the corporation yard. I will be meeting with EWP and Town of Truckee Staff on Monday September 17 to discuss some design details and review the planned alignment in the field. A detailed easement document has not yet been prepared. There are some issues regarding liability and hold harmless agreements that require further discussion with the Town. I would expect that the final agreement would be similar to that between the Town and TTSA regarding the Legacy Trail. 4. Recommendation: 1) Grant a right-of-entry to EWP and the Town of Truckee to allow construction of trail. 2) Direct staff to work with the Town of Truckee to prepare an appropriate easement document.
